ITEM 3. n • MINUTES OF THE REDEVELOPMENT AGENCY Moorpark, California September 16, 1992 A Special Meeting of the Redevelopment Agency of the City of Moorpark was held on September 16, 1992 in the City Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Chairman Lawrason called - the meeting to order at 5:55 p.m. 2. ROLL CALL: Present:- Agency Members Montgomery, Talley, Wozniak and Chairman Lawrason. Absent: Agency Member Perez. Staff Present: Steven Kueny, Executive Director; Cheryl Kane, Agency Counsel; Lillian Kellerman, Agency Secretary. 3. CONSENT CALENDAR: MOTION: Agency Member Montgomery moved and Agency Member Wozniak seconded a motion to approve the Consent Calendar. The motion carried by roll call vote 4 -0, Agency Member Perez absent for the vote. A. Consider Approval of the Minutes of the Redevelopment Agency Meeting of August 19, 1992. Staff Recommendation: 4. CLOSED SESSION: Approve the minutes as processed. BACKGROUND The Redevelopment Agency has determined that it is more cost effective to use the employees and contractors of the City of Moorpark to conduct Agency business rather than incur the associated overhead costs with employing officers and contractors of its own. In order to accomplish this goal Resolution No. 92- , has been prepared which accepts the assigned officers of the City of Moorpark as Agency Officers. The corresponding titles of City of Moorpark Officers and Agency Officers are included as exhibit A. Additionally, the resolution recognizes the Agency's obligation to the City of Moorpark to reimburse the City for the personnel costs associated with the hours worked by City of Moorpark employees in conducting Agency business and to reimburse the City of Moorpark for costs billed by City contractors performing Agency services. The reimbursements initially will be recorded in the form of loans from the City of Moorpark to the Agency and shall be recorded as liabilities on the part of the Agency until such time as the Agency has the available revenues to repay the loans from the City of Moorpark. The terms of these loans will be on the same basis as current loans between the City of Moorpark and the Redevelopment Agency in that, they shall be due in 1994, and will accrue an interest rate which is based upon the daily average interest rate of the Local Agency Investment Fund compounded monthly. BOARD OF DIRECTORS OF THE MOORPARK APPOINTING OFFICERS, EMPLOYEES AND ;ENCY USING THE OFFICERS, EMPLOYEES AND CITY OF MOORPARK AND AGREEING TO FOR ITS COSTS IN PROVIDING THESE WHEREAS, it is in the interest of the Moorpark Redevelopment Agency and the public to establish appointments of officers to conduct the business of the Agency; and WHEREAS, Exhibit A lists the corresponding titles of City Officers and Agency Officers; and WHEREAS, those officers have under their supervisor and control assistants, employees, and contractors to perform the necessary business functions of the Agency; and WHEREAS, the Agency has worked cooperatively in the past with the City of Moorpark; and WHEREAS, the City has established accordingly a personnel and payroll system; and WHEREAS, the City has established contracts for services with individuals and firms which provide the same or similar services required by the Agency; and WHEREAS, the City and the Agency have come to agreement on the accounting mechanism for the loan of Agency start up funds from the City to the Agency; and WHEREAS, the Agency does agree to reimburse the City for monies owed by 1994, with interest calculated at the average daily Local Agency Investment Fund rate compounded monthly; and WHEREAS, it is more efficient for the Agency to rely upon the City to supervise personnel and contractors; and WHEREAS, the accounting mechanisms are available for the City and Agency to record the hours spent by City personnel and contractors in support of Agency activities; NOW, THEREFORE, the Moorpark Redevelopment Agency does hereby accept the Officers, Employees, and Contractors of the City of Moorpark as Officers, Employees, and Contractors of the Moorpark Redevelopment Agency and does agree to reimburse the City consistent with the current reimbursement agreement between the Agency and City for Agency start up costs. MOORPARIC 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 MEMORANDUM TO: Redevelopment Agency Board FROM: Richard Hare, Agency TreasuiFe DATE: October 15, 1992 SUBJECT: Consider Acquisition of Ventura County Transportation Commission Property for the Redevelopment Project Area BACKGROUND The City of Moorpark and the Moorpark Redevelopment Agency (MRDA) agreed on September 27, 1991, to pursue the purchase of Southern Pacific Railroad Property which is located in the Moorpark Redevelopment Project Area. This location would be used for a commuter rail station, parking areas and commercial development. This project was cooperatively established with the Ventura County Transportation Commission (VCTC) which at that time had an option to purchase the Southern Pacific Railroad property on the north side of the tracks south of High street. The City Attorney was used by the Redevelopment Agency to prepare the necessary agreements VCTC to proceed with the acquisition of the property. VCTC per these agreements, acquired all the necessary property and construction has begun on the Metrolink station and related parking areas. At this point, the Redevelopment Agency consistent with the provisions on its agreement with VCTC can move forward with the acquisition of the property. The City of Moorpark operating on behalf of VCTC and The Moorpark Redevelopment Agency has been in control of the property since VCTC's acquisition. Per the agreement, it has been the City's responsibility to manage the property until such time as the Redevelopment Agency would be able to purchase it. As Agency and City Treasurer, I recognized the loan of funds for this purpose in FY 91/92, in accordance with the intent of the MRDA and the Council. Per the agreement the Redevelopment Agency will pay to Southern Pacific eight hundred thousand dollars ($800,000) for the purchase of the property. PAUL W. LAWRASON JR. JOHN E. Councilmember Councilmember Printed On Recycled Paper Redevelopment Agency Board October 15. 1992 Page 2 In order to complete this purchase of the property the Redevelopment Agency must authorize staff to proceed with finalizing all documents for the sale and authorize the Mayor to sign the transfers and property deeds. It is further recommended that the Redevelopment Agency Board authorize the expenditure of eight hundred thousand dollars ($800,000) for the purchase of the property and appropriate twenty thousand dollars ($20,000) as contingency funds for any associated fees or costs related to this sale. RECOMMENDATION (Roll call vote required) Authorize the expenditure of eight hundred thousand dollars ($800, 000) for the purchase of the Southern Pacific property on the north side of the railroad right -of -way and south side of High Street, beginning at the east fence line of the Commuter Rail parking lot, west to Moorpark Avenue and continuing on the west side of Moorpark Avenue between the railroad right -of -way and High street, to the Moorpark Unified School District property.
