Ordinance No. 4 Status Report
On July 6 , 1983, your Council adopted an interim ordinance on
an urgency basis. The ordinance requires the review and approval
by the City Council of any County approved Residential Planned
Development (RPD) permit before any building permits may be
issued. The ordinance was adopted pursuant to Section 65858 of
the Government Code, and unless extended, will be in effect for
a period of 45 days after adoption, which would be until
August 20, 1983.
The reasons for the urgency ordinance are that ". . . the County
of Ventura has approved a large number of Residential Planned
Developments which have not been reviewed or approved by the City
of Moorpark. The Council wishes to be assured that conditions
imposed by the County will properly serve the needs of the people
of the City of Moorpark. " Fifteen permits are affected by the
ordinance. These permits represent approval for 2,896 dwelling
units ; of these, 2,281 dwelling units (79 percent) have not
received building permit approvals. The unbuilt units are
expected to house approximately 7,117 additional residents
within the City -- a 70 percent overall population increase.
When an interim ordinance has been adopted, the Government Code
requires that "Ten days prior to the expiration of an iterim
ordinance or any extension, the legislative body shall issue a
written report describing the measures taken to alleviate the
condition which led to the adoption of the ordinance. " 065858 d)
Since the adoption of the interim ordinance, the following
measures have been taken :
(1) July 18, 1983 -- The Planning Commission, at an
adjourned special meeting, conducted an over-all review of
the 15 permits affected by the ordinance. The Commission also
conducted a specific review of 11 of the permits.
(2) July 19 , 1983 -- The City Council, at an adjourned
regular meeting, conducted an overview of the 15 affected permits .
Specific and in-depth reviews of 8 permits were also conducted.
Testimony was received by project proponents , as well as the
public.

(3) July 20, 1983 -- The City Council, at a regular meeting,
adopted resolutions approving two permits which had been previously
reviewed, gave further consideration to four permits , and conducted
specific and in-depth reviews of two additional permits. For each
permit, public testimony was received and specific areas of concern
were identified bythe Council. Staff was directed to work with
project proponentsto resolve these concerns .
(4) July 26 , 1983 -- The Planning Commission, at a regular
meeting, reviewed two permits and specific concerns which had been
identified by the City Council. This review was conducted at the
request of the Council and entailed the identification of specific
measures designed to alleviate concerns.
(5) August 3, 1983 -- Your Council is scheduled to review
resolutions approving with modification three additional permits.
Also to be considered are staff follow-up reports with recommendations
on five additionalpermits.
RECOMMENDED ACTION:
-- Adopt this report as being in compliance with Government
Code Section 65858(d) .
