May 18, 1985
An adjourned regular meeting of the City Council of the City of
Moorpark, California, was held on May 18, 1985, in the Council
Chambers in the City Hall of said City, located at 799 Moorpark
Avenue, Moorpark.
1. CALL TO ORDER
The meeting was called to order at 9:10 a.m., Mayor Albert Prieto
presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmembers James D. Weak.
3. ROLL CALL
PRESENT: Councilmembers Thomas C. Ferguson, James D. Weak,
Danny Woolard, Leta Yancy - Sutton and Mayor Albert Prieto.
ABSENT: None.
OTHER CITY OFFICIALS AND EMPLOYEES PRESENT:
Steven Kueny, City Manager; Dennis Delziet, City Engineer, and
Earl Ledbetter, from Willdan Associates; Doris D. Bankus,
City Clerk.
4. CITY CLERK'S REPORT RE Affidavits of Service
The City Clerk presented Affidavits of Service of Notice and Call
of Special Meeting of Moorpark City Council, dated May 15, 1985
and signed by Mayor Albert Prieto, as follows:
On Councilmembers Ferguson, Weak, Woolard and Yancy- Sutton
and on Moorpark News, News Chronicle, and The Enterprise,
with The Mirror and the L.A.Times having accepted telephone
service more than 24 hours prior to the meeting.
5. RESOLUTIONS
5. A. Parks Maintenance Assessment District No. AD -85 -1
S.A. 1. Resolution No. 85 -192, Initiating Proceeding for
Formation of District; Consolidating a Portion of
AD -83 -1 Therewith; and Ordering the Engineer to
Prepare and File Report in Accordance Therewith.
The City Engineer made a brief presentation regarding the procedure
to be followed, after which the City Manager presented his report
dated May 16, 1985.
After some discussion, it was moved by Councilmember Yancy- Sutton
and seconded by Councilmember Weak that Resolution No. 85 -192,
entitled:

be adopted, which motion carried by the following roll call vote:
AYES: Councilmembers Yancy- Sutton, Weak, Ferguson,
Woolard and Mayor Prieto;

5.A.2. Resolution No. 85 -193, Approving Engineer's Report
The City Engineer then presented his report entitled, "Parks
Maintenance Assessment District No. AD -85 -1, Lighting and Land-
scaping Act of 1972 ", dated May, 1985, and reviewed its contents,
which included a proposed budget for the fiscal year 1985 -86,
together with a Use Code Formula which he recommended be applied.
During the review of the Engineer's report, it was determined that
changes would be necessary in certain of the Use Codes, that
approval of said report would be contingent upon that fact, and
that there should be language to that effect included in the
resolution of approval.
It was then moved by Councilmember Yancy- Sutton, seconded by Council -
member Weak and unanimously carried that a section be added to such*
resolution of approval, to read as follows:
"That said Engineer's Report, as amended, may be
further modified or changed, pursuant to the provisions
of Section 22630 of the Streets and Highways Code."
It was moved by Councilmember Yancy- Sutton and seconded by Councilmember
Weak that Resolution No. 193, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT FOR "PARKS MAINTENANCE ASSESSMENT DISTRICT
NO. AD -95 -1"
be adopted, which motion carried by the following roll call vote:
AYES: Councilmembers Yancy- Sutton, Weak, Ferguson,
Woolard and Mayor Prieto;
NOES: None;
ABSENT: None.
It was then moved by Councilmember Yancy- Sutton, seconded by Council -
member Weak and unanimously carried that the following changes be
made in the Engineer's Report:

