HomeMy WebLinkAboutMIN 1986 0915 CC REGMINUTES OF THE CITY COUNCIL Moorpark, California September 15, 1986 The regular meeting of the City Council of the City of Moorpark, California was held on September 15, 1986, in the Council Chambers in the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting was called to order at 7:05 p.m. by Mayor Ferguson. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Yancy- Sutton. 3. ROLL CALL PRESENT: Councilmembers James Hartley, Albert Prieto, Danny Woolard, Leta Yancy- Sutton and Mayor Thomas Ferguson Steven Kueny, City Manager; Cheryl J. Kane, City Attorney; John Knipe, Asst. City Engineer; Lt. Mike Brown, Sheriff's Department; Richard Morton, Acting Director of Community Development; Mike Rubin, Senior Planner; Thomas Genovese, Administrative Assistant; and Lucinda Robertson, Acting Recording Secretary. 4. APPROVAL OF MINUTES 4.A. Councilmember Yancy- Sutton indicated the minutes should reflect she abstained due to possible conflict of interest concerning Item 7.A., and also indicate for that item that Art Goulet, Engineering Manager, Ventura Waterworks District, stated provisions of water and sanitation will keep pace with projected construction. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Prieto, to approve the Minutes of September 2, 1986 as amended, carried unaminously. 5. PROCLAMATIONS /COMMENDATIONS AND SPECIAL PRESENTATIONS Mayor Ferguson proclaimed the week of October 14, 1986 through October 18, 1986 as "Child Care Week" in acknowledgment and recognition of the need for quality child care. 6. COMMENTS FROM THE PUBLIC 6.A. Victor Richard, 15750 -168 Los Angeles Avenue, Moorpark, inquired what future impacts may affect his residence in Villa Del Arroyo mobile home park due to possible zoning differences on this property since he noticed that the mobile home park at the corner of Los Angeles Avenue and Moorpark Road is advertised as commmercial zoning. City Manager Kueny advised that the property at the corner of Los Angeles Avenue and Moorpark Road is zoned commercial and the current residential use is legal non - conforming; the owners have the opportunity to convert the property to commercial use; the property where Mr. Richards resides is zoned for mobile home park purposes. Minutes of the City Council Moorpark, California 2 September 15, 1986 6.B. Eloise Brown, 13193 Annette, Moorpark, requested Council oppose removal of any land from the Tierra Rejada Greenbelt. Staff advised that a portion of the subject area has been determined by LAFCO to not fall within the realm of the Tierra Rejada Greenbelt; the issue will be brought before Council for action at a future date. 7. HEARINGS 7.A. Noise Element HEARING having been advertised as required by law was opened regarding the proposed Noise Element. Acting Director of Community Development Richard Morton presented the staff report. The Noise Element was prepared by J.J. Van Houten & Associates, Inc., Anaheim, accoustical engineers. John Van Houten summarized the basic components of the element with inclusion of modifications as recommended by the Planning Commission. Councilmember Yancy- Sutton requested the modifications regarding policies and implementation as recommended by the Planning Commission be included in the final Noise Element document; Councilmember Hartley suggested an informational sheet be prepared summarizing the Element conditions to serve as a handout for developers. Mayor Ferguson directed the item be continued to the next regular meeting on October 6, 1986 for further consideration; staff to return with Resolution of Adoption, and Negative Declaration; Council to provide input to staff as to desired modifications or additions to the Element. 7.B. Development Plan Permit Nos. DP- 338 -347 and DP- 349 -353 (Annotti Accnriatac It was the consensus of the Council to continue this item on an open hearing basis until October 6, 1986; staff to provide plans and circulation informa- tion. 7.C. Proposed Revised Sian Code HEARING having been advertised as required by law was opened regarding the proposed revised Sign Code. Acting Director of Community Development Richard Morton presented the staff report. Paul Tryon, 601 Daily Drive, No. 229, Camarillo, representing the Business Industry Association (BIA), stated he is in agreement with staff's recommenda- tions and encourages adoption of the Sign Code as proposed. Councilmember Woolard requested removal of Exclusion 5 from Exhibit 1. So ordered; Councilmember Yancy- Sutton stated she was concerned regarding the strength and efficiency of the proposed Sign Code and suggested further consideration and study. Minutes of the City Council Moorpark, California 3 September 15, 1986 Motion by Councilmember Yancy Sutton to continue the hearing on an open hearing basis until October 6, 1986; a committee of two Councilmembers and staff to be formed to review the proposed Sign Code and provide recommenda- tions back to Council, seconded by Councilmember Hartly, carried unanimously. Mayor Ferguson appointed Councilmembers Yancy- Sutton and Hartley to serve on the committee. 