HomeMy WebLinkAboutMIN 1986 1020 CC REGMINUTES OF THE CITY COUNCIL Moorpark, California ITEM 4A October 20, 1986 The regular meeting of the City Council of the City of Moorpark, California was held on October 20, 1986, in the Council Chambers in the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER The meeting was called to order at 7:12 p.m. by Mayor Ferguson. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Hartley._ 3. ROLL CALL PRESENT: Councilmembers James Hartley, Albert Prieto, Danny Woolard, Leta Yancy- Sutton and Mayor Thomas Ferguson Steven Kueny, City Manager; Cheryl J. Kane, City Attorney; R. Dennis Delzeit, City Engineer; Richard Morton, Acting Director of Community Development; Lt. Mike Brown, Sheriff's Dept.; Mike Rubin, Senior Planner; Thomas Genovese, Admin- istrative Assistant; Gerald Forde, Administrative Assistant; and Lucinda Robertson, Recording Secretary 4. APPROVAL OF MINUTES 4.A. Councilmember Hartley requested the spelling of his name be corrected under Item 7.C. Councilmember Yancy- Sutton requested Item 9.I. be corrected to read "Second and Third Street ". Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to approve the Minutes of October 6, 1986 as corrected, carried unanimously. 5. PROCLAMATIONS /COMMENDATIONS AND SPECIAL PRESENTATIONS 5.A. Mayor Ferguson introduced Gerald Forde, new Administrative Assistant for the City of Moorpark. 5.B. A Proclamation was presented to Richard Morton in appreciation of his service as Acting Director of Community Development. 6. COMMENTS FROM THE PUBLIC 6.A. Mitch Kahn, 500 Esplanade, Oxnard, Attorney representing Don Scanlin, requested Item 7C be continued for approximately four weeks. So ordered by Mayor Ferguson; item to he scheduled November 17, 1986. 6.B. Tom Speirs, 2800 Camino Dos Rios, Newbury Park, representing Warmington Homes, requested Council approval of issuance of the balance of building permits for Tracts 3525 and 3019 (totaling 89) in order to proceed with the projects. Minutes of the City Council Moorpark, California 2 October 20, 1986 Councilmember Hartley stated the intent at the meeting of October 6, 1986 was to lift ceiling imposed on residential building permits and grant permits if qualified for. Council concurred;-Minutes of October 6, 1986 should be corrected to reflect this intent. Councilmember Yancy- Sutton stated she will abstain from action concerning this issue. Mayor Ferguson directed staff amend the Minutes of October 6, 1986 to reflect the intent of Council to. lift the ceiling imposed on residential building permits. Motion by Councilmember Woolard, seconded by Councilmember Hartley, to direct staff to issue permits for Tracts 3525 and 3019, carried 4 -0, Councilmember Yancy - Sutton abstained. 6.C. Joe Intiso, Moorpark, expressed his appreciation of Council's non - restriction of format under the Public Comment portion of the City Council meeting; stated he felt the public should be able to comment upon any subject matter. 6.D. Marcos Vargas, 526 N. 12th Street, Santa Paula, Director of Planning for the United Way of Ventura County, reported an assessment study and inventory of human service providers in Ventura County has been completed; requested financial or in kind support to publish one hundred informational booklets which list the services offered to the community. 6.E. Victor Richard, 15750 -168 Los Angeles Ave, Moorpark, Villa Del Arroyo Estates, requested the 40 mph speed limit be enforced adjacent the Estates; stated many cars are exceeding the speed limit especially between the hours of 8:00 a.m. and 4:00' p.m. Lt. Brown stated citation figures are available for that area and he may be contacted for the information; Mayor Ferguson requested patrolling of the area. 6.F. Teresa A. Cortes, 1095 Walnut Canyon Road, Moorpark, representing United Way of Ventura County, requested funding to print one hundred copies of a one hundred and seven page Ventura County human services in- formational booklet; reported other Ventura County cities have contributed, the information is important and should be available to the community. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Woolard, to direct staff to print one hundred copies of a one hundred and seven page Ventura County human services informational booklet, carried unanimously. 