A regular meeting of the City Council of the City of Moorpark,
California, was held on April 7, 1986, in the Council Chambers in
the City Hall of said City, located at 799 Moorpark Avenue , Moorpark ,
California .
1 . CALL TO ORDER
The meeting was called to order at 7:08 p.m. , Mayor James D. Weak
presiding. ,
2 . PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Weak.
3 . ROLL CALL
PRESENT: Councilmembers Thomas C. Ferguson, Albert Prieto,
Danny A. Woolard, Leta Yancy-Sutton, and Mayor
James D. Weak;
ABSENT: None.

4 . APPROVAL OF MINUTES
It was moved by Councilmember Yancy-Sutton, seconded by Councilmember
Ferguson and unanimously carried that the minutes of the Special
Meeting of January 24, 1986, be approved as recorded.
It was moved by Councilmember Yancy-Sutton, seconded by Councilmember
Prieto and unanimously carried that minutes of the Regular Meeting
of February 3 , 1986 be approved as recorded .
It was moved by Councilmember Yancy-Sutton, seconded by Councilmember
Prieto and unanimously carried that minutes of the Joint Meeting with
the Moorpark Unified School District, held March 10, 1986 , be approved
as recorded.
5. PROCLAMATIONS/COMMENDATIONS AND SPECIAL PRESENTATIONS
5.A. Moorpark Traffic Safety Week - May 18 through 24, 1986

The Mayor read proclamations of all of the above and declared the
specified weeks and day respectively.

5 .D. Presentation of First City Plaque to Bill Mitchell
The Mayor made a special presentation of the first plaque of the
City bearing a copy of the City ' s seal to Mr. Bill Mitchell , who
had designed the seal prior to the City ' s incorporation, said seal
having been adopted by the City Council at the first meeting held
by the City Council after incorporation, July 2 , 1983 .
Mr. Mitchell made a short response of appreciation for the presentation
and related to the Council the significance of each part of the design
of the seal .
6 . COMMENTS FROM THE PUBLIC
6 .A. Irene Barrera, 172 Second Street, Moorpark, addressed Council
concerning a problem which has been occurring on a vacant lot on
Second Street , particularly on Thursday to Sunday nights, commencing
about 3 :00 p.m. in the afternoon and continuing to 2 or 3 in the
morning - much drinking, loud music and noise , and loitering. She
said she has called the Sheriff ' s Department, but that the problem
still exists, and she requested a permanent solution to the problem.
By general consent staff was instructed to investigate the matter and
see if the problem can be solved. Lt. Brown said he had talked with
Mrs . Barrera and had already started an investigation, and would
report back to the Council .
6 .B. Joe Intiso, 15750 Los Angeles Avenue, Moorpark, addressed
Council regarding the speed limit on Los Angeles Avenue in front of
the Villa Del Arroyo Mobilehome Park.
City Engineer responded that a speed survey had been conducted ,
and that he would meet with Mr. Intiso and furnish him a copy of the
survey so they could discuss it.
6 .C. Elaine Freeman, representing Griffin Homes, 24005 Ventura Boule-
vard, Calabasas, California, addressed Council to clarify any mis-
understanding regarding statements which had appeared in a local news-
paper, stating that Griffin Homes has been in the community for many
years and has a commitment to their buyers and the City of Moorpark ,
that all customer service requests referred to them will be addressed
to determine Griffin Homes ' responsibility; and that Griffin Homes will
take care of all items and be available to customer service requests.
She also apologized to Councilmember Woolard for the reference which
had been made to his wife in the article.
Mr . Woolard accepted the apology and stated that his wife had never
made any profit on the sale of property through Griffin Homes .

