Hayes, Economic Development/Redevelopment Manager DATE: July 9, 1997 (Mtg. 07/16/97) SUBJECT: Consider Property Owner's Consent for Liquor License Request From Mr. Benjamin Cano (La Playita Restaurant) BACKGROUND On September 15, 1993, the Agency closed escrow on the railroad property located on the south side of High Street. One of the businesses located on the property is La Playita Restaurant, owned by Mr. Benjamin Cano. The Agency entered into a land lease with Mr. Cano on January 1, 1994. Section 6 of the Lease Agreement requires that the Tenant shall use the premises for a restaurant and required parking only, subject to all applicable governmental statutes, ordinances, codes, standards, rules and regulations. Further, the premises shall not be used for any other purpose, except with the prior written consent of the Executive Director of the Agency. Before entering into the Lease Agreement with the Agency, Mr. Cano purchased part of the building owned by Pat's CB and Stereo. After entering into the Lease Agreement with the Agency, Mr. Cano expanded the restaurant into the newly purchased building area. He also enclosed a patio area and completed many improvements without building inspections. Mr. Cano failed to apply for and obtain required applications, permits and zoning approval from the City of Moorpark for these improvements. This is in direct violation of Section 6 of the Lease Agreement. On September 28, 1995, Mr. Cano submitted an application for a CUP (CUP 95 -3) for a liquor license for La Playita Restaurant. To be consistent with the CUP, the lease would have to be amended to allow for the sale of alcoholic beverages. There were also concerns over the expansion of the restaurant without required permits. For the aforementioned reasons, the Executive Director would not sign the CUP application and referred the decision to the MRA Board. 0Wo " On December 4, 1996, a moratorium was enacted on the acceptance of applications for businesses proposing to sell alcoholic beverages. However, the request by Mr. Cano was exempted from the moratorium because it had been filed prior to the moratorium. This does not affect the need to address the concerns with the condition of the building and desired expansion. At the meeting of March 19, 1997, the Agency required that the building be brought into compliance with the City's Zoning Codes. To continue with this lease and /or modify the Lease Agreement in the future, the Agency determined that Mr. Cano must complete the following: 1. Within one month from April 1, 1997, (May 1, 1997) contact the City of Moorpark's Building & Safety Department located at 18 High Street to schedule and pay for a building inspection. Once the building has been inspected, contact the Planning Department to determine what zoning approvals will be needed. 2. Within three months from April 1, 1997, (July 1, 1997) following the inspection, apply for all permits and applications necessary to correct all the items found not meeting codes and standards. 3. Within nine months from April 1, 1997, (January 1, 1998) have all corrections completed by a State licensed contractor having a Moorpark Business Registration. DISCUSSION Bob Gehricke, Architect, has been retained by Mr. Cano to process all applications and will assist in the management of the construction of this project. Since the project is proceeding in accordance with the direction of the Agency, Mr. Cano is requesting that the Lease Agreement with the Agency be amended to allow the general sales of liquor on the property. The amendment to the Lease Agreement and concomitant signature on the CUP application as the property owner are the only requirements remaining for the processing of the requested CUP for sales of alcoholic beverages. The Executive Director is authorized to approve Lease Agreements and amendments to them. It is staff's recommendation that since the requirements are being met, the Agency authorize the amendment to the Lease Agreement to allow the general sales of liquor on the property.
