SUBJECT: AMENDMENT TO THE LAND USE ELEMENT
BACKGROUND
This item is the result of the City Council Resolution No. 86-281 initiating
a consideration of either a change in zoning to PC (Planned Community) or
requiring a Specific Plan on the subject property. Attached is the Staff
Report to the Planning Commission discussing the merits of the alternative
proposals. Staff had recommended the Specific Plan approach.
PI ANNING COMMISSION ACTION
At the Planning Commission of April 23, 1986, Mr. Glen Guessford, representing
the owners of the property, stated that they were willing to advance the money
for the Specific Plan but objected to so designating the property on the Land
Use Map since this removed the option of developing the property, or a portion
thereof, at the existing Residential zoning without the adoption of the Specific
Plan. The Commission felt however, that the property should be so designated
and, by unanimous vote, so recommends. In order to conserve on General Plan
changes (four per element per year allowed) this change can be combined with
the General Plan changes on the other item of the agenda ("Changes to the
General Plan and Zoning Ordinance")
RECOMMENDATION
1. Approve the Negative Declaration amending the change to the Land Use Map
of the Land Use Element of the General Plan.
2. Approve the change of the Land Use Map designation on subject property
to include the works "Requires a Specific Plan".

RESOLUTION NO. PC-86-96
( A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL
THE LAND USE MAP OF THE LAND USE ELEMENT OF THE GENERAL
PLAN BE AMENDED TO ADD THE WORDS "THIS AREA REQUIRES
APPROVAL OF A SPECIFIC PLAN".
WHEREAS, Section 8164-1 of Article 22 of Chapter 1 of Division 8
of the Zoning Ordinance of the City of Moorpark provides that the City Council
may initiate proceedings to consider amendments to the Land Use Element of the
General Plan; and by Resolution No. 86-281, adopted February 24, 1986, requested
the Planning Commission of said City to set the matter for public hearing to report
and make its recommendations; and
WHEREAS, at duly noticed public hearing on April 23, 1986, the Moorpark
Planning Commission considered the matter of amending the text of the Land Use
Element of the General Plan of said City in various particulars to; make more
explicit that the maximum density authorized by the General Plan is not an auto-
matic right; authorize "density averaging" in the "Rural Zones" subject to certain
conditions; and to include certain zoning districts including, but not limited
to "Commercial Office and "Highway Commercial"; and
WHEREAS, the Planning Commission has held a duly noticed public hearing,
has carefully considered said information contained in the staff report dated
April 23, 1986, and has reached its decision in the matter:
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Planning Commission hereby recommends to the
City Council that the Land Use Map of the Land Use Element of the General Plan
be amended to add the words as follows:
"This area requires approval of a Specific Plan" to the
Land Use Designation on that property bounded on the east
by the 23 Freeway, on the south by Tierra Rejada Road, on
the west by Moorpark Road, and on the north by the Arroyo
Simi and New Los Angeles Avenue (generally known as Carls-
berg Development Company property)".
SECTION 2. That at its meeting of April 23, 1986, the Planning
Commission took action to request staff to prepare a resolution recommending
to the City Council the Land Use Map of the Land Use Element of the General
Plan be amended; said resolution to be presented for Consent Calendar action
at the next regularly scheduled meeting. The action with the foregoing direction
was approved by the following roll call vote:

AMENDMENT TO THE LAND USE ELEMENT
BACKGROUND
At it' s March 3rd 1986 meeting the City Council adopted a Resolution
of Intention to consider either requiring a__change_ of zone to PC (Planned.
Community) or require a Specific Plan on',495 acres commonly know as the _
"Carlsberg" property as shown on "EXhibit A" hereto.
At a previous meeting the Council had denied a General Plan amendment
to Industrial on 128 acres in the northeast corner of/ the property
Prior to City incorporation, the County had initiated action to change
the property to PC but the action was never completed. The property
owner (Carlsberg) recently submitted a tract map and a Residential
Planned Development on all but the northeast corner of the property,
however, two areas (one of R0 acres and one of 4 acres) were left
blank. Knowning the Council' s concern on the overall planning for
this property, _ took the matter to the Council to discuss the
possibility of PC zoning or of requiring a Specific Plan on the total
property. As a result the Council adopted the aforementioned Resolution
of Intention.
Analysis of PC Zoning/Specific Plan
PC Zoning:
The PC zone was established by the County for "balanced and diversified
large scale planned communities. " When action is taken to change
the zone on property to PC, such action must include a Master Plan,
a Specific Plan or Plans, and a Development Program. The zone was
established primarily for very large areas with various uses and one
that was to be developed over a long period of time. As various pieces
of the property are ready for development the zoning is required to
be changed from PC to whatever is appropriate for the planned use.

STAFF REPORT: CARLSBERG - PC/Specific Plan
Specific Plan:
The State Planning Act authorizes Specific Plans for "the systematic
implementatation of the General Plan for all or part. of the area covered
by the General Plan" . Such plan can be very effective, and advantageous
to the City as well to property owner(s) , when piece-meal development
of a particular area can result in undesirable remnants, inadequate
circulation, leapfroging of development, etc. . Also such areas as
a downtown where a coordinated plan is needed can benefit. Specific
Plans must be "consistent" with the General Plan.
Discussion:
Since a Specific Plan must be consistent with the General Plan and
since a change inzones to PC must be accompanied by a Specific Plan,
the present General Plan designation of low density, residential must
be changed if anything other than such residential is planned.
In this writers opinion, commercial and/or industrial as well as varied
densities of residential should be considered for this property. Should
this opinion be)concurred_iny! the General Plan designation-edUld - ---
be "This area requires PC Zoning" or "requires a Specific Plan" .
_ The Council desires the Commission's recommendation as to whether
, __the approach of a coordinated plan for the entire area is required and,
if so, whether it should be a consideration of a PC zone or a Specific_
Plan.
In staff' s opinion the PC zone is overly complicated for this property
and requiring a Specific Plan is appropriate. This could be accomplished
by adding the words "this area requires a Specific Plan" to the Land
Use designation. If the Commission and Council concur, this amendment
to the General Plan could be added to the one in process thus using
only one of the four allowed changes. Once this was done, the property
owner could fund for a consultant to prepare a Specific Plan, and
appropriate General Plan changes, so that the matter could be heard
once General Plan Amendments are resumed. As an alternative, the City
council could commence work on a Specific Plan, if the property owner
funds the. work, under the assumption that approval of tnis process by
the Council constitutes approval of the screening process and thus the.
Plan could be heard upon resumption ofthe General Plan Amendments.
