On April 18, the Planning Commission discussed the brelth of review
which will be given to the Land Use Element Update as a result of
possible private party General Plan Amendment applications to be
submitted for processing in conjunction with the City's update.
Upon the Commission's request, staff indicated that twelve property
owners had discussed or requested General Plan Amendment applications
for processing with the update. The net effect if all applications
are in fact filed and approved by the City would be an increase of
approximately 2000 dwelling units within the City limits and 17,000
dwelling units outside of the City. This would increase the General
Plan's holding capacity of 35,740 to 85,000 people. Specific infor-
mation regarding those applications received by the May 1 deadline
will be provided at your Council meeting.
After a lengthy discussion of this subject and its possible ramificat-
ions, the Commission acted to recommend that the City not include
with the update any private party amendment request involving more
than 20 acres of land. The motion was made by Commission LaPerch
and seconded by Commission Hartley. The motion passed 2 - 1 with
Commissioner Schleve <iecenting and Commissioner's Rosen and Holland
absent. ~
A subsequent discussion was held by the Commission on April 25.
The issue of screening amendment requests was discussed by the
Commission. By a unanimous vote, the Commission took action
to recommend to your Council that future General Plan Amendment
requests be submitted to the Planning Commission for an advisory
review prior to actual submittal. The motion was made by Commissioner
Hartley and seconded by Chairman Holland.

An amendment to the motion to also require such a review of amendment
request presently being submitted for processing with the update
was defeated. The main motion was adopted by the Commission on
a 3 - 2 vote with Commissioners LaPerch and Schleve decenting.
After review by the City Attorney of the Commission's request, it
is recommended that such an informational review be available to
applicants, but not a requirement. It is the City Attorneys advice
that by making this review voluntary, an applicant would be less
able to claim the review was prejudicial or that the City had made
a commitment to approve the proposal.
RECOMMENDED ACTION
1. Direct the processing of General Plan Amendment requests as part
of the General Plan Update only if they encompass an area of
20 acres or less.
2. Adopt a policy that future General Plan Amendment requests may
be presented to the Planning Commission on a voluntary basis
for an advisory review prior to the formal submittal of an
application.