a. In the Budget Estimate, shown on Page A -4 of the
report, all direct costs relating to the maintenance of parks be
included, such as purchase of a vehicle;
b. That on Page A -1, which sets for the Use Code Formula,
the following changes be made:
Use Code 5 changed to read "$3.00 ea."
Use Code 9 changed to read "$3.00 per space ".
After further discussion, it was moved by Councilmember Yancy - Sutton,
seconded by Councilmember Woolard and unanimously carried that staff
report back with a recommendation for Use Codes 11, 15, 16 and 17 to
include two story or more.
5.A.3. Resolution No. 85 -194, Declaring Intention to
Order Formation of District and Fixing Time and
Place for Hearing Objections Thereto.
It was then moved by Councilmember Yancy- Sutton and seconded by
Councilmember Woolard that ResolutionNo. 85 -194, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DECLARING ITS INTENTION TO
ORDER THE FORMATION OF "PARKS MAINTENANCE ASSESS-
MENT DISTRICT NO. AD -85 -1, PURSUANT TO THE LAND-
SCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME
AND PLACE FOR HEARING OBJECTIONS THERETO
be adopted, which motion Carried by the following roll call vote:
AYES: Councilmembers Yancy- Sutton, Woolard, Weak,
Ferguson and Mayor Prieto;
NOES: None;
ABSENT: None.
NON - AGENDA ITEM
At this time, Margaret Sabine, Recreation and Parks Commissioner,
received special recognition and was permitted to address Council,
urging that an application be filed with the State for a grant
for a Senior Citizens facility.
The City Manager assured Council and Mrs. Sabine that City staff
would be represented at the meeting to be held by the County of Ventura
wherein information would be supplied regarding application for such
funds.

5.B. Moorpark Liahtina Maintenance Assessment District No. AD -84 -2
5.B.1. Resolution No. 85 -195, Initiating Proceeding for Annual
Assessments for District; Consolidating Portion of
AD -83 -1, All of AD -84 -1, and All of Tierra Rejada Road -
Landscape Maintenance District; and Ordering Engineer to
Prepare and File Report in Accordance Therewith.
The City Manager gave an overview of the proposed district, as outlined
in his report dated May 16, 1985.
It was moved by Councilmember Weak and seconded by Councilmember
Yancy- Sutton that Resolution No. 85 -195, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, INITIATING PROCEEDINGS FOR
THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LIGHTING
MAINTENANCE ASSESSMENT DISTRICTING. AD -84 -2" FOR
THE FISCAL YEAR COMMENCING JULY 1, 1985 AND ENDING
JUNE 30, 1986; CONSOLIDATING CERTAIN ASSESSMENT
DISTRICTS AND PORTIONS OF ASSESSMENT DISTRICTS WITH
SAID "MOORPARK LIGHTING MAINTENANCE ASSESSMENT
DISTRICT NO. AD- 84 -2 "; AND ORDERING THE ENGINEER
TO PREPARE AND FILE A REPORT IN ACCORDANCE THEREWITH
be adopted, which motion carried by the following roll call vote:

5.B.2 Resolution No. 85 -196, Approving Engineer's Report
The City Engineer then presented his report entitled, "Lighting
Maintenance Assessment District No. AD -84 -2, Lighting and Landscaping
Act of 1972 ", dated May, 1985, and reviewed its contents, which
included a proposed budget for fiscal year 1985 -86, together with
a Use Code Formula which he recommended be applied.
During the review of the report it was agreed by general consent to
delete the following two sentences from page A -6 of the report:
a. Delete "(This represents 25% of total probable
cost spread over 4 years) "; and
b. Delete "(2) Amortized expenses over a 4 year period."
By general consent, Council adopted a policy that gas tax funds be
used for curb and gutter improvements wherever possible, pursuant
to the provisions of the Lighting and Landscaping Act of 1972.

It was moved by Councilmember Weak and seconded by Councilmember
Yancy- Sutton that the Engineer's Report be amended to include the
spread of Assessment District No. AD -84 -1 as recommended by the
City Manager, to assess the specific homeowners in the district for
those costs attributable solely to them, and those costs attributable
to the City be assessed in AD -84 -2; to add a section to the resolution
of approval, to read as follows:
"That said Engineer's Report, as amended, may be
further modified or changed, pursuant to the pro-
visions of Section 22630 of the Streets and Highways
Code."
and that Use Codes 12, 15, 16 and 17 be changed to include one story
or more. Motion carried by the following roll call vote:
AYES: Councilmembers Weak, Yancy- Sutton, Ferguson,
Woolard and Mayor Prieto;
NOES: None; i

During the discussion, the City Engineer distributed a report showing
the esimated assessments for the proposed district, which report was
ordered received and filed.
It was then moved by Councilmember Weak and seconded by Councilmember
Yancy- Sutton that Resolution No. 85 -196, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT, AS AMENDED, FOR "MOORPARK LIGHTING
MAINTENANCE ASSESSMENT DISTRICT NO. AD -84 -2"
be adopted, which motion carried by the following roll call vote:
AYES: Councilmembers Weak, Yancy- Sutton, Ferguson,
Woolard and Mayor Prieto;
NOES: None;

