MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 09/03/2025 Regular Meeting SUBJECT: Consider Resolution Exonerating Surety Bond No. 100721718 for Grading & Improvements at 13816 Princeton Avenue (Rafiq, Inc. – Hi- Tech Auto) BACKGROUND AND DISCUSSION On July 7, 2021, the City Council adopted Resolution No. 2021-4020, approving Commercial Planned Development No. 2020-01 and Conditional Use Permit No. 2020- 04 to allow the demolition of an existing 2,300 square-feet building and develop a 6,186 square-feet, single-story auto repair shop and associated site improvements located at 13816 Princeton Avenue. On February 15, 2023, staff issued Grading Permit No. PWG2023-0019 for grading and site improvements associated with the development of the auto repair shop at 13816 Princeton Avenue. As part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 22-ML- 11100, are completed in accordance with the reviewed and accepted plans and specifications. The grading and site improvements associated with the development of the auto repair shop, Hi-Tech Auto, are constructed and were accepted by City staff on June 27, 2024. The constructed site improvements have performed beyond the one-year warranty period and staff recommends the bonds be exonerated as follows: Surety Type Bond Number Original Bond Amount Prior Authorization Action of 9/04/2024 Authorized Action as of 9/03/2025 Surety Bond – Grading & Improvements 100721718 $185,672.00 Reduction to $18,567.20 Exonerate Item: 10.L. 133 Honorable City Council 09/03/2025 Regular Meeting Page 2 Attached for the City Council’s consideration is a Resolution exonerating Surety Bond No. 100721718 for Grading & Improvements at 13816 Princeton Avenue. ENVIRONMENTAL DETERMINATION The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment or is otherwise not considered a project as defined by CEQA Statute § 21065 and CEQA State Guidelines § 15060(c)(3) and § 15378. The exoneration of a surety bond for a completed and accepted project meets the above criteria and is not subject to CEQA. No additional environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. STAFF RECOMMENDATION (ROLL CALL VOTE REQUIRED) 1. Adopt Resolution No. 2025-____, exonerating Surety Bond No. 100721718 for Grading & Improvements at 13816 Princeton Avenue; and 2. Authorize the City Clerk to exonerate the bonds as shown in the agenda report and draft resolution. Attachment: Draft Resolution No. 2025-____ 134 RESOLUTION NO. 2025-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, EXONERATING SURETY BOND NO. 100721718 FOR GRADING & IMPROVEMENTS AT 13816 PRINCETON AVENUE (HI-TECH AUTO) WHEREAS, On July 7, 2021, the City Council adopted Resolution No. 2021- 4020, approving Commercial Planned Development No. 2020-01 and Conditional Use Permit No. 2020-04 to allow the demolition of an existing 2,300 square-foot building and develop a 6,186 square-foot, single-story auto repair shop and associated site improvements located at 13816 Princeton Avenue; and WHEREAS, on February 15, 2023, the Public Works Department issued Grading Permit No. PWG2023-0019 for grading and site improvements associated with the development of the auto repair shop at 13816 Princeton Avenue; and WHEREAS, as part of permit issuance, a surety is required to ensure that the improvements, as shown on Moorpark Drawing No. 22-ML-11100, are completed in accordance with the reviewed and accepted plans and specifications; and WHEREAS, the City Engineer/Public Works Director accepted the constructed grading and site improvements at 13816 Princeton Avenue and deem those improvements to be complete; and WHEREAS, City staff now recommends that the City Council fully exonerate Surety Bond No. 100721718 for Grading & Improvements at 13816 Princeton Avenue for Rafiq, Inc. (Hi-Tech Auto). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Moorpark, hereby, exonerates Surety Bond No. 100721718 for Grading & Improvements at 13816 Princeton Avenue. SECTION 2. The City Clerk shall certify to the adoption of this Resolution and shall cause a certified resolution to be filed in the book of original resolutions.
