HomeMy WebLinkAboutMIN 2025 0226 CC SPC JNT PCMINUTES OF THE CITY COUNCIL OF THE CITY OF MOORPARK AND MOORPARK PLANNING COMMISSION Moorpark, California February 26, 2025 A Joint Special Meeting of the City Council of the City of Moorpark and Moorpark Planning Commission was held on Wednesday , February 26, 2025, at 6 :30 p.m. in the Council Chambers of said City located at 799 Moorpark Avenue , Moorpark , California . All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Enegren called the meeting to order at 6:31 p.m . 2 . PLEDGE OF ALLEGIANCE : Planning Commissioner Landis led the Pledge of Allegiance . 3. ROLL CALL: Present: Commissioners Alva, Hamalainen, Landis , and Winters. Commissioner Dicecco . Absent: Present: Councilmembers Barrett , Castro, Delgado, Means, and Mayor Enegren . Staff Present: Troy Brown , City Manager; Kevin Ennis , City Attorney; Diana Varat , Assistant City Attorney; Zach Heinselman, Assistant City Attorney ; Hiromi Dever , Finance Director; Jeremy Laurentowski , Parks and Recreation Director; Daniel Kim, City Engineer/Public Works Director ; Doug Spondello, Community Development Director; April Rosser, Management Analyst -Housing; Chris Thompson , Senior Information Systems Administrator; Captain Darin Hendren , Ventura County Sheriffs Office ; and Ky Spangler , City Clerk . 4 . PUBLIC COMMENT: None. 5. PRESENTATION/ACTION/DISCUSSION: A. Receive Update on New Housing-Related Laws . Staff Recommendation : Rece ive presentation. Mr. Ennis gave a brief oral report and introduced Assistant City Attorneys Diana Varat and Zach Heinselman. Ms. Varat and Mr . Heinselman gave a PowerPoint presentation on new housing-related laws . Minutes of the City Council & Planning Commission Moorpark , California Page 2 February 26, 2025 A discussion followed among Councilmembers, Planning Commissioners, and staff, which focused on: answering questions to gain understanding of limitations and objective versus subjective standards , including those set on projects where there is a development agreement; it was noted that the "builder's remedy " provision of AB 1893 does not apply in Moorpark because the City's Housing Element has been approved by the State; it was noted the enforceability of owner-occupation and no short term rental of units constructed pursuant to SB 9 is difficult ; SB 9 mandates application processing 60 day or the application is deemed approved; AB 2533 allows legalization of unpermitted accessory dwelling units and junior accessory dwelling units constructed before January 1, 2020; SB 1123 , applicable to both fee ownership and common interest developments , provides that no parking is required for units constructed within a half mile of a transit site ; discussion of and clarification regarding requirements for housing development on commercial sites permitted under AB 2011 which is limited to very specific development types ; clarification on how AB 2011 could apply to the Downtown Specific Plan area; AB 2011 and SB 6 include many requirements including payment of prevailing wage for construction ; there is no provision in State law that grants local jurisdictions with approved Housing Elements relief from ministerial approval requires under these laws ; there have been legal challenges to these bills resulting in additional legislation ; the City has received no applications under SB 9 ; it was noted cities may not downzone General Plan densities below 2018 levels without transferring densities to another location and adopting objective standards that reduce density is not permissible. ADJOURNMENT: Councilmember Means moved and Mayor Enegren seconded a motion to adjourn the Special Joint Meeting of the Moorpark City Council and Planning Commission .
