MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 07/02/2025 Regular Meeting SUBJECT: Consider Resolution Exonerating Surety Bond No. 800028667 (Grading & Improvements) and Surety Bonds No. 800028668 (Public Improvements Performance and Payment), Condor Industrial Building LLC BACKGROUND AND DISCUSSION On July 15, 2020, the City Council adopted Resolution No. 2020-3935 approving Industrial Planned Development Permit No. 2019-01 and Conditional Use Permit No. 2020-02 for the development of a 48,787 square feet, single-story industrial building and associated improvements on an undeveloped 3.46-acre site at 5850 Condor Drive. On May 8, 2023, the Public Works Department issued Grading Permit No. PWG2023- 0021 for construction of the project grading and site improvements at 5850 Condor Drive. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 23-ML-11102, are completed in accordance with the reviewed and accepted Plans and Specifications. The project developer, Condor Industrial Building LLC, has provided City staff with new surety bonds to replace the existing surety bonds that are currently in full force and must be renewed each year. Since the developer wanted to change the renewal terms for the existing bonds, the original bonds must be returned and replaced with new bonds. City staff has reviewed and accepted the new, replacement bonds and recommends the City Council exonerate the existing bonds. The following table provides a status of the surety bonds for the project. ENVIRONMENTAL DETERMINATION This action is not subject to the California Environmental Quality Act (CEQA) as it does not constitute a project, as defined by Section 15378 of the State CEQA Guidelines. Therefore, no environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2025-____ 206 ATTACHMENT RESOLUTION NO. 2025-___ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, EXONERATING SURETY BOND NO. 800028667, GRADING & IMPROVEMENTS, AND SURETY BONDS NO. 800028668, PUBLIC IMPROVEMENTS PERFORMANCE AND PAYMENT, FOR CONDOR INDUSTRIAL BUILDING LLC WHEREAS, on July 15, 2020, the City Council adopted Resolution No. 2020-3935, approving Industrial Planned Development Permit No. 2019-01 and Conditional Use Permit No. 2020-02 for the development of a 48,787 square feet, single-story industrial building and associated site improvements on an undeveloped 3.46-acre site at 5850 Condor Drive; and WHEREAS, on May 8, 2023, the Public Works Department issued Grading Permit No. PWG2023-0021 for construction of the project grading and site improvements at 5850 Condor Drive; and WHEREAS, as part of permit issuance, a surety is required to ensure the improvements, as shown on Moorpark Drawing No. 23-ML-11102, are completed in accordance with the reviewed and accepted Plans and Specifications; and WHEREAS, the project developer has submitted new replacement surety bonds to replace the existing bonds; and WHEREAS, City staff now recommends that the City Council exonerate Surety Bond No. 800028667, Grading & Improvements and Surety Bonds No. 800028668, Public Improvements Performance and Payment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark hereby exonerates Surety Bond No. 800028667, Grading & Improvements and Surety Bonds No. 800028668, Public Improvements Performance and Payment. SECTION 2. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions. PASSED AND ADOPTED this 2nd day of July, 2025.
