Latunski and Clement General Plan Amendment and. Zone Change
Applications (GPA's 813-1A&1B/ZC's 88-2A&2B)
At the City Council's meeting of February 1, 1989, the Council
determined. that the City would continue to waive the processing fee
.related to staff work on processing of a General Plan amendment and zone
change for the Latunski and. Clement properties; however, the Council
further determined that the Cit:y would riot be responsible for any direct
processing costs related to these applications. The specific costs which
the Council determined that Mr. Latunski and Mrs. Clement would be
responsible for were those associated with the preparation of a Traffic
Study and public hearing noticing costs.
Staff subsequently notified Mr. Latunski and Mrs. Clement on February 8,
1989, of the costs which they would be required to pay before any further
work would be done on their application (Letter attached). On February 27,
1989, staff sent a followup letter to Mr. Latunski. and Mrs. Clement giving
them until the end of March to :respond. To date, no response has been
received from Mr. Latunski. Mrs. Clement has responded that she is
unwilling to pay the identified costs (response. attached).
Staff is recommending that the files be closed for the referenced General
Plan amendment and zone change applications. Staff considered the option.
of adding these proposals into the General Plan update that is currently
under preparation; however, this would require amending the scope of the
contract with PBR Inc. Also, if Mr. Latunski. and Mrs. Clement are not
willing to pay the costs :identified in our February 8 letter., they would
probably not be willing to participate in. the prorated costs that all of
the other General Plan. Update applicants are sharing. We are, therefore,
recommending that no further work be done on the Latunski and Clement
applications and that the files be closed.

At the City council's meeting of February 1, 1989, the Council determined
that the City would continue to waive the processing fee related to the
processing of a General Plan amendment and zone change for your property at
213 East Los Angeles Avenue, but would not be responsible for any •direct
processing costs. Specifically, the direct costs associated with the
processing of your application include a maximum of $6,000.00 to have the
City Traffic Engineer prepare a Traffic Study analyzing the traffic impacts
associated with changing the land use designation and zoning for your
property to commercial, $50.00 for publication of public hearing notices in
the newspaper, $13.00 for mailing notices to residents within 300 feet, and
$200.00 for the construction and posting of a sign notifying the time and
place of the public hearing for the project. In lieu of paying the City
$200.00 for a public hearing sign, you have the option of providing your
own sign for the public hearing noticing. A copy of our requirements for
public hearing signage is enclosed.
If you elect to assume responsibility for providing the public hearing
sign, the estimated cost of the identified direct costs which you must
deposit is $6,063.00. If you elect to have the City provide the necessary
signage, the amount of the required deposit is $6,263.00. In addition, you
may be subsequently billed a maximum of $564.00 to pay for the City
Engineer's staff review of your application if such review is determined
necessary.

processing of a General Plan amendment and zone change for your property
located approximately 1,800 feet north of Casey Road and 1,500 feet west of
Walnut Canyon Road; however, the Council further determined that the City
would not be responsible for any direct processing costs: Specifically, the
direct costs associated with the processing of your application include a
maximum of $1,000.00 to have the City Traffic Engineer prepare a Traffic
Study analyzing the traffic impacts and circulation system issues
associated with changing the land use designation and zoning for your
property, $50.00 for publication of a public hearing notice in the
newspaper, $3.00 for mailing notices to residents within 300 feet, and
$400.00 for the construction and posting of two signs notifying the time
and place of the public hearing for the project. In lieu of paying the City
$400.00 for public hearing signs, you have the option of providing your own
signs for the public hearing noticing. Two signs would need to be
provided, one on your property and one along Casey Road near the access
road to your property. A copy of our requirements for public hearing
signage is enclosed.
If you elect to assume responsibility for providing the public hearing
signs, the total estimated cost of the identified direct costs which you
must deposit is $1,053.00. If you elect to have the City provide the
necessary signage, the amount of the deposit,is $1453.00. In addition, you
may be subsequently billed a maximum of $568.00 for the -City Engineer's
staff review of your application if such review is determined necessary.

No further work will be done by the Community Development Department on the
processing of your application until we receive a deposit of one of the two
aforementioned amounts from you. Once this deposit has been received, we
will resume working on your application.
The City Council by consensus decided not to require evidence of legal
access to your property as a prerequisite to proceed with the processing of
a General Plan amendment and zone change. It is expected, however, that
this matter will be an issue in the staff analysis for this proposal.

Our February 8, 1989, letter to you identified the amount of money you
needed to deposit with the City for preparation of a traffic study and for
the public notification costs related to the processing of your application
for a general Man amendment and zone change. Ti. we have not received a
deposit or a response from you by March. 31, 1989, we will. be scheduling
this matter before the City Council to request a denial wil:hout prejudice
