SUBJECT: Exoneration of Bond and Acceptance of Cash
Payment in Lieu of Street Tree Placement for Tract 3841
(Griffin)
BACKGROUND:
The last remaining condition of Tract 3841, Heatherglen, requiring the
placement of street trees along the south side of L.A. Avenue between
Maureen Lane and Tierra Rejada Road has been resolved.
This matter has been unresolved for five years. The City has had
periodic discussions with CalTrans concerning planting the trees and
alternative landscaping concepts but has not reached agreement with
CalTrans. In the past, CalTrans has not wanted the street trees
adjacent to the curb. We are working with CalTrans to develop an
acceptable landscaping treatment on the north side of L.A. Avenue
directly across from Tract 3841 and should be able to do the same at
this location. Staff recommends that Griffin Homes be able to resolve
this condition so the remaining bond can be exonerated by paying the
equivalent amount in cash.
Griffin Homes initially submitted a proposal of $1,500.00 to install
the 17 street trees. Staff submitted a counter proposal since we felt
Griffin' s proposal did not accurately reflect the full costs associated
with completing the project. Staff' s counter proposal (see attached)
was for $7, 153.00 and has been accepted by Griffin Homes.
DISCUSSION:
With receipt of Griffin Homes check, the final tract condition for
Tract 3841, Heatherglen, has been completed. Final bond exoneration of
Tract 3841, Heatherglen, would be in order.

STAFF RECOMMENDATION:
1. Accept the cash payment of $7,153.00 in lieu of placement of
street trees as submitted by Griffin Homes and earmark the funds
for streetscape improvements to the Los Angeles Avenue (SR 118)
corridor.
2. Authorize the City Manager to proceed with final bond exoneration
of Tract 3841.
3. Direct staff to secure a mutually acceptable landscaping plan from
CalTrans for the Los Angeles Avenue (SR 118) frontage of Tract
3841.

Dear Ms. Freeman:
Please accept my apology for my delayed response to your request to
finalize the street tree issue related to Tract 3841, Heatherglen; the
placement of .street trees along L.A. Avenue between Maureen Lane and
Tierra Rejada Road.
After reviewing Griffin Homes' proposal submitted by Joanne Sorensen,
we are offering a counter proposal . We agree, .a cash settlement is
agreeable in lieu of placement of the trees along L.A. Avenue. We
propose the following for your consideration.
Total number of trees required to be planted and proposed associated
costs with the tree plantings are:
Trees - 17 (15 gal . ) @ $40.00 ea. = $ 680.00
Root Barriers - 17 @ $75.00 ea. = $1,275.00
Tree stakes - 51 @ $ 3. 50 ea. _ $ 178. 50
Tree ties - 102 $ 60.00
Plant Tabs - 102 @ $ .25 ea. = $ 25.50
Soil amendment @ 25.5 cu. feet @ $4.00 per cu. foot = $ 102.00
Irrigation system $1,800.00
Staff time for planting — 48 hrs. @ $30/hr. _ $1,440.00
Saw cutting planter boxes $ 400.00

We feel the above costs accurately reflect City costs associated with
completing this project.
If you concur with the costs as stated, please remit a check payable to
the "City of Moorpark" in the amount of $7, 153.00. If you disagree
with the costs as stated, please submit a counter proposal .
