Moorpark, California
August 12, 1985
An adjourned regular meeting of the Moorpark City Council of the
City of Moorpark, California, was held on August 12, 1985, in the
Council Chambers in the City Hall of said City, located at
799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER
The meeting was called to order at 7:15 p.m., Mayor Albert Prieto
presiding.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmember Ferguson.
3. ROLL CALL
PRESENT: Councilmembers Thomas Ferguson, Danny Woolard,
James D. Weak, Leta Yancy- Sutton, and
Mayor Albert Prieto;
ABSENT: None.
OTHER CITY OFFICIALS PRESENT:
Steven Kueny, City Manager; Cheryl J. Kane, City Attorney;
Diane Eaton, Associate Planner; and Doris D. Bankus,
City Clerk.
4. COMMENTS FROM PUBLIC
None.
5. COMMENTS FROM COUNCILMEMBERS
Councilmember Weak addressed the matter of the services proposed to
be performed by the Senior Citizens organization for the benefit of
the senior citizens of the City, stating it was his opinion those
services must be a part of the proposed agreement between the City
and the Seniors for assistance in the operation of the Senior
Citizens' Thrift Store and Center.
The City Attorney replied that the agreement had been drafted and
transmitted to the City Manager, and that it was her intent that a
list of such services be attached to and incorporated in the agreement.
Dean Newman, representing the Senior Citizens, addressed Council and
presented a list of the proposed services to be provided to the seniors
of the City.
It was the consensus that said list be attached as an exhibit to the
proposed agreement, subject to approval by the Council.
Councilmember Woolard requested clarification regarding the recent
action of Waterworks District No. 1 in making the decision not to

- issue "will serve" letters for sanitation service -f-or new develop-
ment within the City, and then reversing that decision, thus causing
a great deal of confusion, not only to City officials, but to
developers as well.
The City Manager replied, stating he could not speak for Waterworks
District No. 1, but that his current information was that they have
determined there is existing sewer capacity to meet the current
demand; that expansion plans are well under way; and that a study
is nearly completed and will be available soon.
Councilmember Woolard then addressed the matter of the recent action
of the Planning Commission, taken on August 8, 1985, stating the
intent of the Commission not to approve or recommend approval of
any further discretionary entitlements until there exists a "clear
picture" of the infrastructure capacity of the City.
The City Manager stated that he has been consulting with each
member of the Commission to make certain of their intent, and would
keep Council informed.
Councilmember Woolard stated that it was his opinion the Commission
should make a recommendation to the Council on each project, and
that the Council would be the deciding body.
6. ORDINANCES, RESOLUTIONS
6.A. Ordinance re Rent Control
The City Manager presented the draft revision to the Mobile Home
Rent Control ordinance, stating that said revision was the result
of review by the Mobile Home Rent Review Board, with modifications
directed by the City Attorney, as explained in his report dated
August 1, 1985.
The following persons addressed Council regarding the draft ordinance
under consideration:
Bob Wedell, Vella Del Arroyo Mobile Home Park, 15750 L.A.
Avenue, Moorpark, on behalf of Jim Joffe, of
Leasco, manager of the mobile home park;
Joe Antiso, tenant of Villa del Arroyo Mobile Home Park, opposing
various provisions of the proposed ordinance;
Paula Schwem, 15750 Los Angeles Avenue, #123, Vella Del Arroyo
Mobile Home Park, suggesting that Council reserve
authority for final decision on all rent increases;
Dean Newman, Villa Del Arroyo Mobile Home Owners Association,
declined to speak;
Rev. William E. Raney, 15750 L.A. Avenue, Space #237,
opposing various provisions of the proposed ordinance,
and suggesting that Council retain authority for
approval of all rent increases.

During the public testimony some confusion was expressed regarding
the codification of the rent control ordinance into the Moorpark
Municipal Code, and the City Manager explained the reason the
ordinance was written that way, and that it was strictly administerial
and had nothing to do with its legality or effectiveness. He also
explained that most of the provisions of the original Ordinance No. 7
had been retained in the proposed draft.
Councilmember Yancy - Sutton stated that she felt the Council should
be the hearing body on an administerial basis; that if there is no
appeal, the matter be placed on the Consent Calendar for approval,
and that if there is an appeal, then the procedures for hearing,
as outlined in the ordinance, would be followed.
RECESS
The Mayor declared a recess, the time being 9:35 p.m.
The meeting reconvened at 10:05 p.m., all members of the Council
being present.
6.A. Rent Control Ordinance (continued)
Discussion ensued between members of the Council and staff, centering
mainly on the provisions of Sections 5.04.070 and 5.04.080 of the
proposed ordinance. It was the consensus that Section 5.04.070 should
be changed to provide, in the first paragraph, as follows:
"The procedures and fees set forth in Sections 5.04.080
and 5.04.090 shall not be applicable to any proposed space
rent increases of no more than five percent (5) or 2/3 of
the CPI, whichever is lower, of the total space rent of
each effected space......"
During the discussion regarding Section 5.04.080 of the proposed
ordinance, it was the consensus that the determination of the
remainder (after operation and maintenance allowance) of the pro-
posed increase would be determined by the calculation of from
between 40% and 70% of the Consumer Price Index, and in no event
more than seven percent (7 %), to be determined by the City Council.
Mr. Joe Antiso addressed Council once again, still in opposition
to various provisions of the proposed ordinance.
It was moved by Councilmember Yancy- Sutton, seconded by Councilmember
Ferguson, and unanimously carried that the City Attorney and
City Manager prepare another draft of the proposed ordinance,
encompassing the matters agreed upon by members of the City Council,
and that such new draft be presented to the City Council for
consideration at its meeting of September 3, together with an
emergency ordinance extending the present moratorium of mobile home
park rent increases.

7. ADJOURNMENT
There being no further business to be considered, it was moved
by Councilmember Yancy- Sutton, seconded by Councilmember Woolard
and unanimously carried to adjourn, the time being 10:47 p.m.
