ORDINANCE NO. 83
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING CHAPTER 1 ,
ZONING, OF DIVISION 8 OF THE VENTURA COUNTY
ORDINANCE CODE, ADOPTED BY THE CITY COUNCIL ON
SEPTEMBER 21, 1983, PERTAINING TO TEMPORARY
PRODUCE STANDS
WHEREAS, at a duly noticed public hearing on August 27, 1986,
the Moorpark Planning Commission considered a proposed amendment to
certain sections of Chapter 1, Zoning, of Division 8 of the County
Ordinance Code, adopted by the City Council of the City of Moorpark
on September 21, 1983 ; and
WHEREAS, after careful consideration, the Planning
Commission reached its decision in the matter and adopted its
Resolution No. 86-107 recommending approval of said proposed
amendments; and
WHEREAS, public notice having been given in time, form and
manner as required by law, the City Council of the City of Moorpark
has duly considered said proposed amendments and has reached its
decision;
NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. The following eight (8) existing sections are
amended to be affected by this ordinance:

TPD 8135-0. 1.2
APD 8136-0. 1.5
RPD 8137-0. 2.4
OS 8143-4. 11
All temporary produce stands mentioned in the eight ( 8)
sections are amended and shall comply with the following conditions
and limitations:
All temporary stands established or maintained for the
sale of agricultural or horticultural products, grown on the premises,
as permitted by this Article shall conform to the following conditions
and limitations :
1 . The floor areas of such stands shall not exceed four
hundred ( 400 ) square feet each;
2 . Such stands shall not be located or maintained within
twenty ( 20) feet of any public road, street or highway;
3 . A letter shall be submitted by the applicant stating the
days of the week, hours and months of the year that are
intended to be the primary period of operation.
4. Building specifications shall be submitted for approval;
5. Land area must be one ( 1) acre or more;
6. A Conditional Use Permit shall be required (Planning
Commission) .
7 . The existing temporary produce stand, which is located
on A.P. No. 506-0-02-33, shall be exempt from the
provisions of items 3, 4, 5 and 6 of this Section while
at the same location and under the same ownership;
SECTION 2. If any section, subsection, sentence, clause,
phrase or word bf this Ordinance is for any reason held to be invalid
by a court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this Ordinance. The City
Council of the City of Moorpark hereby declares that it would have
passed and adopted this Ordinance and each and all provisions thereof,
irrespective of the fact that any one or more of said provisions
may be declared invalid.
SECTION 3 . The City Clerk shall certify to the passage and
adoption of this Ordinance; shall enter the same in the book of
original ordinances of said City; shall make a minute of the passage
and adoption thereof in the records of the proceedings of the City
Council at which the same is passed and adopted; and shall, within
fifteen (15) days after the passage and adoption thereof, cause the
same to be published once in the Moorpark News, a weekly newspaper
of general circulation, as defined in Section 6008 of the Government
Code, for the City of Moorpark, and which is hereby designated for
that purpose.
SECTION 4. That this Ordinance shall take effect thirty
( 30) days after its passage and adoption.
