SUBJECT: REAL ESTATE AND OTHER SIGNS IN PUBLIC RIGHT-OF-WAY

The Department of Community Development in February 1989 sent letters to
all local Real Estate and the Board of Realty Offices. These letters
discussed the cities concerned with the increasing number of Real Estate
Open House and For Sale/Lease signs being placed on public right-of-way.
These signs are being placed in City parks, pathways, medians, and even
fastened to utility poles and traffic sign posts.
On June 3, 1989, the Code Enforcement Officer was directed to devote
time during a Saturday workday to observe, report and photograph real
estate signs displayed in public right-of-way and to remove any sign
that may be confusing to traffic or impairing the vision of the operator
of a motor vehicle.
The City Council directed the Public Works Committee to meet and. work on
a plan that would resolve the problem of Real Estate signs being placed
in public right-of-way.
On June 19, 1989, the committee met and the ecommendations were to
first, send another letter of notice to all Board of Realtors and Real
Estate office that service Moorpark from the surrounding cities.
Second, have the Code Enforcement Officer abate all signs from a date
specific.
The City Attorney's office is in the process of researching the City's
present Ordinance (No. 82 Section 9.50.20 Abatement (c) Illegal signs in

Public Right-of-Way) to ensure that all legal matters are covered before
abating signs.

Discussion
The problem continues to grow throughout the City with signs being
displayed in public right-of-way, by Real Estate Companies, garage sale,
boutique signs etc. The abatement of signs in the public right-of-way
at one time was a high priority in the City. Therefore, staff is
requesting guidance until which time the City Attorney's office makes
the determination that current City Ordinance(s) will allow the
abatement of signs. There is the possibility that staff may have to
draft and adopt new ordinances to allow the City to abate signs on
public right of way.
Staff Recommendation
1. Direct staff to continue to abate all signs placed in the public
right of way that present a potential public safety hazard, pending
a determination by the City Attorney on applicability of existing
ordinances.
2. That staff be directed by Council to abate all signs placed in the
public right of way after notice from the City Attorney that the
signs can be legally abated under current ordinance provisions, or
if the City does not currently have that ability, to direct staff
to proceed with the necessary ordinance revisions to allow
abatement.