8. ORDINANCES /RESOLUTIONS 8.A. Ordinance No. 80, Amending the Zoning of Certain Properties (Zone Change No. Z -2806, Caren) ORDINANCE NO. 80, AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING THE ZONING OF CERTAIN PROPERTIES (ZONE CHANGE NO. Z -2806, CAREN) Motion by Councilmember Hartley, seconded by Councilmember Prieto, that Ordinance No. 80 be read in title only, further reading be waived, carried unanimously. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to adopt Ordinance No. 80, carried unanimously. 8.B. Resolution No. 86 -342, Approving the Application for Grant Funds Under the Regional Competitive Program of the California Park and Recreational Facilities for Monte Vista Nature Park RESOLUTION NO. 86 -342, OF THE CITY COUNCIL OF THE CITY OF MOORPARK APPROVING THE APPLICATION FOR GRANT FUNDS UNDER THE REGIONAL COMPETITIVE PROGRAM OF THE CALIFORNIA PARK AND RECREATIONAL FAC- ILITIES ACT OF 1984 FOR MONTE VISTA NATURE PARK Administrative Assistant Genovese presented the staff report concerning the grant application and conceptual design for Monte Vista Nature Park. Motion by Councilmember Yancy- Sutton to approve the conceptual design of Monte Vista Nature Park, and adopt Resolution No. 86 -342, seconded by Councilmember Woolard, carried unanimously. Motion by Councilmember Yancy- Sutton to refer the item back to the Parks and Recreation Commission for consideration of naming the park "Monte Vista Nature Park ", seconded by Councilmember Hartley, carried unanimously. Motion by Councilmember Yancy- Sutton that a Resolution of Commendation be prepared for Daniel Claffey for his proposal and involvement concerning the Monte Vista Nature Park, seconded by Councilmember Prieto, carried unanimously. Council recessed at 8:27 p.m. and reconvened at 8:41 p.m. Minutes of the City Council Moorpark, California 4 September 15, 1986 9. COMMENTS FROM COUNCILMEMBERS 9.A. Designation of Voting Delegate for League of California Cities Annual Conference Motion by Councilmember Yancy- Sutton to appoint Mayor Ferguson as voting delegate for the League of California Cities Annual Conference, Mayor Pro - Tem Woolard to serve as alternate, seconded by Councilmember Prieto, carried unanimously. Councilmember Hartley commended City Manager Kueny for awareness of technical problems concerning residential permit issuance for 1986; stated information received concerning further growth forecasts and methodology is used to establish the appropriate number of dwelling units constructed per year and the number of predicted units should not exceed the assumed growth forecasts. Mayor Ferguson commented regarding area dust and mosquito nuisances; requested staff report. Councilmember Yancy- Sutton advised there is a Moorpark Mosquito Abatement District phone number available to the community for immediate action. 10. STAFF REPORTS /ACTION ITEMS 10.A. Moorpark Country Days Agreement Administrative Assistant Thomas Genovese presented the staff report and recommendation for approval of the Moorpark Country Days agreement. Motion by Councilmember Yancy- Sutton to approve the execution of the Agreement by and between the City of Moorpark and the Moorpark Chamber of Commerce for sponsorship of Moorpark Country Days with addition of addendums, seconded by Councilmember Hartley, carried unanimously. 