TERRY STRAUGHAN TO: The Honorable City Council FROM: Marshall Julian, City Manager DATE: June 28, 1984 SUBJECT: MOUNTAIN MEADOWS CABLE TELEVISION FRANCHISE PROPOSED ACTION: Direct the Amendment of TV franchise awarded to Mountain Meadows Cable Television in order to clarify certain sections. BACKROUND INFORMATION: l' See attached letter for Mountain Meadows Cable Television. SECTION 1. . Clarifies that the area of franchise service is the Urban West development, as opposed to the city in general. SECTION 2. . Same SECTION 8. . Modifies language by spelling out the Basic - .. Service currently being provided by Storer Cable. Purpose of this language is to clarify "Basic Service" and to establish that as a "floor" for service in the future. While not in Urban West's letter; in order to make the franchise a viable document for the full 15-year period of the franchise, "Storer Cable Television" should be replaced by language referring to "the major cable television firm serving elsewhere in the city" SECTION 8. . The deletion of reference to Group W Cable reacts in favor of subscribers in the city, inasmuch as it removes the possibility of rates being geared to a higher Group W rate r- (outside the city and over which there is no local control) . SECTION 9. 3 Provides that the type of equipment to be supplied to School District by Urban West would be selected by the District. SECTION 12. This change involves ownership of conduit on private property. This is a matter between private parties and it is question- able whether it should be included in the franchise agreement. The above proposed changes should be referred to the City Attorney for incorporation in the franchise by amendment. SUGGESTED MOTION: That the proposed changes to Sections 2,4 ,8 and 12 of the franchise awarded to Mountain Meadows Cable Television, outlined in the letter from the franchise holder, dated June 25, 1964 , be referred to the City Attorney for placing in the form necessary to amend the franchise. Box 701 Moorpark, CA 93021 Dear Mr. Julian: As you are aware, through meetings with ,City staff and Council hearings on the Mountain Meadows Cable Television Franchise, we are currently working with Entertainment Express Corporation as our cable television contractor at Mountain Meadows. In those meetings, the system to be built and the service to be provided by Entertainment Express Corporation was discussed. Section 7.5 of the recently adopted franchise, City of Moorpark Resolution No. 84-99, states that "the City Manager of the .City shall have the right of prior approval of each such cable tele- vision contractor, and such right of approval shall be reasonably exercised" . • In compliance with the above mentioned franchise, we respectfully request that you approve Entertainment Express Corporation as the cable television contractor for the Mountain Meadows Cable Tele- vision System.
