DEEWAYNE JONES, D.D.S FOR THE CITY TO INITIATE A GENERAL PLAN AMENDMENT FOR A FOUR ACRE PARCEL LOCATED CONTIGUOUS WITH THE SOUTHWEST QUADRANT OF MISSION BELL - PHASE 2 (ASSESSOR'S PARCEL NO. 511-08-42) Background The applicant is requesting permission to concurrently process a General Plan Amendment, Zone Change, Tentative Parcel Map and Commercial Planned Development Permit. The property consists of approximately 176,625 square feet with approximately 471 feet of frontage along Los Angeles Avenue. The proposed project is bound by residential properties on both the north and west and has a Land Use Designation of M (Median Density Residential). Staff does not accept an application for a General Plan Amendment unless the City Council concurs with the initiation of the requested amendment. Discussion The applicant's request is to authorize staff to process a General Plan Amendment for a change in the existing M (Median Density Residential) land use designation of the property in the Land Use Element of the General Plan to C-2 (General Commercial). The proposed change to the Land Use Designation of the General Plan and zone change to CPD would make the applicant's proposed project consistent with the allowed uses on the land. The applicant's proposed development would consist of a General Plan Amendment, Zone Change, three lot Tentative Parcel Map and a Commercial Planned Development for three buildings. Parcel 1 would consist of a two story 12,000 square foot office building and would be located west of the existing commercial development; Parcel 2 would be located easterly of existing residential properties and would contain a 5,500 square foot restaurant; and Parcel 3 would be developed with a multistory 53,000 square foot office building. Staff Analysis The request for a C-2 General Commercial Land Use Designation would be consistent with the existing land use (Mission Bell 000267 Plaza) designation to the east of the proposed development but could create compatibility problems with the adjacent residences to the residential properties to the north and west. For example, a restaurant may create sufficient noise in the parking area to adversely affect the residents in the area and an office building in excess of two stories may create an adverse visual impact to the residences. Consistency with City Council Guidelines for Screening of General Plan Amendments Resolution No. 94-1055 adopted by the City Council on August 17, 1994 established criteria to be used by the City Council as justification to deny or approve the processing of a General Plan Amendment (see attachment No. 3). The proposed General Plan Amendment coupled with commercial development that would be considered compatible with the residential properties to the west and north could be considered consistent with the following criteria for approving the processing of a General Plan Amendment: 1. The proposed amendment request is consistent with or has a potential for consistency with the City's General Plan, including applicable goals and policies. 2. The proposed amendment request is compatible with or has a potential for compatibility with either existing or planned uses for the surrounding properties. 3. The proposed amendment request has the potential for conformity with other City Council adopted policies. 4. The proposed amendment request has the potential to provide, through the project approval process, public improvements, public services, public amenities, and/or financial contributions that the City Council determines to be of substantial public benefit to the community. Review of Proposal by Community Development Committee Staff will be discussing the applicant's proposal with the Community Development Committee at it's meeting of April 1, 1996 and will report the Committee's comments to the City Council at the April 3, 1996 meeting. Concurrent Processing of General Plan Amendment with other Discretionary Projects Processing a General Plan Amendment and Zone Change together is a legislative act which does not have time constraints for completion. However, other discretionary projects such as a F Tentative Parcel Map and Commercial Planned Development must be completed within specified time frames once the projects are deemed complete. Processing a Zone Change and General Plan Amendment without a Tentative Parcel Map and Commercial Planned Development would alleviate the problem of exhausting the case processing time constraints as required by the Streamlining Act. Recommendations: 1. Direct staff to accept a General Plan Amendment to change of Land Use Designation from M to C-2. 2. Authorize staff to accept an application for processing a Tentative Parcel Map, Zone Change and Commercial Planned Development Permit after the General Plan Amendment is heard by the Planning Commission at a public hearing. Lawrason, Hayor City of Moorpark 799 Moorpark Avenue Moorpark, California 93021 Re: Pre Application n Medical Arts Plaza Project n 4 Acre Gisler Property APN 511-08-42 Dear Mayor Lawrason and Members of the City Council: I am asking the Council to approve my Pre Application for a Medical Arts Complex and related Commercial on the 4 Acre Gisler property. It is located and contigious with the S/W Quadrant of the Albertson's Shopping Center to the East and Los Angeles Avenue to the South. It is bounded on the North and West by SFR. The property was in escrow for over a year to a developer who wanted to build SFR's. He could not make the numbers work so he cancelled the escrow last fall. It has been my dream to build a Medical Arts building where Hedical/Dental and related Health Professions could come together in one beautiful location to better serve the needs of our Community. This property caught my eye for several reasons.... It seemed to be an extension of the Albertson's Shopping Center ....there is good visibility.... there would be good access from the signal at Liberty Bell Road .... the project would be a nice transition from R-1 to the Shopping Center.... storm drain and Los Angeles Avenue improvements already completed ....the site is centrally located to all areas of the City ....and it became available again: The project would consist of two (2) retail pads and a multiple story Medical Office building of approximated 53,000 square feet. OF MOORPARK, CALIFORNIA, RESCINDING RESOLUTION NO. 85-209 AND ADOPTING NEW GUIDELINES 11'UR THE SCREENING OF GENERAL PLAN AMENDMENT REQUESTS Ci lerk WHEREAS, Resolutioni`No, 85-209 established guidelines screening of General Plan amendments; and for the WHEREAS, the City Council has determined that Resolution No-,=- 85-209 should be revised; and WHEREAS, Government Code Section 65300 directs the adoption of a comprehensive, long-term General Plan for the physical development of the City and of any land outside its boundaries which in the planning agency's judgment bears relation to its planning; and WHEREAS, Government Code Section 65358 provides for the amendment of the General Plan; and WHEREAS, the City Council deems it desirable to continue to pre-screen all requests for General Plan amendments and determine, based on adopted criteria, those re ests for which accept a formal General Plan amendment application. the City shall NOW, THEREFORE, THE CITY COUNCIL OF THE CALIFORNIA, RESOLVES AS FOLLOWS: CITY OF MOORPARK, SECTION 1. Resolution No. 85-209 is hereby rescinded in its entirety. SECTION 2. The following criteria will be used by the City Council as justification to deny the processing of a General Plan amendment request: 1• The proposed amendment re similarities with other amendment requests for nificproperties locatedlocated in the same general area of the City or its Area Of Interest, and those other amendments have been previously considered and denied by the City Council within the preceding twelve- (12) month period. 2 • The proposed amendment request site is located in an area or is the site for which the City Council has initiated a General Plan amendment, zone change, or land use study scheduled for a public hearing within the next twelve- (12) month period. 3• The proposed amendment request would create a spot land use designation inconsistent with the planned land use for the surrounding properties and inconsistent with the goals and policies of the General Plan. The following criteria will be used by the City Council as justification to approve the processing of a General Plan amendment requeet: 1• The proposed amendment request is consistent with or has a potential for consistency with the City's General Plan, including applicable goals and policies.- 2. The proposed amendment request is compatible with or has a potential for compatibility with either existing or planned uses for the surrounding properties. 3• The proposed amendment request has the potential for conformity with other City Council adopted policies. 4.
