MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Brian Chong, Assistant to the City Manager DATE: 08/06/2025 Special Meeting SUBJECT: Consider Authorizing the City Manager to Execute Easements to Aspire Broadband LLC to Install Fiber Optic Lines Along the Countrywood Drive Access Driveway to the Arroyo Vista Recreation Center and Making a Determination of Exemption Pursuant to the California Environmental Quality Act in Connection Therewith SUMMARY On April 2, 2025, the City Council voted to enter into a License Agreement and a Smart City Services Agreement with Aspire Broadband LLC (Aspire) to grant access to the City’s right-of-way to install a fiber optic network and to provide the City with various broadband-related services. Among these services is a 10-gigabit Internet connection to the Arroyo Vista Recreation Center (4550 Tierra Rejada Road) and dark fiber connections between the City’s offices at the Arroyo Vista Recreation Center and other City buildings. To get access to the Countrywood Drive Access Driveway to reach the Arroyo Vista Recreation Center, Aspire requires easements over the driveway. It is recommended that the City Council authorize the City Manager to execute these easements. BACKGROUND AND DISCUSSION In order to serve the Arroyo Vista Recreation Center with fiber optic service pursuant to the Smart City Services Agreement, Aspire is proposing to install fiber optic lines connecting the facility within the Countrywood Drive Access Driveway. The driveway comprises five parcels of land, with the Arroyo Vista Recreation Center located on a sixth parcel of land. All six parcels are owned by the City. Item: 9.A. 3080 Honorable City Council 08/06/2025 Special Meeting Page 2 Because the Countrywood Drive Access Driveway is not part of the City’s right-of-way, the License Agreement does not grant Aspire access to install the fiber optic line to the Arroyo Vista Recreation Center. To grant the necessary access, the City must grant Aspire easements over the driveway. Aspire’s engineers are currently preparing the easement documents to submit to the City Engineer for review, with this process taking weeks to complete. By default, City Council approval is necessary to offer and execute an easement over City property. However, both staff and Aspire want to install the fiber optic lines before Moorpark High School resumes classes. To facilitate this schedule, it is recommended that the City Council authorize the City Manager to execute the necessary easements to allow Aspire to install the fiber optic lines to the Arroyo Vista Recreation Center. Waiting for the next regular City Council meeting (September 3) would not allow construction before the school year begins. Once the easements are recorded, staff will issue a Right of Entry Permit to Aspire to physically construct the fiber optic lines. The lines will be installed via microtrenching, identical to the installation within public streets. 3081 Honorable City Council 08/06/2025 Special Meeting Page 3 ENVIRONMENTAL DETERMINATION The Community Development Director has reviewed this project and found it to be Categorically Exempt in accordance with Section 15301 (Class 1: Existing Facilities) of the CEQA Guidelines because the project consists solely of authorizing fiber optic line installation within an existing driveway. There is no substantial evidence that the project would have a significant effect on the environment. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION Authorize the City Manager to execute easements to Aspire Broadband LLC to install fiber optic lines along the Countrywood Drive Access Driveway to the Arroyo Vista Recreation Center. 3082