7 . HEARINGS
7.A. Conditional Use Permit No. CUP-4502 - Sun Exploration and
Production Company''s request approval to drill an exploratory
oil well. Location: Approximately 6, 000 feet southwest of
the intersection of Los Angeles Avenue and College View Avenue

7.B. Net vs . Gross Density - (Continued from March •17 , 1986)

7.C. Development Plan Permit Nos. DP-320 and DP-322 (F. E.Financial)
Request Approval for development plans to permit an office and
medium industrial facility which would encompass two structures ,
each containing 20,760 square feet. Location: On Commerce,, ,
400 feet south of Poindexter Avenue (Continued from 3-17-86) •
The Associate Planner presented and reviewed her report dated
March 17, 1986 and described the two Development Plans . After questions
posed by members of the City Council, the Mayor declared the hearing
opened and the City Clerk presented the following documents for filing:
1 . Affidavit of mailing notice of public hearing to the
property owners within 300 foot radius of the, subject
property, which notices were mailed on March 3 , 1986;
2 . Proof of publication of notices of hearing in the Moorpark
News on March 12 , 1986 .
There being no persons present desiring to give testimony, either for
or against the development plans, the Mayor declared the hearing closed .
After discussion, it was moved by Councilmember Yancy-Sutton and
seconded by Councilmember Prieto that the Council finds that the proposed
projects will not have a significant effect on the environment and that
the Council has reviewed and considered the information contained in the
Negative Declaration and does approve the Negative Declaration on file
as having been completed in compliance with State CEQA Guidelines issued
thereunder, which motion carried by the following roll call vote :
AYES: Councilmembers Yancy-Sutton, Prieto and Mayor Weak;
NOES: Councilmembers Woolard and Ferguson;
ABSENT: None.
It was then moved by Councilmember Yancy-Sutton and seconded by
Councilmember Prieto that the Council adopts the findings as recommended
by the Planning Commission and approves DP-320 and DP-322 , subject to
the recommended conditions; further, that staff be instructed to prepare

a resolution of approval for presentation at the next Council Meeting .
Motion carried by the following roll call vote :

Councilmembers Woolard and Ferguson both expressed concern regarding
traffic on Poindexter Avenue , generated by the subject developments .
7 . D. Amendment to Zoning Ordinance (A-85-3) re Changes to Industrial
Setback Requirements (Article 23) and to Parking and Loading
Unloading Space Requirements (Article 41 ) .
By general consent this item was continued to the meeting of
April 21 , 1986.
7 . E. Development Agreement for Planned Community No . PC-3
The City Manager presented and reviewed in detail his report dated
April 4 , 1986, together with his report to the Planning Commission,
dated March 21 , 1986, regarding the proposed Development Agreement.
After discussion with members of the City Council , the Mayor declared
the hearing on this matter opened, and the City Clerk presented the
following documents which were ordered, received and filed
by general consent :
1 . Proof, of publication of Notice of Hearing, published
in the Moorpark News on March 12, 1986;
2 . Affidavit of Mailing Notice of Hearing to all property
owners within 300 foot radius of the subject property,
mailed on March 10, 1986.
3 . Communications as follows:
From Marilyn Peterson, dated April 7, 1986, with petition
bearing 33 signatures, in support of Agreement;

(Both of the above gentlemen were referred to staff
to discuss their concerns)

During his testimony, Mr. Galloway questioned the propriety of
Councilmember Yancy-Sutton 's participation regarding the subject
Development Agreement, inasmuch as her husband is an employee,of,
D. W. Burhoe, Inc. , which firm has been under contract with Urban
West Communities in some of the development of PC-3 , and advising
that he has requested a ruling from the Fair Political Practices
Commission.
Councilmember Yancy-Sutton responded that the projects she has
voted on have had nothing to do with D. W. Burhoe, that after a
project is approved, D.W. Burhoe bids for the job along with every-
one else; that Mr. Sutton is an estimator for D. W. Burhoe, and whether
or not D. W. Burhoe is awarded a contract has nothing to do with her
husband ' s status with the firm, or her position as a Councilmember.
The following person then addressed Council in opposition to the
Development Agreement:

