MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 09/03/2025 Regular Meeting SUBJECT: Consider Acceptance of Public Improvements, Authorization of Release of Project Bonds in Accordance with the Contract Provisions for the Princeton Avenue Improvement Project (CIP Project No. C0020), Specification No. MPK 21-03, Federal Aid No. HSIPL-5436(018), and Authorization to File Notice of Completion SUMMARY On February 16, 2022, the City Council awarded a construction contract to Security Paving Company, Inc. (Security Paving) in the amount of $14,161,334.00, plus a 15% project contingency amount of $2,124,200.00, for a total contract amount of $16,285,534.00 for the Princeton Avenue Improvement Project. The completed project scope of work includes widening of the roadway and construction of two vehicle travel lanes, dual left-turn lane, Class II bikeways, sidewalks, curb and gutter, retaining wall structures, storm drainage infrastructure, landscape and irrigation improvements, and utility relocations. Final inspection for the project is complete and the work performed by Security Paving has been accepted by the Public Works Director. It is staff’s determination that Security Paving has executed 100% of the construction contract and that it is now appropriate for the City Council to accept the Princeton Avenue Improvement Project as complete. BACKGROUND On July 1, 2009, the City Council approved the conceptual design for the Princeton Avenue Improvement Project and directed staff to proceed with the completion of the plans, specifications, cost estimates, and acquisition of the required right-of-way and construction easements for the widening of the roadway and construction of two vehicle travel lanes, dual left-turn lane, Class II bikeways, sidewalks, curb and gutter, retaining wall structures, storm drainage infrastructure, landscape and irrigation improvements, and utility relocations. Item: 10.M. 136 Honorable City Council 09/03/2025 Regular Meeting Page 2 In 2010, the City was awarded $900,000 in federal funds from the Highway Safety Improvement Program (HSIP) for the construction of the improvements on Princeton Avenue. The Federal Highway Administration (FHWA) is the federal agency that is involved in the federal funding and has delegated its authority to the State of California Department of Transportation (Caltrans) Office of Local Assistance. Caltrans has the responsibility to ensure that local agencies are administering the federal aid program and are in conformance with the applicable federal requirements, including the following FHWA project milestones for the Princeton Avenue Improvement Project. • June 12, 2018: National Environmental Policy Act (NEPA) Compliance and Determination that the project has no significant impacts on the environment. • December 10, 2020: Caltrans Office of Permits approved the City’s Encroachment Permit No. 07-18-N-MC-2457 for the construction of the Princeton Avenue improvements within State right-of-way. • January 7, 2021: Caltrans Office of Permits approved the City’s Encroachment Permit Rider No. 07-18-N-RD-3216 for acceptance of the Hazardous Waste reports associated with construction of the Princeton Avenue improvements within State right-of-way. • August 5, 2021: Obtained NEPA Re-Validation for a minor scope change to the project to include a pedestrian sidewalk along the north side of Princeton Avenue. • August 12, 2021: Right-of-Way Certification was granted by Caltrans. • November 18, 2021: Project Authorization to Proceed granted by the FHWA. FHWA obligates $900,000 of federal HSIP and $200,000 of federal Surface Transportation Program (STP) funds for the project. Federal Project Authorization to Proceed provides clearance for the City to advertise the project for construction contracts. On October 6, 2021, the City Council approved the Plans and Specifications for the Princeton Avenue Improvement Project and authorized staff to advertise the project to obtain construction bids and a Request for Proposals for Construction Management and Inspection Services. DISCUSSION On February 16, 2022, the City Council awarded a construction contract to Security Paving Company, Inc. in the amount of $14,161,334.00, plus a 15% project contingency amount of $2,124,200.00, for a total contract amount of $16,285,534.00. Immediately after the contract award, staff coordinated with AT&T California, Charter/Spectrum Communications, Crown Castle Network, Southern California Edison, and Southern California Gas Company for the relocation of all utility infrastructure within the public right-of-way. This utility relocation effort was to prepare Princeton Avenue for the roadway widening and improvements. 137 Honorable City Council 09/03/2025 Regular Meeting Page 3 Staff issued a Notice to Proceed with an effective start date of August 1, 2022. The project was originally scheduled to be completed on February 5, 2024. However, the project encountered many weather-related delays. Additionally, Security Paving assisted the City with replacing several street light fixtures and sections of the retaining wall that were damaged by the public, which extended the duration of the project. Final inspection for the project is complete and the work performed by Security Paving has been accepted by the Public Works Director. It is staff’s determination that Security Paving has executed 100% of the construction contract and that it is now appropriate for the City Council to accept the Princeton Avenue Improvement Project as complete. City staff also secured additional federal funds for the project and a reimbursement agreement with Ventura County Waterworks District No. 1 for the construction of a new water main line along Princeton Avenue. The following table provides a summary of reimbursements to the City for the project. In accordance with the Contract Documents, the Faithful Performance and Material Suppliers and Laborers Bonds (Bond No. 30134657), in the amount of $14,161,334.00, will be exonerated by the City Clerk’s Office one year after the date of recordation of the Notice of Completion. ENVIRONMENTAL DETERMINATION The California Environmental Quality Act (CEQA) does not apply to activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment or is otherwise not considered a project as defined by CEQA Statute §21065 and CEQA State Guidelines § 15060(c)(3) and § 15378. The acceptance of a project and filing a Notice of Completion meets the above-mentioned criteria and is not subject to CEQA. No additional environmental review is required. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive.
