SUBJECT: TO CONSIDER REMOVING WESTLAND COMPANY FROM THE GENERAL PLAN
UPDATE PROCESS
The Westland Company of Ventura is requosting that the City Council to
consider the removal of their application from the Generill Plan Update
process so as to develop the Moorpark Ranch and Milling property with 98
affordable. townhouses and 156 single farni ly residential dwelU.ngs.
The subject site is approximately a '.35-·acre parcel located at 850 Los
Angeles Avenue just west of Liberty Bell Road. The property i8 currently
zoned R-1-13,000/du.
Discussion
To develop the property with the densJty proposed will require a General
Plan Amendment and rezoning of the property. The current General Pl an
Update is expected to be completed in November 1990. Any General Plan
Amendment /Zone Change will require a. public hearing before both the
Planning Commission and City Council. Also any such reques_t would require
an environmental review under the California Environmental Quality Act.
The Wefltland Company has proposed a June 1990 completion date. This
t:lme-frame appears ambiguous. To process any application for a General
Plan Amendment: outside of the update process wlll have an impact on City
staff.
This request has the potential to fos ti:>.r other similar demands upon the
City. Should this request he allowed to be separat<~d from the upda.te
process both clear and substantial fin<l:ings must be evidenced by the City.
The subjeGt property is currently zoned R-l·-l3,000/d11. This zoni.ng would
allow approximately 117 units to occupy Ute site.

revising my November 16, 1989 letter to you to more accurately·
reflect the items discussed at our meeting on November 16, 1989.
This revised letter is being forwarded directly to the .Council as
part of their packet for consideration on December 6. This n)te
merely advises you of the fact that the earlier draft has been

EXECUTIVE SUMMARY
DEVELOPER
Hartman Land Inc., a development firm based in the city of
Ventura and active in development throughout Ventura county,
proposes a ~arket priced/affordable priced residential project
for the 30 +/-net acre property located on Los Angeles Avenue
near the Shasta Avenue intersection.
DEVELOPMENT PROPOSAL
o Up to 100 affordable for sale townhomes and condominium
units on 6 +/-net acres
o 156 single family detached units on 25 +/-net acres
AFFORDABLE COMPONENT
We have had preliminary discussions with the Council Affordable
Housing Committee in connection with the specifics of the
affordable proposal with contemplated sales prices targeted at
sot of median income, resale restrictions, marketing preferences
and the like which is envisioned to be proper and necessary to
achieve and help the city meet its Regional Housing Needs
Allocation and the goals of its General Plan.
1J)PROVAL PROCESS
o Property is already part of current General Flan Update
o Property needs General Plan Amendment, zone change,
tentative map and PD permits for each of the three different
housing types, a development agreement and allocations undQr
Measure F
o Consideration should be given to fast track processing by
hiring a planning consultant under City direction paid for
by the applicant
o Property will apply for density bonus consideration
PROPOSED BENEFITS TO CITY
o Up to 100 affordable for sale residential units on land that
is close to City services
o Development of property will assist in establishing a
quality appearance for Los Angeles Avenue and help the
redevelopment area of which the property is a part
o Property can mitigate traffic by provisions of a connector
street from Goldman Avenue to Unidos Avenue that will

o Affordable units help City meet its RI-INA housing goals and
General Plan housing element
o Applicant shall provide the cost associated with the
expedited planning process and will provide $5,000
immediately to the City to defer staff processing costs
needed before formal applications are filed
SCHEDULE
To achieve implementation of a proposal it is necessary that all
applications be processed and the proposed project is available
for receipt of Measure F allocations by June, 1990, or in the
alternative, use same method to reserve necessary allocations for
the project in the 1990 cycle.
REQUEST
Give staff direction to proceed with processing the applications
necessary for the proposal and commence negotiation with the
applicant for the development agreement which will serve, among
other things, to regulate the affordability of the affordable
component proposed.
Attached hereto is a more datailed presentation of the proposal.

Gentlemen:
In furtherance of our meeting a short time ago, this letter
respectfully sets forth (l) our development proposal,
particularly the affordable component, (2) a suggested approach
for processing needed City approvals, and (3) a request that the
Affordable Housing Committee and, to the extent proper and
necessary, the full Council, authorize and instruct staff tcf~.:
initiate fast-track processing of the necessary applications to
implement our proposal. The letter has been revised slightly
since our meeting on November 16, 1989.
DEVELOPMENT FROPOSAL
The subject property consists of approximately 30 net acres
(after deducting on-site road improvements) which is located on
Los Angeles Avenue near the Shasta Avenue intersection. on
approximately 6 acres we propose constructing 98 affordable
townhomes in accordance with an affordable program that we find
mutually acceptable. Attached hereto please find a suggested
affordable program that can serve as a starting point for further
discussion and consideration. We further propose developing 156
single family detached units on lots si~ed at approximately s,ooo
square feet each. These units would be aold at "market" rates.

Tract Map.
It will be necessary to process a tentative tract map:
Development femit.
We understand that a planned development penuit will be
necessary to enable construction of the residential dwelling
units, both affordable and market. We request three (3)
separate PD pernits for each housing type proposed, to wit:
single family detached, affordable, and market rate multi-
family townhomes. •
Developm~nt Agreement.
As you had previously suggested, a project such as this
seems to·be properly the subject of a development agreement
within which we can assure implementation and proper
administration of the envisioned affordable housing program
and vest our development rights to complete the project in
accordance with whatever conditions are attendant to City
approvals. We believe that it would be mutually
advantageous to concurrently process the applications
connected with the above-described steps thereby enabling a
comprehensive review of all issues associated with the
proposal and enabling a time savings that would track the
June 1990 deadline for Measure F residential allocations.
We expect that your staff will have a reasonably accurate
understanding of what off-site improvements will be
necessary for this project and can negotiate, with or
without council participation, the appropriate affordatile
program during the period that the land use applications are
being processed so that the d~velopment agreement can be
approved by the City Council current with or immediately
following approval of the land use entitlements.

We are prepared to proceed immediately with the filing and
processing of a'll necessary applications and colnll\encing
negotiation of the affordable program and development
agreement. Accordingly, we need your support for proceeding
with this proposal as promptly as possible.
Please instruct staff to (a) receive and process the applications
necessary for our proposal, (b} authorize-the hiring of an
outside consultant to process our applications, and (c) authorize

approvals and the development agreement can come before Council