6.G. Vicky Howard, 5507 Indian Hills Drive, Simi Valley, Simi Valley Councilmember representing Ventura /San Fernando Valley Freeway Improvement Committee, commended Moorpark City Council for the hiring of Pat Richards, new Director of Community Development; stated the attendance of Council- member Yancy- Sutton at a past meeting of the Committee to widen Highway 118 was by invitation of the Committee and she was not attending in the capacity of a Councilmember; reported Cal Trans is interested in doing a model project of the area and is cooperative in working with the cities and Counties involved to accomplish the completion of the Highway 118 and Rou`? 23 connection and the widening of the Highway 118. Councilmember Hartley congratulated Councilmember Howard for Simi Valley's establishment of local Amtrak service. Mi outes of the City Council M1Ioorpark, California _ _ _____ 3 October 20, 1986 7. HEARINGS 7.A. Home Oc October tion - Revision to Zoninq Ordinance (Continued from HEARING having been advertised as required by law was opened regarding a Home Occupation Ordinance and revision to zoning Ordinance. Senior Planner Mike Rubin presented the staff report and stated the intent of the Ordinance is to provide definitions, criteria and eligibility for home occupations; reported staff has further work to do on the proposed Ordinance and recommended the Public Hearing be conducted, approval of the Negative Declaration and first reading of the Ordinance be continued to the next regular meeting. Councilmember Yancy- Sutton requested No. 10 under the Permit Criteria of the proposed Ordinance be amended to read "for home occupation purposes or businesses." Councilmember Hartley suggested Section 3 state "all residential dwellings within the City of Moorpark shall prescribe to this Ordinance" instead of listing specific zones. Dan Schmidt, 420 E. Los Angeles Avenue, Moorpark, stated the high cost of living has forced many people to operate a business,from their home; stated the proposed Ordinance is too restrictive and requested Council support home based businesses and issues. Councilmember Hartley suggested specific examples of home based businesses be provided to staff to assist in the contents of the home occupation Ordinance. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to approve the Negative Declaration as being in compliance with the CEQA guidelines, carried unanimously. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to continue the Public Hearing on an open hearing basis, staff to revise the proposed home occupation Ordinance and bring back at the next regular Council meeting, November 3, 1986, carried unanimously. 7.B. Temporary Fruit Stands - Revision to Zoning Ordinance (Continued from October 6. 1986 HEARING having been advertised as required by law was opened regarding Ordinance for temporary fruit /produce stands and revision to zoning Ordinance. Senior Planner Mike Rubin presented the staff report; reported one existing produce stand in the City will be grandfathered in and not be subject to the provisions of the proposed Ordinance; the draft Ordinance will be provided for first reading at the next Council meeting. Councilmember Prieto stated the exclusion of the existing produce stand from the proposed Ordinance needs to be clearly identified and addressed in the proposed Ordinance. Minutes of the City Council Moorpark, California 4 October 20, 1986 Councilmember Woolard suggested an additional Planning Commission re- commendation and condition be added to address the existing produce stand specifically. Councilmember Yancy- Sutton recommended the following specific wording "that the existing produce stand on Los Angeles Avenue, Assessor's Parcel No. 506- 0 -02 -33 be exempt from-the conditions of the proposed Ordin- ance except for items 1 and 2 while at the same location and under the same ownership." Charmane Deas, 13092 Williams Ranch Road, Moorpark, owner of the existing produce stand, was present for questions. - Councilmember Yancy - Sutton suggested the existing produce stand be required to submit a letter /registration document designating and identifying their operating periods. Councilmember Hartley recommended the record specifically state the intent of the Council for exemption of the existing produce stand at it's current location from the proposed Ordinance. