CALL TO ORDER The meeting was called to order at 7:09 p.m. by Mayor Ferguson. 2. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilmember Prieto. 3. ROLL CALL PRESENT: Councilmembers James Hartley, Albert Prieto, Danny Woolard, Leta Yancy- Sutton and Mayor Thomas Ferguson Steven Kueny, City Manager; Cheryl J. Kane, City Attorney; Pat Richards, Director of Community Development; R. Dennis Delzeit, City Engineer; Lt. Mike Brown, Sheriff's Dept.; Mike Rubin, Senior Planner; Gerald Forde, Administrative Assistant; and Lucinda Robertson, Recording Secretary 4. COMMENTS FROM THE PUBLIC 4.A. Thomas Baldwin, 6475 Pepperdine, Moorpark, stated, after speaking with Fair Political Practices Commission enforcement division attorney, Janis McLean, regarding possible conflict of interest concerning Jim Keenan, he understands the conflict of interest laws and no longer believes Mr. Keenan's vote on U.S. Condominium projects to be of conflict of interest; withdraws questions re propriety of the votes. 4.B. Jim Keenan, 14961 Campus Park Drive. Moorpark, stated he was delighted to hear the answer from the Fair Political Practices Commission and to put the issue to rest. 5. PROCLAMATIONSJCOMMENDATIONS AND SPECIAL PRESENTATIONS Mayor Ferguson introduced the City's new Director of Community Development. Pat Richards. 10. STAFF REPORTS - ACTION ITEMS (Continued from October 20, 1986) 10.H. Community Center Tot Lot Proposal Administrative Assistant Forde presented the staff report. Motion by Councilri =ember Yancy- Sutton, seconded by Councilmember Hartley, to approve the Services Agreement with R.W. Graham R Associat(,s for the development of the Community Center park Tot Lot; approval of nine hundred and fifty dollars from thr� Park Improvement Fund (05) to Account 05- 149 -606; Park and Recrea tion Commission to review Council concerns regarding location and safety for final recommendation back to Council, carried unanimously. Minutes of the City Council Moorpark, California 2 October 27, 1986 10.I. Monte Vista Nature Park Administrative Assistant Forde presented the staff report and recommendation. Motion by Councilmember Hartley, seconded by Councilmember Woolard, to approve the Services Agreement with R.W. Graham & Associates for the development of the first phase of Monte Vista Nature Park, carried unanimously. 10.J. Proposed Criteria for Annual Allocation Pro4ram Pursuant to Measure "H" City Manager Kueny presented the staff report and introduction of Article 18 which was prepared by staff under the direction of Council to be available for public information prior the November 4, 1986 election. Director of Community- Development Richards addressed five points for Council consideration - 1) policy for allocation hearings; 2) eligibility of projects approved prior to Measure "H" enactment for consideration of bonus points; 3) use of a minimum scoring requirement; 4) allocation exemptions; and 5) allocation of bonus points for Senior Citizen and affordable projects; report- ed staff will establish points on a tentative basis for review by the Planning Commission and final ranking by the City Council - filing periods would be established by the Council. Council concurred separate hearings were in order for the program. Councilmember Woolard suggested exemption recommendation No. 4 be set at "4" units; Councilmember Hartley suggested exemption recommendation No. 5 be deleted as is repetitious to recommendation No. 3. Tom Zanic, 520 Broadway, Suite 100, Santa Monica, representing Urban West, requested contents be closely examined and flexible; stated points for in -fill projects are not applicable for the City of Moorpark; suggested Council allow for future modification to allocation system to provide flexibility. Motion by Councilmember Woolard, seconded by Councilmember Yancy- Sutton to approve in concept only the criteria for the annual allocation program pursuant to Measure "H" with changes as recommended by Council, carried unanimously. Council recessed at 8:41 p.m. and reconvened at 9:03 p.m. 10.K. Grading of the Southerly Slopes of Lots 9 - 12 Within Tract 3019 Warmington City Engineer Delzeit reported Warmington has requested their original request for modification to the grading plan be withdrawn as the problem has been resolved; stated no action is required on this matter. It was the consensus of the Council to receive and file the report. Minutes of the City Council Moorpark, California 3 October 27, 1986 10.N. Moorpark Road Restoration - Disputed Work City Engineer Delzeit reported A -C Construction Company has not provided the sheer analysis report as required by staff for review prior to acceptance of project and payment for work as established in the staff report; stated Council action is not required at this time and a future report will be provided. It was the consensus of the Council to receive and file the report. 