SUBJECT: EXTENSION OF ORDINANCES 4 AND 5 .
PROPOSED ACTION:
Adopt this report and an urgency ordinance extending the
effectiveness of Ordinances Nos . four and five for twelve
months.
BACKGROUND INFORMATION:
On July 6, 1983 your Council adopted an interim ordinance
on an urgency basis. The ordinance required the review and
approval by the City Council of any approved Residential
Planned Development (RPD) Permit before any building permits
may be issued. The ordinance was adopted pursuant to Section
65858 of the Government Code. The ordinance was effective
for a period not to exceed 45 days.
On August 3 , 1983 , your Council reviewed a status report on
the measures that had been taken to alleviate the conditions
which led to the adoption of the Ordinance. At that time,
the Council also adopted Ordinance No. 5 which extended the
effectiveness of Ordinance No. 4 for a period of 101/2 months,
or until July 6, 1984 .
These Ordinances affect 15 permits, representing 2 ,896
dwelling units, of these, 2 ,281 units (79%) were not built
at the time Ordinance No. 4 was adopted. The unbuilt units
were sufficient to house approximately 7 ,117 additional
residents -- a 70% overall increase in the City' s population.
The Planning Commission and Council has reviewed all 15 of
the permits which were affected. This was done in July 1983 .
In addition, since that time 12 of the permits have been
specifically reviewed and the County' s approval of the pro-
jects reaffirmed by your Council. The remaining three permits
have been allowed to expire by the developers without any
attempt to receive building permits.

The City Attorney has advised that, in order to insure
compliance with the additional conditions placed upon these
permits by your Council, the Ordinance should be extended
for an additional 12 months . As an urgency ordinance, a
four-fifths vote is required.

Adopt this report and an ordinance extending the effectiveness
of Ordinance Nos. four and five.
