MOORPARK CITY COUNCIL
AGENDA REPORT
TO: Honorable City Council
FROM: Hiromi Dever, Finance Director
DATE: 04/16/2025 Regular Meeting
SUBJECT: Consider Resolution Updating the Citywide Schedule of Fees and
Service Charges including Development Impact Fees, and Rescinding
Resolution No. 2024-4267
BACKGROUND
California Government Code Section 66014 authorizes cities to charge fees for services
that may not exceed the reasonable costs of the service being provided. Additionally,
Sections 66016, 66018, and 6062(a) set forth the notification and public hearing process
required prior to levying fees or service charges, or prior to increasing an existing fee or
service charge.
In accordance with the provisions of Section 66017 of the Government Code, a public
hearing notice was advertised in a newspaper of general circulation for the subject matter.
This Government Code Section also provides that certain fees shall take effect no sooner
than 60 days from the date of adoption.
On February 1, 2023, the results of the comprehensive fee study and its recommendation
was presented to the City Council and Resolution No. 2023-4157 was adopted approving
the fees that were outlined in the study. The Resolution authorized periodic adjustment
to the Schedule of Fees and Service Charges to ensure the cost of services were
recovered. The methodology of annual updates of User and Regulatory Fees used the
annual percentage change in Consumer Price Index (CPI) while the annual updates of
Development Impact Fees used the annual percentage change in Construction Cost
Index (CCI) for the period ending in May.
On September 4, 2024, the City Council adopted Resolution No. 2024-4267, updating the
Schedule of Fees and Service Charges, including real time billing rates. This Resolution
authorized staff to update User and Regulatory Fees using the annual percentage change
in the All-Urban Consumer Price Index for Los Angeles-Long Beach-Anaheim, CA for the
12-month period ending in February.
Item: 8.B.

Page 2
On December 18, 2024, Ordinance No. 524 was adopted which included the methodology
of periodic adjustment to Development Impact Fees using CCI for the Los Angeles Region
as reported by Engineering News Record (ENR) for the 12-month period ending in
February.
DISCUSSION
Proposed Schedule of Fees and Service Charges, effective July 1, 2025, updates User
and Regulatory Fees by the February 2025 annual percentage change in the All-Urban
Consumer Price Index for Los Angeles-Long Beach-Anaheim, CA. For February 2025,
the annual change in CPI was 3.1%.
Proposed Schedule of Fees and Service Charges for Development Impact Fees (DIFs),
effective July 1, 2025, updates DIFs by the February 2025 annual percentage change in
the Construction Cost Index for the Los Angeles Region. For February 2025, the annual
change in CCI was 2.5%
There are no proposed updates to real time billing rates for staff time. Real time billing
rates will be updated the next time salary rates are updated.
A Public Hearing Notice was published in the Ventura County Star newspaper on April 6,
2025, and April 11, 2025. The Notice was also emailed to the Gas Company, as per their
requests, and posted on the City’s website and posting board.
The draft Schedule of Fees and Service Charges attachment becomes effective July 1,
2025, and is attached an Exhibit to the attached Draft Resolution.
ENVIRONMENTAL DETERMINATION
The Community Development Director has determined that the update to Schedule of
Fees and Service Charges is exempt from the provisions of the California Environmental
Quality Act (CEQA), in that the action of the City Council does not involve the
consideration of the approval of a project. In addition, pursuant to Public Resources Code
Section 15273, CEQA does not apply to the modification of rates, fares, or other charges
which are for the purpose of meeting operating expenses.
FISCAL IMPACT
Adjustment to the Schedule of Fees and Service Charges will result additional revenues
generated in the City for programs and services and contain subsidy costs for certain
services. Further, adjusting DIF fees provides a mechanism for the City to keep pace
with escalating costs for capital improvement projects identified in the Fee Study.
COUNCIL GOAL COMPLIANCE
This action does not support a current strategic directive.
