HomeMy WebLinkAboutMIN 1983 0921 CC REGMINUTES OF THE CITY COUNCIL Moorpark, California September 21, 1983 A Regular Meeting of the City Council of the City of Moorpark was held on September 21, 1983 in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Yancy- Sutton called the meeting to order at 7:00 p.m. 2. 'PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Beaulieu. 3. ROLL CALL: Present: Councilmembers Roger Beaulieu, Clinton D. Harper, Albert Prieto, Jerry Straughan and Mayor Leta Yancy Sutton Niall Fritz, City Manager/ Director of Community Development; Mark C. Allen, Jr., City Attorney; Scott Field, Assistant City Attorney; and Doris D. Bankus, City Clerk 4. PUBLIC COMMENTS: Phil Vein, 6685 Princeton, spoke representing U.S. Condo regarding PD 857. Tom Baldwin, 6475 Pepperdine, spoke regarding the practice of citizens working on cars in their front yards. Bill Mitchell, 6440 N. Berkley Circle, spoke in favor of PD 857 (U.S. Condo). Gerry Goldstein, 11932 Los Angeles Avenue, addressed the Council regarding the removal of trees for street widening. Rick Niec, 19436 Ventura Blvd., Tarzana, spoke representing Griffin Homes regarding item 7.F. the formation of a maintenance district for Tierra Rejada Road and other streets. Minutes of the City Council Moorpark, California Page 2 September 21, 1983 Stan Cohen, 500 Esplanade Dr., Oxnard, spoke as the attorney for Pacifica on items 9.B., 9.C. and 9.D. 5. APPROVAL OF MINUTES: A. Approval of Minutes of the Regular City Council Meeting of July 6, 1983. MOTION: Councilmember Prieto moved and Councilmember Harper seconded a motion to approve the minutes of the Regular City Council Meeting of July 6, 1983. The motion carried by unanimous voice vote. 6. PRESENTATION: A. County -Wide Solid Waste Management Plan Bill Powers gave the presentation. B. Business Assessment District John Newton gave the presentation. 7. A. PUBLIC HEARINGS: 1. Adoption of Ordinance No. 6, Introduced 9 -7- 83, Adopting by Reference Various County Ordinances. The City Attorney read the title of Ordinance No. 6: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADOPTING BY REFERENCE VARIOUS ORDINANCES OF THE COUNTY OF VENTURA. MOTION: Councilmember Harper moved and Councilmember Straughan seconded a motion to read the ordinance by title only. The motion carried by unanimous roll call vote. MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to waive further reading and declare Ordinance No. 6 read for the second time and adopted. A Resolution of the City Council of the City of Moorpark Adopting Express Findings in Re Modification of Uniform Codes Which Regulate Buildings Subject to the State Housing Law. MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to approve Resolution No. 83 -35. The motion carried by voice vote 3 -2, Councilmember Prieto and Mayor Yancy- Sutton dissenting. B. Resolution Establishing Fees for Permit & Services Rendered Pursuant to Moorpark City Building Code. MOTION: Councilmember Straughan moved and Councilmember Prieto seconded a motion to approve Resolution No. 83 -36. The motion carried by unanimous voice vote. C. Adoption of Ordinance No. 7. Introduced 9 -7 -83, regarding Mobile Home Rent Control. Victor Richard, 15750 Los Angeles Avenue, Space 168, spoke regarding the Mobile Home Rent Control Ordinance. The City Attorney read the title of Ordinance No. 7: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK REGULATING MOBILE HOME PARK RENTS. MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to read the ordinance by title only. The motion carried by unanimous roll call vote. MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to waive further reading declare Ordinance No. 7 read for the second time and adopted. The motion carried by unanimous roll call vote. D. Ordinance Adopting Police and Fire Facilities Fees The City Attorney introduced Ordinance No. 8 entitled: AN ORDINANCE OF THE CITY OF MOORPARK REGARDING THE IMPOSITION OF BUILDING FEES TO PROVIDE FIRE PROTECTION FACILITIES MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to read the ordinance by title only. The motion carried by unanimous roll call vote. The motion carried by roll call vote 4 -1, Mayor Yancy- Sutton dissenting. The City Attorney introduced Ordinance No. 9 entitled: AN ORDINANCE OF THE CITY OF MOORPARK REGARDING THE IMPOSITION OF BUILDING FEES TO PROVIDE POLICE FACILITIES MOTION: Councilmember Straughan moved and Councilmember Beaulieu seconded a motion to read the ordinance by title only. The motion carried by unanimous roll call vote. MOTION: Councilmember Harper moved and Councilmember Straughan seconded a motion to waive further reading and declare Ordinance No. 9 introduced for first reading. The motion carried by roll call vote 4 -1, Mayor Yancy- Sutton dissenting. E. Ordinances Adopting Uncodified County Ordinances. Mr. Fritz said these ordinances were not yet ready and would be presented to the Council on a future agenda. AT THIS POINT in the meeting a recess was declared. The time was 8:15 p.m. The meeting reconvened at 8:30 p.m. F. Resolution Initiating Proceedings, etc., for Formation of Maintenance District AD -83 -1, Tierra Rejada Road and Other Streets. CONSENSUS: By consensus the Council determined to continue this item to the next regular meeting. G. Resolution Fixing Compensation for Members of the City Council, the Planning Commission, and the Parks and Recreation Commission. The City Attorney introduced Ordinance No. 10 entitled: AN ORDINANCE OF THE CITY OF MOORPARK FIXING THE COMPENSATION OF THE CITY COUNCIL MOTION: Councilmember Harper