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to continue the Public Hearing on an open hearing basis, approve the Negative Declaration as being in compliance with the CEQA guidelines; staff to provide draft Ordinance with recommended provisions for first reading at the next Council meeting, carried unanimously. Council recessed at 8:30 p.m. and reconvened at 8:52 p.m. 1.C. Appeal -10 /Development Plan Permit No. DP- 311/314 (Scanlin) Hearing continued to November 17, 1986 as requested by the Applicant's representative during Public Comment. 7.D. Tract 3049 /RPD 1057 /Residential Planned Development - 93 -Lot Single Family Subdivision Located West of the Terminus of Loyola Street, South of Happy Camp Regional Park, North of CalTrans Right -of -Way (U.S. Condominium HEARING having been advertised as required by law was opened concerning Vesting Tentative Tract 3049, RPD 1057, 93 -Lot Single - Family Subdivision. Councilmember Yancy- Sutton excused herself from the dais due to possible conflict of interest. Carol Waldrop, Consultant to the City of Moorpark, presented the staff report and project as redesigned to address the concerns of adjacent property owners; commended the project applicant and adjacent property owners and representative John Roberts for working together to mitigate and solve the concerns. City Engineer Delzeit reported Condition No. 30 will be deleted and replaced with a new Condition relative to drainage; Condition No. 44 is amended to delete "unit cluster at the southerly portion of the site ". Sill Mitchell, 6440 N. Berkeley Circle, Moorpark, representing Highway 118 Improvement Association, spoke in opposition of the proposed project due to increased traffic impacts on Highway 113; recommended an alternate route to Highway 118 he provided. Minutes of the City Council Moorpark, California _ 5_____ October 20, 1986 John Roberts, 14419 E. Loyola, Moorpark, submitted a petition in support and recommended approval of the proposed project as redesigned. Rob Dick, 156 1/2 N. Arnaz Dr.=, Los Angeles, representing U.S. Condominium Corporation, spoke in support of the project as redesigned and the re- commendations of the adjacent homeowners for installation of stop signs; requested a thirty -six month RPD approval period be granted in lieu of twelve months as referred to in Community Development Department Condition No. 10. David Z. Grive, 14418 E. Loyola Street, Moorpark, spoke in support of new plan and redesign of project. Councilmember Prieto advised staff City Engineering Condition No. 42 should be deleted as it is the same as Condition No. 16. Councilmember Woolard requested the wording of City Engineering Condition No. 32 be changed to reflect the same conditions as was done on the Griffin project regarding Area of Contribution payment. Motion by Councilmember Woolard, seconded by Councilmember Hartley, to approve the Negative Declaration as being in compliance with the CEQA guidelines, carried 4 -0, Councilmember Yancy- Sutton absent from the dais. Motion by Councilmember Woolard, seconded by Councilmember Hartley, to direct staff to prepare a Resolution of Approval for Tract 3049 and RPD 1057 according to findings noted in the staff report and subject to recommended conditions as modified by Council, carried 3 -1, Councilmember Prieto dissenting, Councilmember Yancy- Sutton absent from the dais. Councilmember Prieto requested the record show the reason for his dissention is due to objection of issuance of excess building permits. Councilmember Yancy- Sutton returned to the dais at 10:06 p.m. Council recessed at 10:07 p.m. and reconvened at 10:25 p.m. 8. ORDINANCES /RESOLUTIONS 8.A. Ordinance No. 81, Providing for the Regulation and Use of Public Parks and Recreation Facilities ORDINANCE NO. 81, AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, PROVIDING FOR THE REGULATION AND USE OF PUBLIC PARKS AND RECREATION FACILITIES WITHIN THE CITY OF MOORPARK Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, that Ordinance No. 81 be read in title only, further reading be waived, carried unanimously. Motion by Councilmember Yancy - Sutton, seconded by Councilmember Hartley, that Ordinance No. 81 be adopted, carried unanimously. Minutes of the City Council - Moorpark, California 6 October 20, 1986 8.B. Ordinance No. 82, Adopting the Revisions to Zoning Ordinance_ Regarding Signs ORDINANCE NO. 82, AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA AMENDING THE ZONING ORDINANCE OF THE COUNTY OF VENTURA, AS ADOPTED BY THE CITY OF MOORPARK ON SEPTEMBER 21, 1983, BY REPEALING SECTIONS OF SAID ORDINANCE PERTAINING TO THE SIGN CODE; AND ADDING CHAPTER 50 TO TITLE 9 OF SAID CODE, PERTAINING TO SIGNS - STANDARDS AND PERMITS City Attorney Kane stated a severability clause will be added to Ordinance No. 82, wording to be same as Section 2 of Ordinance No. 81. Motion by Councilmember Woolard, seconded by Councilmember Hartley, that Ordinance No. 82 be read in title only, further reading be waived, carried unanimously. Motion by Councilmember Hartley, seconded by Councilmember Prieto, that Ordinance No. 82 be introduced, carried unanimously. 