RECESS
The Mayor then declared a recess , the time being 9 : 05 p .m.
The meeting reconvened at 9: 20 p.m. , all members of the Council
being present.
There being no further public testimony to be given, the public hearing
was declared closed.
Then followed considerable discussion between Member of the City
Council , the City Attorney and the City Manager, regarding the
specifics of the proposed agreement.
During the discusson regarding the various provisions of the develop-
ment agreement and at the suggestion of Councilmember Yancy-Sutton,

concurred in by the remaining members of the Council, Subparagraph
F of Paragraph 5 is to be amended to provide that any application
received by the City shall be accompanied by a schedule• of population
allocation in reserve under the Air and Water Plans, thus ensuring
proper development of the Project.
There were no other changes or amendments suggested by members of the
Council, and the City Attorney, at the request of the Mayor, presented
Ordinance No. 69, entitled:
AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA
APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY
AND UWC MOORPARK INVESTORS (PLANNED COMMUNITY NO. 3)
It was moved by Councilmembers Woolard, seconded by Councilmember
Yancy-Sutton and unanimously carried that further reading of said
Ordinance No. 69 be waived and the ordinance declared read for the
first time.
It was then moved by Councilmember Yancy-Sutton and seconded by
Councilmember Woolard that Ordinance No. 69 be introduced, which
motion carried by the following roll call vote:
AYES: Councilmembers Yancy-Sutton, Woolard, Ferguson,
Prieto and Mayor Weak;

7.F. Housing Element of General Plan

The meeting reconvened at 10: 00 p.m. , all members of the Council

9. COMMENTS FROM COUNCILMEMBERS
9.A. Appointment to VCAG Citizens Transportation Advisory Committee
Mayor Weak appointed Tina May, of 901 Los- Angeles Avenue, as a member
of the VCAG Citizens Transportation Advisory Committee, representing
the City of Moorpark. There were no objections to the appointment,
which was ratified by general consent.
9.B. Appointment of Tenant Commissioner, Area Housing Authority
Mayor Weak re-appointed Mrs . Virginia Hall as the Tenant Commissioner
on the Board of the Area Housing Authority, for the two-year period
ending March 31 , 1988. There were no objections td the appointment ,
which was ratified by general consent.
9 .C. Voting Delegate and Alternate to Board of Directors of
California Contract Cities Association
There being no objections , the following designations, to represent
the City of Moorpark were approved:

9.D. Press Packets for Council Meetings
Councilmember Woolard stated that he felt the press should be furnished
a complete press packet for each Council Meeting, to which the City
Clerk replied that a, complete packet is placed on the press table
prior to each meeting, and that each member of the press is furnished
a packet containing only the staff reports, without the back-up
material, but that it had not been her practice to furnish a copy of
the warrant register.
Dion Lefler, of the News Chronicle, addressed Council regarding this
matter, in support of the press receiving the complete packet .
The City Clerk agreed to include the warrant register in the packet
for the press table, but no other change was made in procedure.

9 .E. Child Safety Week
Councilmember Yancy-Sutton requested information regarding the
extent of involvement of the Sheriff ' s Department, to which Lt. Brown
replied that he would investigate as to plans for the finger-printing
and would offer whatever assistance is possible from his department.
9 .F. Tree Removal in Peach Hill Park
Councilmember Yancy-Sutton reported a receipt of a complaint regarding
a large hole where trees were removed in Peach Hill Park, and requested
status report, to which the City Manager replied the .matter was being
taken care of .
9.G. Sidewalk Improvement on Moorpark Avenue
Councilmember Yancy-Sutton read a prepared statement regarding the
recent improvement of sidewalks , curb and gutter on Moorpark Avenue,
stating that it was her recollection that the intent was to build
sidewalks where none exist, and stating that she was not aware that
existing sidewalks were going to be replaced. She then recommended
that in the future, when an off-site improvement is planned, that all
affected parties be notified and a public hearing be held to receive
public comments regarding the proposed improvement .
9.H. Smoking in the Council Chambers
It was moved by Councilmember Ferguson and seconded by Councilmember
Woolard that smoking be banned in the Council Chambers during sessions
of the City Council, Planning Commission and the Parks and Recreation
Commission .
The City Manager suggested consideration of an interim policy to
refer the matter to the Parks and Recreation Commission for consideration
as a part of their Rules and Regulations, with a request for a
recommendation.
On roll call the above motion failed to pass by the following roll
call vote:
AYES: Councilmembers Ferguson and Woolard;
NOES: Councilmembers Prieto, Yancy-Sutton and Mayor Weak;
ABSENT: None .
Mayor Weak then moved that no smoking be permitted ifi the Community .
Center , except in the area where City Hall Offices are located, as
an interim policy, and that the matter be referred to the Parks and
Recreation Commission for recommendation. Said motion was seconded
by Councilmember Yancy-Sutton and unanimously carried.