5.B.3. Resolution No. 85 -197, Declaring Intention to Order
Annual Assessments for District; Consolidating Portion
of AD -83 -1, All of AD -84 -1, and All of Tierra Rejada

It was moved by Councilmember Weak and seconded by Councilmember
Yancy- Sutton, that Resolution No. 85 -197, entitled:

The City Manager gave a brief report, outtlining the necessity for
the continuation of the subject district in the event the Parks Main-
tenance District was not approved, and a short discussion followed.
5.C.1. Resolution No. 85 -198, Initiating Proceeding for
Annual Assessments for District; and Ordering
Engineer to Prepare and File Report in Accordance
Therewith.
It was moved by Councilmember Woolard and seconded by Councilmember
Weak that Resolution No. 85 -198, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, INTIATING PROCEEDINGS FOR
THE ANNUAL ASSESSMENTS FOR THE "MOORPARK LANDSCAPE

The Mayor declared a recess, the time being 11:20 a.m.
The meeting reconvened at 11:35 a.m., all members of the Council being
present.
6. OTHER ITEMS FOR CONSIDERATION
6.A. Consideration of Summer Recreation Program
The City Manager presented his report dated May 16, 1985, outlining
the recommendation of the Recreation and Parks Commission concerning
initiation of the Summer Recreation Program.
Dan Rasey, Chairman of the Recreation and Parks Commission, addressed
Council further expanding on the proposed programs, after which it

it was moved by Councilmember Yancy - Sutton, seconded by Council-
member Woolard and unanimously carried to approve the recommenda-
tions of the Recreation and Parks Commission, as outlined in Items
Nos. 1, 2 and 3 of the City Manager's Report, with the exception
that in Item No. 2, the estimated cost of printing the fliers be
changed from $350 to $250.
There was further discussion, including (1) proposed expenditure for
purchase of a ping pong table and various table games for a drop -in
center at the Community Center, and (2) a "scholarship" program for
City- sponsored activities to provide a funding mechanism for
families unable to pay for all or part of the costs for a particular
program. It was moved by Councilmember Yancy- Sutton and seconded
by Councilmember Weak that staff be directed to proceed with
implementation of these two facets of the summer recreation program.
Motion carried by the following roll call vote:
AYES: Councilmembers Yancy - Sutton, Weak, Ferguson,
Woolard and Mayor'Prieto;
NOES: None;
ABSENT: None.
It was then moved by Councilmember Yancy- Sutton, seconded by Council-
member Woolard and unanimously carried that Staff proceed with formula-
tion of plans for the celebration of the City's Second Anniversary,
with instructions to present such plans to Council for approval at a
later date.
It was moved by Councilmember Yancy - Sutton, seconded by Councilmember
Ferguson and unanimously carried that a letter of appreciation be
addressed to Karen Chapel for her participation in the creation of
a summer recreation program.
6.B. Consideration of Including.Street Sweeping, Code
Enforcement, and Recreation Program Information in
Public Notice for Assessment Districts.
The City Manager gave a verbal report regarding a proposal to include
along with the Assessment District notices an informational flier
regarding the City's recently instituted street sweeping program,
stating that there would be no additional postage, that the only
cost involved would be printing the flier and some staff time in
stuffing the envelopes along with the assessment district notices.
It was moved by Councilmember Yancy- Sutton and seconded by Council-
member Weak that the recommendation of the City Manager be approved
to include the street sweeping flier along with the recreation program
flier and the assessment district notices. Motion carried by the
following roll call vote:
AYES: Councilmembers Yancy- Sutton, Weak, Ferguson,
Woolard and Mayor Prieto;
NOES: None;
ABSENT: None.

6.C. Rescission of Hiring Freeze Established by Council
on December 19, 1984.
It was moved by Councilmember Yancy - Sutton, seconded by Councilmember
Woolard and unanimously carried that the City Manager be authorized
to proceed with filling the positions of Recreation Coordinator and
Administrative Secretary, for which positions recruitment had already
been conducted.
7. ADJOURNMENT
There being no further business, it was moved by Councilmember
Yancy- Sutton, seconded by Councilmember Woolard and unanimously
carried that the meeting stand adjourned, the time being 12:20 p.m.