10.0. PD -1010 - Moorpark Avenue -Storm Drain Reimbursement City Engineer Delzeit presented the staff report and recommended action regarding the construction of drainage facilities in the Moorpark Avenue area; estimated cost to be submitted for Council review and reimbursement to be granted after project acceptance by the-City so that actual costs may be used. Motion by Councilmember Woolard, seconded by Councilmember Prieto that after construction of the storm drain and acceptance by the City, exact reimbursement amounts to based upon actual construction costs as recommended by the City Engineer and approved by Council; reimbursement to come from the Los Angeles Avenue Area of Contribution, carried 4 -0, Councilmember Yancy- Sutton abstained. 10.P. Truck Parking in Vacant Lot, Southwest Corner of Moorpark Avenue and Poindexter Avenue City Engineer Delzeit presented the staff report and recommended action for prevention of trucks parking in the vacant lot on the southwest corner of Moorpark Avenue and Poindexter Avenue. Motion by Councilmember Yancy- Sutton to authorize staff to implement placement of a six inch diameter pole at the lot entrance; staff to monitor deterance results and report back in one month, carried unanimously. Introduction of Ordinance No. 83 Pertaining to Temporary Produce Stands and Ordinance No. 84 Pertaining to Home Occupations ORDINANCE NO. 83, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING CHAPTER 1, ZONING, OF DIVISION 8 OF THE VENTURA COUNTY ORDINANCE CODE, ADOPTED BY THE CITY COUNCIL ON SEPTEMBER 21, 1983, PERTAIN- ING TO TEMPORARY PRODUCE STANDS ORDINANCE NO. 84, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, ADDING CHAPTER 12 TO TITLE 9 OF THE MOORPARK MUNICIPAL CODE; AND MAKING CERTAIN AMENDMENTS AND DELETIONS TO THE VENTURA COUNTY ZONING ORDINANCE, AS ADOPTED BY THE MOORPARK CITY COUNCIL ON SEPTEMBER 21, 1983, PERTAINING TO HOME OCCUPATIONS City Manager Kueny presented the staff report and recommended adoption of first reading of Ordinance No. 83 and 84 pertaining to Temporary Fruit Stands and Home Occupations, respectively. Minutes of the City Council Moorpark ,_Cal_i fornia_ _ _ - _- - 4 - _October- 27, _1.986 City Attorney Kane reported both Ordinance Nos. 83 and 84 will be amended to include the standard severability clause as follows "Constitutionality. If any part of this Ordinance is held invalid or unconstitutional for any reason, such shall not affect the validity or constitutionality of the remaining portion of -this Ordinance. The Moorpark City Council declares that each part of this Ordinance would have been adopted irrespective of the fact that a part thereof may be declared invalid or unconstitutional." Motion by Councilmember Yancy- Sutton, seconded by Councilmember Hartley, that Oi,dinance No. 83 be read in title only, further reading be waived, carried unanimously. Motion by Councilmember Prieto, seconded by Councilmember Hartley, that Ordinance No. 83 pertaining to temporary produce stands be introduced, carried unanimously. Councilmember Woolard stated criteria for home occupations should allow for non - resident employees. City Manager Kueny suggested Permit Criteria No. 4 be amended to allow no more than one non - resident employee at any one time, limit one commercially identifiable vehicle for the home occupation, neighbors to be notified. Motion by Councilmember Woolard, seconded by Councilmember Hartley, to amend Permit Criteria No. 4 to allow one none - resident employee, carried 3 -2, Councilmember Yancy- Sutton and Mayor Ferguson dissenting. Motion by Councilmember Prieto, seconded by Councilmember Woolard to add new section allowing no more than one identifiable commercial vehicle of five - thousand pounds gross vehicle weight or less in connection with the home occupation, carried unanimously. Motion by Councilmember Prieto, seconded by Councilmember Woolard, that Ordinance No. 84 be read in title only, further reading be waived, carried unanimously. Motion by Councilmember Prieto, seconded by Councilmember Hartley, that Ordinance No. 84 pertaining to home occupations be introduced as amended, carried unanimously. Council recessed at 10:18 p.m. and reconvened at 10:27 p.m. 11. STAFF REPORTS - INFORMATION ITEMS 11.A. Relinquishment of Highway 118 It was the consensus of the Council to receive and file this report. I.I.B. Tract 4037 - Grading It was the consensus of the Council to receive and file this report. 11.C. Kavlico Grading (DP -318) Status It was the consensus of the Council to receive and file this report. Attorney Kane presented the report in answer to questions received by Thomas Baldwin regarding possible Conflict of Interest concerning Jim Keenan (U.S. Condominium) Motion by Councilmember Yancy- Sutton, seconded by Councilmember Woolard, to receive and file this report, carried unanimously. I.I.E. Travel Authorization - Re: April 1985 Tri It was the consensus of the Council to receive and file this report. 11.F. "Children at Play" Signs It was the consensus of the Council to receive and file this report. I.I.G. Effective Date for Measures "F" and "H" It was the consensus of the Council to receive and file this report. 11.H. City Selection Committee It was the consensus of the Council to receive and file this report. 11.I. City Attorney Response - Re: Elections Code, Section 4055 Ouestion It was the consensus of the Council to receive and file this report. 11.J. This report was heard previously at the City Council meeting on October 20, 1986 12.