8.C. Res. No. 86 -346, Authorizing Transportation Development Act Claim for Street Purposes RESOLUTION NO. 86 -346, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DIRECTING THE PROCESSING OF A CLAIM FOR FISCAL YEAR 1986/87 TRANSPORTATION DEVELOPMENT ACT AND STATE TRANSPORTATION ASSISTANCE FUNDS City Manager Kueny presented the staff report. Motion by Councilmember Hartley, seconded by Councilmember Woolard to adopt Resolution No. 86 -346, authorizing the filing of claims for the Local Transpor- tation Fund (LTF) and State Transit Assistance Funds (STAF) for street and road purposes and transit purposes, respectively, carried unanimously. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Prieto, that the City of Moorpark not provide a voluntary percentage contribution of funds for regional transportation planning purposes, carried unanimously. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, that Local Transportation Funds (LTF) and State Transit Assistance Funds (STAF) be claimed for street and road and transit purposes, respectively, carried unanimously. 8.D. Res. No. 86 -347, Approving Planned Development Permit Nos. DP 388 - 347 and DP 349 - 353 Annotti RESOLUTION NO. 86 -347, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, APPROVING DEVELOPMENT PLAN PERMIT NOS. DP 338 - 347 AND DP 349 - 353 ON THE APPLICATION OF MARK ANNOTTI (ASSESSOR PARCEL_ NO. 511- 07 -42) Senior Planner Rubin presented the staff report. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to adopted Resolution No. 86 -347 approving the Development Permit Nos. DP 338 - 347 and DP 349 - 353 (Annotti), carried 4 -1, Councilmember Prieto dissenting. Minutes of the City Council Moorpark, California 7 _ _ October 20, 1986 Mayor Ferguson directed the following staff report, Item 11.J. be taken at this time due to the presence of Applicant's representative. 11. STAFF REPORTS - INFORMATION 11.J. Minor Modification - Tract 3070 -4 /RPD -857 (U.S. Condominiums Senior Planner Rubin reported on.October 8, 1986 the Planning Commission concurred with the requested Minor Modification; recommended if the Council concurs with the Planning Commission recommendation no formal action by the Council is necessary. Councilmember Yancy- Sutton and Prieto stated they would abstain from action relating to the request. It was the consensus of the Council to uphold the decision of the Planning Commission receive and file this report. 9. COMMENTS FROM COUNCILMEMBERS 9.A. Councilmember Woolard presented information concerning the Highway 118 Summit meeting; reported there will be another meeting in approximately thirty days, date to be confirmed. 9.B. Councilmember Hartley reported he had difficulty making a left turn off Highway 118 on to Goldman and right turn off Highway 118 on to Maureen; concerned re safety and suggested Highway 118 access be studied. 9.C. Councilmember Hartley reported he attended a School Board meeting, October 14, 1986; discussion center on predicted impacts on schools resulting from the passage of Measures F, G, and H and passage of combinations of the three Measures. 9.D. Mayor Ferguson commended the Fire Department for their swift and efficient action in dealing with a recent auto /truck accident on Highway 118, in which there were no fatalities. 10. STAFF REPORTS - ACTION ITEMS 10.A. City Hall Building Administrative Assistant Genovese presented the staff report; project con- cept and architectural drawings were presented by Pam Sharkey, representing Dial Services, project architect. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to approve the City Hall Building design and elevations, and City Hall site plan and location, and authorize processing of the Development Plan C or City Hall, carried unanimously. 