9. I. Use of AC Pipe
Councilmember Prieto moved that staff prepare a report regarding
the abolishing of AC pipe in the City Of Moorpark, which would then
require the construction industry to provide input regarding its
use and some alternatives, which motion was seconded by Councilmember
Woolard and unanimously carried .

9.J. Bus turn-out at Senior Housing Complex on Charles Street
Councilmember Prieto report that the bus turn-out at the Senior
Housing Complex on Charles Street was being used for diagonal parking
by residents on Charles Street. The City Engineer replied that this
was intended for loading and unloading of residents of the Complex,
and not for parking. Staff to investigate and report.
9.K. Parked Train Cars
Mayor Weak requested staff to investigate with Southern Pacific to
see about moving train cars parked in the downtown area and along
Poindexter Avenue for several weeks .
9 .L. Stop Sign at Ashtree and Mesa Verde
Mayor Weak reported that the stop sign at the corner of Ashtree and
Mesa Verde has been down for several weeks.
9.M. Newsrack Ordinance
Mayor Weak inquired regarding the status of the newsrack ordinance ,
and the City Attorney replied she anticipated having it ready at the
next Council Meeting.
10. STAFF REPORTS - ACTION ITEMS
10.A. Bicycle and Pedestrian Safety Project - Application for SB-821 Funds
The Administrative Assistant presented his report dated April 3, 1986, recommending
that the City Council authorize the submission of an application to Ventura County
Association of Governments for a grant under Senate Bill 821 for the construction
of sidewalks, curb, gutter and pavement for pedestrian safety for the area along
the north side of High Street, more particularly described as follows:

After discussion, it was moved by Councilmember Yancy-Sutton, seconded by
Councilmember Prieto and unanimously carried that the recommendation of the
Administrative Assistant be approved and that an application be made to Ventura
County Association of Governments requesting SB 821 funding for sidewalks,
curb, gutter and pavement along the north side of High Street east to approximately
150 feet from Moorpark Road, to provide for pedestrian safety.
10.B. Installation of "KEEP CLEAR" Package on Moorpark Avenue at
Poindexter Avenue
The City Engineer reviewed his report dated March 27, 1986, and after dis-
cussion, it was the consensus of the Council that staff would pursue the matter
and report back regarding installation of a three-way stop sign.
10.C. Rubberized Railroad Crossing Status Report
The City Engineer presented his report dated April 3, 1986, and after discussion
it was received and filed by general consent. The City Manager reported that
he had requested information from the State Controller's office regarding use of
gas tax funds for installation of rubberized crossings, and that an answer would
be forthcoming soon.
10.D. Request from Animal Regulation Department re Code Amendment
The City Manager reviewed his report dated April 4, 1986, and after discussion
staff was instructed to prepare an ordinance for the next Council meeting to
comply with the request from the Director of the Animal Regulation Department,
as contained in the staff report.
10.E. Recommendation from Parks and Recreation Commission Regarding
Informational Brochure
The Administrative Assistant presented and reviewed his report dated April 3,
1986, and during discussion, Dan Schmidt, of the Mirror, who had submitted
the proposal, was permitted to address the Council.
Most of the discussion concerned the question of whether or not to ;allow the
sale of advertising to cover the majority of the costs of production and printing
the brochure, as opposed to the City's absorbing the entire cost.
It was moved by Councilmember Ferguson and seconded by Councilmember Woolard
that the recommendation of the Parks and Recreation Commission be approved, to
allow the sale of advertising to cover the majority of the costs involved in
production of the 4"Summer Recreation Brochure", if the concerns expressed by
the members of the Council can be worked out with Mr. Schmidt. Motion carried
by the following roll call vote:
AYES: Councilmembers Ferguson, Woolard, Prieto and
Mayor Weak;
NOES: Councilmember Yancy-Sutton;
ABSENT: None.
The Mayor called attention to the fact that the time was 11:40 p.m. , and it was
the unanimous decision of the Council to continue with the ordinance of business
as shown on the Agenda.