10.B. Excess Liability Insurance Administrative Assistant Genovese presented the staff report and staff recommendation concerning excess liability insurance. Motion by Councilmember Yancy- Sutton to authorize additional appropriation of $7,500 from General Fund Reserve to account 01- 117 -548 Insurance & Bonds and authorize purchase of additional insurance coverage of three million in excess of two million from the State of Pennsylvania Insurance Company, seconded by Councilmember Prieto, carried unanimously. I.O.C. Agreement to Construct Improvements and Approval of the Final Map for Tract 3963 -1 Griffin Homes Councilmember Yancy- Sutton excused herself from the dais due to conflict of interest concerning this item. Assistant City Engineer Knipe presented the staff report and recommended action. Bill Mitchell, 6440 N. Berkeley, Moorpark, representing Highway 118 Improvement Association, spoke in opposition to the approval of tract map and development due to traffic impacts. Minutes of the City Council Moorpark, California 5 September 15, 1986 Elaine Freeman, representing Griffin Homes, reported alternate route/ traffic studies and communication with Cal Trans are in progress. Motion by Councilmember Woolard to approve the final tract map and agreement for Tract 3963 -1 (Griffin Homes), seconded by Councilmember Prieto, carried 4 -0, Councilmember Yancy- Sutton absent. Councilmember Yancy- Sutton returned to the dais. 10.D. Parks Master Plan Administrative Assistant Genovese presented the staff report and recom- mended action; reported the intent of the document is to serve as a statement of general policy of city standards for location, size and amenities; recommended proposals for new parks include description of park and amendment to page five of the Plan concerning Mini Parks to state "...serve a population of 500 to 2,500 and consist of but not be limited to..." Councilmember Yancy- Sutton requested page seven of the document, first paragraph, reflect the projected population of Moorpark at build out to be approximately 33,878 at the year 2,000. Motion by Councilmember Yancy- Sutton to adopt the Moorpark Parks and Recreation Master Plan and added recommendations and amendments, seconded by Councilmember Woolard, carried unanimously. 10.E. Liability Insurance Amount for Newsrack Installation on Public Property Councilmember Hartley excused himself from the dais due to his unfamiliar - arity with previous discussion concerning this matter. City Manager Kueny presented the staff report and recommended pursuant to Section 14.16.030 of Ordinance No. 78, establish the minimum liability insurance amount as $500,000.00 combined single limits for bodily injury and property damage. Motion by Councilmember Yancy- Sutton to establish a minimum liability insurance amount as $500,000 combined single limits for bodily injury and property damage for newsrack installation on public property, seconded by Councilmember Prieto, failed 2 -2, Councilmember Woolard and Mayor Ferguson dissenting. Motion by Councilmember Woolard to establish a minimum liability insurance amount as $50,000 combined single limits for bodily injury and property damage for newsrack installation on public property, seconded by Councilmember Prieto, carried 3 -1, Mayor Ferguson dissent- ing, Councilmember Hartley absent. Councilmember Hartley returned to the dais. 10.F. Measured Growth Plan: Criteria for Allocating City Manager Kueny presented the staff report and recommendation concern- ing the next phase of the proposed measured growth plan; attachments were presented of adopted criteria of four other cities. Minutes of the City Council Moorpark, California 6 September 15, 1986 Motion by Councilmember Yancy- Sutton to direct staff to develop criteria for allocating the amount of dwelling units permitted each year based on the samples submitted or as modified by Council, seconded by Councilmember Hartley, carried unanimously. 10.G. General Policy Regarding Conceptual Grading Plans on Tentative Maps Assistant City Engineer Knipe presented the staff report and policy re- commendations concerning conceptual grading plans on tentative tract maps, parcel maps, land divisions, and development permits. Motion by Councilmember Hartley, to adopt the proposed general policy regarding conceptual grading plans on tentative maps, seconded by Councilmember Yancy- Sutton, carried unanimously. 