'O.B. Notice of Completion _ Annual Pavement Overlay Project -ity Engineer Delzeit presented the staff report and recommendation. Minutes of the City Council Moorpark, California 8 October 20, 1986 Motion by Councilmember Hartley, seconded by Councilmember Yancy- Sutton, to accept the work as complete; authorize the City Manager to file the Notice of Completion and authorize final payment to the contractor (Camino Contract- ing) for the ten percent retention, pending clearance of the thirty -five day lien period, carried unanimously. 10.C. Notice of Completion - Moorpark Avenue Pedestrian Safety Project City Engineer Delzeit presented the staff report. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to accept the work as complete; authorize the City Manager to file the Notice of Completion and authorize final payment to the Contractor (Sully - Miller Contracting Company) for the ten percent retention, pending clear- ance of the lien period, carried unanimously. 10.D. Community Center Signage Administrative Assistant Genovese presented the staff report; City Manager Kueny requested the matter be referred back to the Parks and Recreation Commission for a total signage recommendation for the Community Center with inclusion of all facilities, i.e. City Hall, Library, Senior Center, Community Center with inclusion of addresses. So ordered by Mayor Ferguson. Mayor Ferguson requested the lettering be legible from the road. Council- member Hartley suggested separate signage for other activities and re- commended an uncluttered and clear design. 10.E. Peach Hill Park City Manager Kueny presented the staff report and Parks and Recreation Commission recommendation to list construction of Peach Hill Park as a number one priority item; reported the project should be ready for bid by the middle of November. Council concurred with the recommendation of the Parks and Recreation Commission to place construction of Peach Hill Park as top priority. 10.F. Downtown Study - Award of Contract City Manager Kueny requested this item be continued to November 17, 1986 in view of the appointment of a new Director of Community Development to allow him time to review the proposals for the project. Councilmember Hartley recommended a Council committee assist in review of the proposals. After Council discussion, the Mayor directed the Public Works Committee assist in this review. 10.G. Report on Time Periods for Implementation of Building Permits Senior Planner Rubin presented the staff report and recommended Council accept the time periods currently in use and take no action for revision. There was discussion by the Council concerning the time period, extension of permits and related fees. It was the consensus of the Council to receive and file the report. Minutes of the City Council Moorpark, California 9 _ _ _ _ _ _ _ October 20, 1986 Councilmember Hartley requested due to the lateness of the hour, the remaining items not needing Council attention or action be continued to October 27, 1986 at 7:00 p.m. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Woolard, to continue the remainder of the agenda items, with no additions, with the exception of items IOL, IOM, 10Q and 12, which will be heard tonight as requested by the City Manager, to October 27, 1986, 7:00 p.m., carried unanimously. 10.H. Modification to City Clerk Description City Manager Kueny presented the staff report and recommendation. Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, to modify the position description for City Clerk by deleting the words "90 words per minute and to accurately transcribe it" and inserting the following: "A rate of speed to allow timely and accurate preparation of official minutes of City meetings and to meet the other needs of the position; the ability to take shorthand is a desirable qualification ", carried unanimously. 10.M. Request by the City Attorney for Fee Adjustment City Manager Kueny presented the staff report and recommendation to refer the matter to the Budget Committee in order to prepare a draft contract and return to Council. Motion by Councilmember Hartley, seconded by Councilmember Prieto, to refer the matter to the Budget Committee, carried unanimously. 10.N. Continued to October 27, 1986 10.0. Revision to Planning Services Contract (Sage Institute /Carol Waldrop_ — -- City Manager Kueny presented the staff report and recommendation. Motion by Councilmember Hartley, seconded by Councilmember Yancy- Sutton, to approve the contract for consultant services with Carol Waldrop, carried unanimously.