- 10.F.1 Report from City Attorney re Public Comment Period
The City Attorney reviewed her report dated March 24, 1986, and after dis-
cussion it was moved by Councilmember Yancy-Sutton, seconded by Councilmember
Prieto and unanimously carried that Council adopt the policies set forth on
Page 3 of said report, and that a resolution be prepared for the next •
Council meeting, amending the Council Rules of Procedure to reflect those policies.
It was moved by Councilmember Woolard, seconded by Councilmember Yancy-Sutton
and unanimously carried that all announcements for public hearing contain a
statement that public comments regarding the subject will be confined to the
time of the public hearing.
10.F.2 Revised Speaker Card
After a brief discussion, this item was continued for further study, with
no time certain for return to the agenda.
11.E. Scope of Work for Caren Traffic Study
By general consent, this item was considered at this time.
The City Engineer presented his report dated March 4, 1986, and there was
discussion between the City Engineer, the City Manager and Members of the
City Council, after which the following person addressed Council:
John Newton,165 High Street, Suite 204, Moorpark, representing
the applicant.
Mr. Newton requested, on behalf of his client, that the proposed up-date of the
traffic study not be at the expense of the applicant, based on the fact that he
had already provided $8,000 for a traffic study and $1200 for traffic signalization
study for Moorpark and Poindexter. Further, he stated that in his opinion the
proposed scope of work was in excess of that necessary to address the concerns
of Council, which was the traffic situation at Moorpark Avenue and Poindexter,
and which did not include the High Street intersection on Moorpark Avenue. He
further urged that the work be completed prior to summer vacation. He expressed
concerns regarding entitlement rights authorized in the C-2 Zone, and offered to
relinquish occupancy of the buildings to certain kinds of businesses.
Mr. Newton also requested the City•to reliev e his client from the payment of
another fee ($175) for installation of the project sign, since his client had called
City Hall and had been informed that the matter was over.
The City Engineer stated that he would break out the costs for the inclusion-of
High Street and Moorpark Road intersection and would have a report at the
next Council meeting. By general consent the matter was continued to the
meeting of May 5, 1986.

10.G. Budget Transfers and Appropriations
The City Manager presented and reviewed his report dated April 4, 1986, and
it was moved by Councilmember Yancy-Sutt on, seconded by Councilmember Woolard
and unanimously carried to approve the recommendations of the City Manager as
follows:
1. Appropriate $3,400.00 from the General Fund Reserve to Account No. 01-116-541
(Finance Department - Professional Services) for additional services from
Arthur Young and-Company.
2. Authorize transfer of funds as follows:
(a) $700.00 from 01-148-502
to 01-113-503
(b) $400.00 from 25-147-502
to 25-147-504
3. Authorize appropriation of $4,900.00 from the Park Improvement Fund for the
demolition work at the future Community Park.
4. Authorize appropriation of an amount not to exceed $4,000.00 from Account
No. 01-131-502 (Planning - Regular Employee Salaries) to Account No.
01-131-529 (Planning - Special Departmental Supples and Services) for
moving related expenses for Director of Community Development.
10. H. Authorization to Transfer between Expenditure Accounts
The City Manager presented his report dated April 3, 1986, and it was moved by
Councilmember Yancy-Sutton, seconded by Councilmember Prieto and unanimously
carried to approve the recommendation of the City Manager, and authorize him to
approve within each department transfers between expenditure accounts:
A. (1) Within the Personnel Costs and (2) within Supplies, Services,
Maintenance and Operations budget categories, so long as the City
Council approved budget appropriation for that budget category
is not exceeded;
B. Within each expenditure account for the Capital Outlay budget
category.
10. p. Moorpark Road Washout (between Los Angeles Avenue and Arroyo Simi)
The City Engineer presented his report dated April 2, 1986, and after discussion
it was moved by Councilmember Yancy-Sutton, seconded by Councilmember Prieto
that Option No. 1 be approved as recommended, and that action be taken to
repair Moorpark road to its previous width with minimal improvements to the
existing drainage ditch.
