SUBJECT: TEMPORARY MORATORIUM FOR CERTAIN R-1 AND R-E
ZONED PARCELS WITHIN THE CITY
Background
City staff have recently been concerned with the possibility of
residential land divisions occurring without the ability to condition
and control the development process to the degree experienced in the
past. The current R-1 and R-E zones only regulate such matters as lot
size, set backs and height restrictions. There would be no
architectural elevation review under the R-1 or R-E zones.
Discussion
Staff is recommending that the Council enact a limited moratorium which
will allow the City the ability to consider the benefits of modifying
the zoning on certain R-1 and R-E properties to an RPD zone. Staff
proposes the following outline to be the basis o:E future changes:
1. To include only parcels where a subdivision under current
zoning could result in lots of less than one (1) acre in
size. Staff feels that lots of less than one (1) acre are of
a more urbanized nature and no longer a truly rural
designation.
2. That no change in density occur. For example, if current
zoning is R-1 minimum 10,000 sq. ft. , we would purpose zoning
of RPD-10,000.
3. That existing lots, currently meeting minimum lot size would
not change. Therefore, only when a division of the property -
is available would these suggested changes occur. There is
no intent to affect lots where no change is anticipated.

Staff has included a map which will help illustrate which properties
may be affected by our recommendation.
Other than a rezoning of the property there is an additional
opportunity available to the City. The City could ammend its
subdivision and zoning regulations to require an RPD process when there
is a subdivision to create a certain number of lots. This would
prohibit lot sales only. There would need to be some identification of
what sized lots would fall into this type of process (such as one (1)
acre or less).
The City's general welfare is at stake if a process is not put in place
which will create the type of living environment acceptable to the City
of Moorpark.
Staff Recommendation
That the City Council adopt an urgency ordinance imposing a moratorium
prohibiting the creation of parcels in the R-1 and R-E zone of less
than one (1) acre, until which time as the RPD zoning could be
established on the affected parcels.
