SUBJECT - General Plan Amendments A
BACKGROUND:
At its August 19 meeting, the City Council discussed the issue of applications for
General Plan Amendments. A list of the eleven applications that had been filed
previously was provided with the agenda letter and is attached hereto.
At the August 19 meeting, staff recommended that (1) applicants be informed that
no applications be accepted until the General Plan elements are completed;
(2) existing applications, along with any fees still with the City (JBR and CAVLICO)
be returned; and (3) staff maintain a list of property owners still interested in a
General Plan Amendment, along with any letters of interest, with the original 11
in the top priority when the process is resumed.
After the staff presentation, Mr. John Newton, representing both JBR and
CAVLICO, stated that his clients were the only ones still having fees on file,
and that since others had not retained their fees on file, or resubmitted, his
clients should be top priority.
Subsequent to the meeting, staff has contacted eight of the other nine original
applicants who no longer have applications or fees on file. It is apparent in talking
with these applicants that not all perceived the intent or meaning of the letter (attached)
returning the fee and informing them that the process of General Plan Amendments
was terminated until the General Plan was completed in the same manner, nor did all
talk to-the Director-of- Community Development regarding. the letter: As a- result, the
majority -of the applicants either assumed that they would be notified when processing
was reinstated, or planned to periodically check with the City. Since contacting
the applicants, three have returned letters of interest, indicating a wish to proceed
when the process resumes, and four others indicated they would also submit letters
of intent.

Staff is still of the opinion that any of the original eleven who are still interested
in applying when the General Plan elements are adopted be all together in a first
priority. (It is assumed that most of them would want a General Plan screening and
due to objections that may arise by the Council, resulting in applicants either
withdrawing or needing time for revisions, the number of applicants ready and
willing to proceed immediately would be a manageable number.) Letters of interest
from other applicants would fall in line behind those left of the original eleven.
RECOMMENDATIONS:
1. That the Council reaffirm its decision not to process any applications for
General Plan Amendments until the General Plan elements are completed.
2. That those of the original eleven submitting letters of interest be classed
as priority one, with any others to follow in order of priority.
3. That the two applications and fees on file be returned.

SUBJECT: GENERAL PLAN AMENDMENT
On May 22, 1985, the City Council directed the termination of pro-
cessing for your General Plan Amendment application and other
applications submitted for consideration in conjunction with the
completion of the City's General Plan. In taking this action,
the Council directed that all deposit fees are to be returned.
Enclosed is a check for the full amount of your original deposit
fee.
The Council also indicated that any party may submit a new application
for a General Plan Amendment. However, hearings on new applications
are not expected prior to the completion of the City' s General
Plan and probably not till 1986.
