SPECIAL MEETING OF THE REDEVELOPMENT AGENCY
OF THE CITY OF MOORPARK
TO THE MEMBERS OF THE REDEVELOPMENT AGENCY OF THE CITY OF
MOORPARK:
NOTICE IS HEREBY GIVEN that a Special Meeting of the Redevelopment Agency of
the City of Moorpark is hereby called to be held on Wednesday, October 7, 2009,
commencing at 6:45 p.m. Said meeting will convene in the Community Center located at
799 Moorpark Avenue, Moorpark, California.
Said Special Meeting shall be for the purpose of considering the following:

emergency will not permit a delay resulting from a competitive solicitation for
bids and that the action is necessary to respond to the emergency to prevent
the possibility of a fire in the future; and 2) Authorize the Executive Director to
execute all documents necessary to mitigate this emergency. ROLL CALL

All writings and documents provided to the majority of the Agency regarding all open- session agenda items are
available for public inspection at the City Hall public counter located at 799 Moorpark Avenue during regular
business hours. The agenda packet for all regular Redevelopment Agency meetings is also available on the Citys
website at www.ci.mooraark.ca.us.
Any member of the public may address the Agency during the Public Comments portion of the Agenda, unless it is
a Public Hearing or a Presentation /Action/ Discussion item. Speakers who wish to address the Agency concerning
a Public Hearing or Presentations /Action /Discussion item must do so during the Public Hearing or
Presentations /Action/ Discussion portion of the Agenda for that item. Speaker cards must be received by the City
Clerk for Public Comment prior to the beginning of the Public Comments portion of the meeting; for a
Presentation /Action /Discussion item, prior to the Chair's call for speaker cards for each Presentation /Action/
Discussion agenda item; and for a Public Hearing item, prior to the opening of each Public Hearing, or beginning
of public testimony for a continued hearing. A limitation of three minutes shall be imposed upon each Public
Comment and Presentation /Action /Discussion item speaker. A limitation of three to five minutes shall be imposed
upon each Public Hearing item speaker. Written Statement Cards may be submitted in lieu of speaking orally for
open Public Hearings and Presentation / Action /Discussion items. Any questions concerning any agenda item may
be directed to the City Clerk's office at 517 -6223.

That I am the Assistant City Clerk of the City of Moorpark and that a notice for a Special
Meeting of the Redevelopment Agency of the City of Moorpark will be held Wednesday,
October 7, 2009, commencing at 6:45 p.m. at the Moorpark Community Center, located at
799 Moorpark Avenue, Moorpark, California.
A copy of said Notice was posted on October 7, 2009, at a conspicuous place at the
Moorpark Community Center, 799 Moorpark Avenue, Moorpark, California.

Subject: Consider Authorizing the Executive Director to Execute all
Documents Necessary to Mitigate an Electrical Hazard at Agency
Owned Property Located at 33 High Street
BACKGROUND AND DISCUSSION
On March 4, 2009, the Agency Board approved a multiple year lease agreement
between the Agency and Robert Sichmeller for second floor office space in Agency
owned property located at 33 High Street.
On October 1, 2009, the building located at 33 High Street had a small fire ignite in the
women's bathroom. The fire was started by the exhaust fan that stopped working and
overheated at approximately 6:30 a.m. An employee of Mr. Sichmeller discovered the
fire at 7:00 a.m., quickly extinguished it and called 911.
Staff contacted DNA Electric ( "DNA ") to inspect the damage to the electrical system.
Upon removing the sheetrock, DNA discovered that the electrical system is in need of
replacement and upgrading immediately to prevent another fire in the future.
Section 22050 of the Public Contractor Code allows a public agency to take emergency
action by a four -fifths vote of its governing body to take any action required by an
emergency, and procure the necessary equipment, services and supplies for that
purpose, without giving notice for bids to contractors. This section also requires the
Agency to make a finding, based on substantial evidence set forth, that the emergency
will not permit a delay resulting from a competitive solicitation for bids and that the
action is necessary to respond to the emergency.
FISCAL IMPACT
DNA has estimated the repair of the electrical system to be $6,680.00. Staff will solicit
informal bids from at least two contractors in an effort to receive a competitive bid. A

A line item transfer will be conducted by Staff from account 2904 - 2410 - 5063 -9611
(demolition of improvements at the Caltrans site) to provide the needed funds to repair
the electrical system.
STAFF RECOMMENDATION (4/5 VOTE REQUIRED)
1. Find that the emergency will not permit a delay resulting from a competitive
solicitation for bids and that the action is necessary to respond to the emergency
to prevent the possibility of a fire in the future; and
2. Authorize the Executive Director to execute all documents necessary to mitigate
this emergency.
