MOORPARK CITY COUNCIL AGENDA REPORT TO: Honorable City Council FROM: Daniel Kim, City Engineer/Public Works Director DATE: 11/19/2025 Regular Meeting SUBJECT: Consider Resolution Granting Easements to Ventura County Waterworks District No. 1 on City-Owned Property (Assessor Parcel Number (APN) 511-0-020-275) for Sanitary Sewer and Domestic Water Infrastructure Improvements that are Constructed as Part of the Vendra Gardens Development and Making a Finding of Consistency with the Approved Mitigated Negative Declaration of Residential Planned Development Permit No. 2012-02 in Connection Therewith BACKGROUND The City of Moorpark previously approved a 200-unit affordable apartment community, known as Vendra Gardens, located at 150 Casey Road. As part of the project conditions of approval, the Applicant is required to construct various off-site improvements and secure easements for public, sanitary sewer and domestic water infrastructure improvements on approximately 6.5 acres of property (the “City Parcel”) that the Applicant dedicated to the City located immediately to the south of the residential development. These easements are necessary to ensure the project’s compliance with approved conditions, including the construction of public sanitary sewer and domestic water improvements, and to allow the City and County Waterworks District No. 1 to maintain appropriate oversight of the improvements within City property. DISCUSSION The development of the Vendra Gardens project required the design and construction of new, public sanitary sewer and domestic water infrastructure improvements on the “City Parcel.” As part of the design review process, County Waterworks District No. 1 determined the final points of connection for both sanitary sewer and water lines. Because both utilities will be owned and maintained by County Waterworks District No. 1 and located within City-owned private property, an easement is required for final acceptance. The final alignment of the sanitary sewer and water lines were designed Item: 10.B. 86 Honorable City Council 11/19/2025 Regular Meeting Page 2 and constructed with consideration for the potential, future development of the “City Parcel.” The sanitary sewer line has been located along, and adjacent, to the western property line. The domestic water line has been located along the eastern property line to a point of connection on High Street. The Legal Descriptions for the two easements were prepared by Vendra Gardens’ Engineer and Surveyor of Record, Southland Civil Engineering & Survey, LLP, and reviewed by the City and County for technical correctness. Staff is recommending that the City Council consider a resolution granting easements to County Waterworks District No. 1 for public sanitary sewer and domestic water lines on the “City Parcel.” ENVIRONMENTAL DETERMINATION Pursuant to the California Environmental Quality Act (CEQA), the City Council adopted a Mitigated Negative Declaration (MND) on July 18, 2007, that analyzed the environmental impacts associated with development of the Project and adopted a Mitigation Monitoring and Reporting Program to reduce those impacts to levels that are less than significant. The proposed grant of easements is consistent with the development analyzed in the approved MND. Therefore, no additional environmental analysis is required pursuant to Section 15162 of the CEQA Guidelines. FISCAL IMPACT None. COUNCIL GOAL COMPLIANCE This action does not support a current strategic directive. Attachment: Draft Resolution No. 2025-____ 87 RESOLUTION NO. 2025-____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING THE GRANT OF EASEMENT DEEDS FOR SANITARY SEWER LINES AND DOMESTIC WATER LINES ON CITY-OWNED PROPERTY (ASSESSOR PARCEL NUMBER 511-0-020-275) TO VENTURA COUNTY WATERWORKS DISTRICT NO. 1 AND MAKING A FINDING OF CONSISTENCY WITH THE APPROVED MITIGATED NEGATIVE DECLARATION FOR RESIDENTIAL PLANNED PERMIT NO. 2012-02 IN CONNECTION THEREWITH WHEREAS, the City of Moorpark (“City”) is the owner of certain real property identified as Parcel “B” of Lot Line Adjustment No. 2014-01, as evidenced by the document recorded on August 31, 2016, as Instrument No. 20160831-00125261 of Official Records, located at the corner of High Street and Walnut Canyon Road (the “City Property”); and WHEREAS, Moorpark Casey Road LP (“Developer”) is the owner of property located at 150 Casey Road, Moorpark, California, on which it is developing a 200-unit affordable apartment community commonly known as Vendra Gardens (the “Project”), approved on March 1, 2017, under Residential Planned Development Permit No. 2012-02; and WHEREAS, as Conditions of Approval for the Project, the Developer is required to secure certain easements on the City Property to provide for the construction and transfer of maintenance of public sanitary sewer and domestic water lines for the Project; and WHEREAS, to satisfy these conditions, the Developer, Ventura County Waterworks District No. 1 (VCWWD No. 1), and City have determined the locations for the public sanitary sewer and domestic water lines, and the associated easement areas, over portions of the City Property for the construction, use, and maintenance of the required improvements; and WHEREAS, the Developer has constructed all improvements for the public sanitary sewer and domestic water lines within the easement areas and at its sole cost; and WHEREAS, VCWWD No. 1 has inspected all improvements for the public sanitary sewer and domestic water lines within the easement areas; and WHEREAS, VCWWD No. 1 requires a perpetual easement and right-of-way on the City Property to construct, use, maintain, operate, and repair subsurface sewer pipelines and related purposes; and WHEREAS, VCWWD No. 1 requires a perpetual easement and right-of-way on the City Property to construct, use, maintain, operate, and repair subsurface water pipelines and related purposes; and ATTACHMENT 88 Resolution No. 2025-____ Page 2 WHEREAS, on July 18, 2007, the City Council adopted a Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program for the Project, and the Community Development Director has determined that the proposed Easement Agreements are consistent with the Project as analyzed in the MND, requiring no further environmental review under Section 15162 of the California Environmental Quality Act (CEQA) Guidelines. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby concurs with the Community Development Director’s finding that the approval of the Easement Agreements is consistent with the previously adopted Mitigated Negative Declaration for Residential Planned Development Permit No. 2012-02 and this action does not require additional environmental review pursuant to CEQA Guidelines Section 15162. SECTION 2. Based on the findings contained herein, the City Council approves the grant of easement deed to Ventura County Waterworks District No. 1 on the City Property (APN 511-0-020-275) to construct, use, maintain, operate, and repair subsurface sewer pipelines and related purposes, attached hereto as Exhibit A, and authorizes the Mayor to sign the Easement Deed. SECTION 3. Based on the findings contained herein, the City Council approves the grant of easement deed to Ventura County Waterworks District No. 1 on the City Property (APN 511-0-020-275) to construct, use, maintain, operate, and repair subsurface water pipelines and related purposes, attached hereto as Exhibit B, and authorizes the Mayor to sign the Easement Deed. SECTION 4. The City Clerk shall certify to the adoption of this resolution and shall cause a certified resolution to be filed in the book of original resolutions.
