Staff Recommendation: Approve minutes. B. Consider Authorizing Agency Executive Director to Execute Escrow Instructions and Related Sale Documents for Agency - Owned Houses and Transferring Agency Interest in Ongoing Affordability of Lots 12, 13 and 14 in Tract 5307 to City for Inclusion in First -Time Home Buyer Program. Staff Recommendation: 1) Authorize Agency Executive Director to execute Escrow Instructions and related documents for the sale escrows of Lots 12, 13 and 14 of Tract 5307; and 2) Authorize the transfer of the Redevelopment Agency's obligation and interest in the ongoing affordability of the dwelling units on Lots 12, 13 and 14 of Tract 5307 to the City of Moorpark for inclusion in the First -Time Home Buyer Program. Speakers who wish to address the Agency concerning a Public Hearing or Presentations /Action/ Discussion item must do so during the Public Hearing or Presentations /Action /Discussion portion of the Agenda for that item. Speaker cards must be received by the City Clerk for Public Comments prior to the beginning of the Public Comments portion of the meeting and for Presentation /Action /Discussion items prior to the beginning of the first item of the Presentation /Action /Discussion portion of the Agenda. Speaker Cards for a Public Hearing must be received prior to the beginning of the Public Hearing. A limitation of three minutes shall be imposed upon each Public Comment and Presentation /Action /Discussion item speaker. CALL TO ORDER: Chair Hunter called the meeting to order at 7:22 p.m. 2. ROLL CALL: Present: Agency Members Harper, Mikos, Millhouse, Parvin, and Chair Hunter. Staff Present: Steven Kueny, Executive Director; Joseph Montes, General Counsel; Hugh Riley, Assistant Executive Director; and Deborah Traffenstedt, Agency Secretary. 3. PUBLIC COMMENT: None. 4. CONSENT CALENDAR: MOTION: Agency Member Harper moved and Agency Member Parvin seconded a motion to adopt the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Approval of Minutes of Regular Meeting of October 20, 2004. Staff Recommendation: Approve minutes. B. Consider Amendment to Construction Agreement with Colmer Construction. Staff Recommendation: Approve Amendment to Construction Agreement, subject to final approval by City Manager and City Attorney. (Staff: Nancy Burns) 5. CLOSED SESSION: None was held. ADJOURNMENT: MOTION: Agency Member Mikos moved and Agency Member Parvin seconded a motion to adjourn the meeting of the Moorpark Redevelopment Agency. The motion carried by unanimous voice vote. C_. -4 To: Honorable Agency Board of Directorsl- From: Nancy Burns, Senior Management Analyst v -- 9 Y Date: November 19, 2004 (MRA Mtg. of December 1, 2004) Subject: Consider Authorizing Agency Executive Director to Execute Escrow Instructions and Related Sale Documents for Agency -Owned Houses and Transferring Agency Interest in Ongoing Affordability of Lots 12, 13 and 14 in Tract 5307 to City for Inclusion in First -Time Home Buyer Program BACKGROUND Three (3) dwelling units were constructed on Agency owned land as part of the Moondance residential development (Tract 5307), through a Construction Agreement executed June 24, 2003, with Colmer Construction. These units have been completed and are ready for sale to Low and Very Low Income buyers, through the City's First -Time Home Buyer Program, the initial guidelines for which were approved by the City Council on June 16, 2004, and modified on July 7, 2004. DISCUSSION Buyers have been selected and approved for these units. The City Council is being asked to approve the Purchase Documents for the sale transactions. In order to expedite the escrow process, the Agency Board is being asked to authorize its Executive Director to execute Escrow Instructions and other documents related to the sale of Lots 12, 13 and 14 of this project to qualified Low and Very Low Income buyers. "0090i Moorpark Agency Agenda Report Date 11/23/04 Page 2 In addition, the Agency's interest in the ongoing affordability of the three Agency -owned units in the Moondance project can be assured by conveying its obligation and interest to the City and directing that these units be included in the First -Time Home Buyer Program. STAFF RECOMMENDATION 1. Authorize Agency Executive Director to execute Escrow Instructions and related documents for the sale escrows of Lots 12, 13 and 14 of Tract 5307; 2. Authorize the transfer of the Redevelopment Agency's obligation and interest in the ongoing affordability of the dwelling units on Lots 12, 13 and 14 of Tract 5307 to the City of Moorpark for inclusion in the First -Time Home Buyer Program.