moved and Councilmember Beaulieu seconded a motion to read the ordinance by title only. The motion carried by unanimous roll call vote. The motion carried by unanimous roll call vote. The City Attorney introduced Resolution No. 83 -37 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA FIXING THE COMPENSATION OF MEMBERS OF THE PLANNING COMMISSION. MOTION: Councilmember Beaulieu moved and Councilmember Prieto seconded a motion to adopt Resolution No. 83 -37. The motion carried by unanimous roll call vote. The City Attorney introduced Resolution No. 83 -38 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA FIXING THE COMPENSATION OF MEMBERS OF THE PARKS & RECREATION COMMISSION. MOTION: Councilmember Beaulieu moved and Councilmember Prieto seconded a motion to adopt Resolution No. 83 -38. The motion carried by unanimous roll call vote. H. Appointments CONSENSUS: By consensus the Council determined that Councilmember Straughan will serve on the Calleguas Creek Steering committee and Councilmember Prieto on the United Disaster Council. MOTION: Councilmember Harper moved and Councilmember Prieto seconded a motion to approve the appointments of Bill LaPerch and Bill Mitchell to the Citizens Transportation Advisory Committee; Victoria Perez and Geraldine Spencer to the Area Housing Authority; Robert Crockford as Member and Everett Braun as Alternate to the Countywide Planning Program Advisory Committee. Resolution Appointing City Clerk The City Attorney introduced Resolution No. 83 -39 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA APPOINTING DORIS D. BANKUS CITY CLERK AND FIXING THE COMPENSATION MOTION: Councilmember Straughan moved and Councilmember Harper seconded a motion to adopt Resolution No. 83 -39. The motion carried by unanimous roll call vote. J. Approval of Warrants Warrants No. 136 - 147 $5,857.23 MOTION: Councilmember Beaulieu moved and Councilmember Harper seconded a motion to approve the Warrants. The motion carried by roll call vote 4 -0, Mayor Yancy- Sutton absent for the vote. K. Medical Insurance Mr. Fritz gave the staff report requesting that as an interim measure, the City Manager be authorized to enter into a contract for medical coverages as part of the City of Simi Valley Group Policy, at a cost not to exceed $299.51 per month. MOTION: Councilmember Harper moved and Councilmember Beaulieu seconded a motion to approve the staff recommendation to authorize the City Manager to enter into a contract for medical coverages as part of the City of Simi Valley Group Policy, at a cost not to exceed $299.51 per month. The motion carried by unanimous roll call vote. L. Appointment of Delegates to League Conference The Council determined that none of its members were attending the meeting. No delegate was appointed. Minutes of the City Council Moorpark, California Page 7 September 21, 1983 8. PUBLIC WORKS MATTERS: A. Approval of Parcel Map No. PM -3828 Mr. Fritz gave the staff report. AT THIS POINT in the meeting a recess was declared. The time was 9:15 p.m. The meeting reconvened at 9:25 p.m. MOTION: Councilmember Straughan moved and Councilmember 'Harper seconded a motion to approve Parcel Map 3828. The motion carried by voice vote 4 -1, Councilmember Beaulieu dissenting. 9. PLANNING MATTERS: A. Resolution Approving PD -939 (STG Development) The City Attorney introduced Resolution No. 83 -40 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, APPROVING RESIDENTIAL PLANNED DEVELOPMENT PERMIT PD -939 (STG DEVELOPMENT) MOTION: Councilmember Harper moved and Councilmember Straughan seconded a motion to adopt Resolution No. 83- 40. The motion carried by unanimous roll call vote. B. Resolution Denying Appeal No. 148 regarding PD -851 (Pacifica /Pardee) C. Resolution Approving Appeal No. 149 regarding PD- 851 (Pacifica /Pardee) D. Resolution Approving PD -851 (Pacifica/Pardee) MOTION: Councilmember Harper moved and Councilmember Prieto seconded a motion to continue items 9.B., 9.C., and 9.D. to the next meeting. The motion carried by unanimous voice vote. 10. COUNCIL COMMENTS AND FUTURE AGENDA ITEMS: A. Freeway Connection Mayor Yancy- Sutton gave a report on the proposed 118/23 Freeway Connection. Oil Field Waster Disposal Site Mayor Yancy- Sutton gave a report on a proposal that oil wastes be allowed at the Simi Valley Landfill. She said she opposed dumping oil wastes at the site because most of the material would pass through Moorpark on its way from the western end of the County. MOTION: Councilmember Harper moved and Councilmember Straughan seconded a motion to oppose the Simi Landfill's proposal to allow dumping of oil wastes. The motion carried by unanimous voice vote. C. Consider Directing the Preparation of the following Ordinances: 1) Noise; 2) Vehicle Parking on Streets; 3) Private Auto Repairs on Streets or Residential Property CONSENSUS: By consensus the Council determined to place on the agenda for the next meeting consideration of an ordinance restricting the parking of campers and vehicles being repaired. CONSENSUS: By consensus the Council determined that the City Clerk should procure from the League of California Cities copies of various city ordinances regulating noise. D. Discussion of City's Obligation to Enforce CC &R's CONSENSUS: By consensus the Council determined to direct the City Manager to report back to the Council at the next meeting on the subject of "Granny Flats ". 11. ADJOURNMENT: Mayor Yancy- Sutton stated that the Council would not adjourn to a Joint Meeting with the City Council of Simi Valley on September 29th as had previously been planned.