10.H. Agreement for Use of Facilities, Supplies and Services with Moorpark Unified School District Administrative Assistant Genovese presented the staff report concerning leasing of facilities to allow the Recreation Department to expand its available facilities for adult and youth classes and operate the Star Club afterschool care program; reported the Moorpark Unified School District has agreed to allow the City assume a monthly lease from Action Mobile Office Rentals for a classroom trailer; tentative cost to the city is $2,000 /month including staff, the program has twenty students currently enrolled and is self supporting. Motion by Councilmember Yancy- Sutton to approve agreement for use of facilities, supplies and services of Moorpark Unified School District, subject to review and approval by the City Attorney and City Manager, seconded by Councilmember Prieto, carried unanimously. Council recessed at 10:00 p.m. and reconvened at 10:15 p.m. 11. STAFF REPORTS - INFORMATION ITEMS 11.A. Tract No. 4037 /Planned Development Permit No. PD -1044 (Calprop) Environmental Review The staff report was presented by Senior Planner Mike Rubin; reported the EIR for Tract 2964 essentially addressed the same project on the same site as Tract 4037 and areas east of the present site and was utilized for environmental review of Tract 4037; public notice, review and hearing dates were addressed in the report. It was the consensus of the Council to receive and file the report. 11.B. Senior Citizens Expenditures Councilmember Yancy- Sutton recommended senior programs be provided in recreation programing prior to construction of the Senior Center. It was the consensus of the Council to receive and file this report. Minutes of the City Council Moorpark, California 7 September 15, 1986 11.C. Preparation of Final Environmental Impact Review (EIR) for P.D. 1014 /LDM -9 It was the consensus of the Council to receive and file this report. 11.D. Improvements to Griffin Senior Park It was the consensus of the Council to receive and file this report. 11.E. Urban West Communities - Tierra Rejada Road Streetscape It was the consensus of the Council to receive and file this report. 11.F. Status Report - Residential Permits Issued in 1986 Councilmember Yancy- Sutton excused herself from the dais due to possible conflict of interest. City Manager Kueny presented an update to information submitted in a prior report relative to the past residential permit moratorium; reported Urban West Communities has requested two hundred and forty two building permits which combined with anticipated permit requests will surpass the January 1, 1990 Countywide Planning Program population forecast for the City of Moorpark; recommended a ceiling on residential building permits be issued for the remainder of 1986, limiting construction to previously approved housing tracts in order to remain consistent with the population estimate. Tom Zanic, 520 Broadway, Suite 100, Santa Monica, representing Urban West Communities, announced withdrawal of their request for two hundred and forty two permits. Tom Thompson, 16601 Ventura Boulevard, Encino, representing Glenfed Development Corporation, requested staff be directed to administratively handle and /or place RPD 941 on the next City Council agenda; stated zoning clearances must be met in order to obtain necessary building permits and continue with proposed construction. Motion by Councilmember Woolard to impose a five hundred and seventy -six unit ceiling on additional residential building permits to be issued during 1986, limiting distribution to previously approved housing develop- ments pursuant to list presented to Council with addition of twenty seven units for Tract 4095, seconded by Councilmember Prieto, carried 4 -0, Councilmember Yancy- Sutton absent. Councilmember Yancy- Sutton returned to the dais. 12. CONSENT CALENDAR 12.A. Approval of Warrant Register Prepaid Warrants No. 3742 through 3755 in the amount of $ 8,631.27 Payable Warrants No. 3756 through 3795 in the amount of $ 71,391.78 Total Amount of Warrants $ 80,023,05 Minutes of the City Council Moorpark, California 8 September 15, 1986 12.B. City Manager Approved Contracts 1. Moorpark Mirror - Production, Printing and Distribution of Fall 1986 Recreation Service Guide 2. Marchetti & Associates, Inc. - Provide Photometric, Electrical, Structural Engineering Services for Lighting at Peach Hill Park Motion by Councilmember Yancy- Sutton, seconded by Councilmember Woolard, to approve the Consent Calendar, carried unanimously. 13. FUTURE AGENDA ITEMS Councilmember requested a staff report concerning issuance of twelve month extension permits upon payment of additional fees. Staff advised they are currently researching the legality of the proposed permit extension relative to compliance with the Uniform Building Codes; if permissable, communities will be surveyed for additional input and a report will be provided to Council. 14.
