HomeMy WebLinkAboutMIN 1987 1105 CC ADJMINUTES OF THE CITY COUNCIL Moorpark, California ._ November 5, 1987 The adjourned meeting of the City Council of the City of Moorpark, California was held on November 5, 1987, in the Council Chambers of City Hall located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: The meeting was called to order at 8:1? p.m. by Mayor Clint Harper. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember John Patrick Lane. 3. ROLL CALL: Present: Councilmembers Eloise Brown, Thomas Ferguson, John Galloway, John Patrick Lane and Mayor Clint Harper. Steven Kueny, City Manager; Cheryl Kane, City Attorney; Patrick Richards, Director of Community Development; Thomas P. Genovese, Deputy City Manager; John Knipe, Assistant City Engineer, Paul Berlant, Contract Planner from the City Engineer's Office; and Maureen W. Wall, City Clerk. 4. PROCLAMATIONS, COMMENDATIONS,.AND SPECIAL PRESENTATIONS: None were presented. 5. REORDERING OF, AND ADDITIONS T0,__THE AGENDA: Nothing was reordered, and nothing way added to, the agenda. 6. PUBLIC COMMENTS: No one wished to address the Council. 7. COMMITTEE REPORTS: None were given. 8. CONSENT CALENDAR: Nothing was presented on the Consent Calendar. 9. PUBLIC HEARINGS: Minutes of the City Council Moorpark Cal ifornia_ _ 2 November 5,­1987 C. Consider vesting Tract Nos. 43401 _4341 and 4342; _Planned Development Permit Nos. 1070, 1071 and 1072; and Zone Change Nos. 2815, 2816 and 2817, t" t__Villa_ge (Urban West Communities) The applicant is requesting_ approval to subdivide the sublect property into 499 single famil_y lots five recreation lots as follows: Tract No. 43401_166 lots. Tract No. 43_41,-_.154 lots; and Tract No. 4342, 179 lots.__The_projec_t is located adjacent, north and south of Tierra__ Rejada Road_ between Walnut Creek_ Road_ and the north terminus of Tierra Re,iada Road at the _Arroyo _Simi. The Planning Commission recommended Council deny the project without prejudice. Staff r- rommended Council approve the project with conditions. Councilmember Ferguson announced he had listened to the meeting tapes of November 4, 1987 conrerning this item, since he was not in attendance at the meeting. Councilmember Lane announced he had listened to the tapes for the meeting of October 30, 1987, since he was not in attendance at. that meeting. Council then continued their discussions of the project's conditions. They discussed moving homes located on the bluff at the west end of the project hack to preserve the views of those in the Home Acres area, and also discussed the use of wrought iron fencing. MOTION: Councilmember Galloway moved and Councilmember Brown seconded a motion to direct that homes would be moved back 20' from the top of the slope with the fence back 10' to 30' easterly in Tract No. 4340 to accommodate the aesthetic and visual concerns of the bluff area; to direct that rear fencing is to be a mix of wrought iron and block pilasters with front setbacks to be 25'. AMENDMENT TO THE MOTION: Councilmember Lane moved and Councilmember Ferguson seconded a motion to specify that lot size after adjustments in Phase I would be 6,800 square feet. The voice vote was unanimous. The main motion, as amended. way approved by a unanimous voice vote. AT THIS POINT IN THE MEETING, the Council rPrpccad. ThP time was 9:23 p.m. At 9:47 p.m. the full Council reconvened. MOTION: Councilmember Brown moved and Councilmember Lane seconded a motion to direct. that any changes to the street improvement plans would be hrought back to the Planning Commission for review, to direct that rough grading would be sufficient, and to direct that. in Tract No. 4341, Lots 62 -70 would be removed and converted into a buffer as indicated by the developer, and that the builder would be provided with the opportunity to re- locate those lost lots elsewhere in the development and have until ,January 31, 1989, to come back to the Planning Commission for a review of the location of those lost. Minutes of the City Council Moorpark,_CaI i forn i a 3 November___5,__1987 lots; to direct that Home Acres join in an assessment district through a joint powers agreement to maintain and reimburse the developer for the costs of the buffer area, if this is not successful by January 31, 1989, the lots would revert to Urban West Communities, with the buffer being Lots 66 and 67, and 1 and 2, with the developer unahle to build additional units on those lots. AMENDMENT TO THE MOTION: Councilmember Brown moved and Councilmember Lane seconded a motion to direct that seven replacement lots may be allowed to encroach on the 20% slope for those that were taken. The voice vote was unanimous. SECOND AMENDMENT TO THE MOTION: Councilmember Lane moved and Councilmember Galloway seconded a motion to direct that the assessment district would be a 50 -50 split between the City (the three subject. tracts) and the unincorporated (Home Acres) araa. The voice vote was unanimous. The main motion, as twice amended, was approved by a unanimous voice vote. By consensus of Council, once a minimum of 100 units of single family occupancy have been requested, then multi- family units entitlements can be requested; then 250 units, and then completion. The applicant must begin construction of at least 100 multi - family units prior to the issuance of occupancy permits for 250 single family detached units in the West Village area, if entitlements are not qranted. MOTION: Councilmember Brown moved and Councilmember Galloway seconded a motion to go into dosed Session under Government Code Section 54956.9(b)(1) since the need arose after posting of the agenda. The voice vnto was unanimous. The time of adjournment was 10:15 p.m. At 11:50 p.m. the full Council reconvened in Open Session. The City Attorney reported that Condition No. 24 of PD -1070 would be amended to require that no later than the issuance of the combined 50th occupancy permit. within Tract Nos. 4340, 4341 and 4342, the developer, any subsequent owner of a multi - family parcel within PC -3 or a combination of the developer and one or more subsequent owners, as applicant, shall (i) apply for appropriate subdivision and land use development entitlements for a total of at least 200 units of multi - family units within PC -3 in accordance with the Mountain Meadows Community Plan and (ii) commencing with the filing period immediately following the approval or conditional approval of the entitlements and, as needed, continuing with each successive filing period, apply for a residential development allotment. under Measure F equal to the total number of multi - family units authorized by the entitlements. MOTION: Councilmember Galloway moved and Councilmember Brown seconded a motion to direct that the City Attorney draft specific language to amend Condition No. 24 of PD -1070 as outlined in her report from the Council's Closed Session. The voice vote was unanimous. MOTION: Councilmember Galloway moved and Councilmember Lane seconded a motion to direct that the proposed commercial facility application have plan approval before permits Nos. 1 -77 on Tract No. 4342. The voice vote was unanimous. Mr. Tom Zanic, representing Urban West Communities, agreed to an extension of time under the Sijbdivision Map Act, to Monday, November 9, 1987, at midnight. MOTION: Councilmember Brown moved and Councilmember Galloway seconded a motion to direct staff to draft the resolutions with conditions for approval for Tract Nos. 4340, 4341, and 4342; and Planned Development Permits Nnc. 1070, 1071 and 1072. The voice vote was unanimous. D. Appeal of _a Development Plan Permit No. 390 and Conditional Use Permit No. 4507 (Sig Friedman)_ regardinq the construction of a 9,847 square foot industrial building including an automotive repair and incidental retail safes of automotive parts. Located on the northwest corner of Los _ AMeles Avenue and Goldman Avenue. Staff recommended Council take action as deemed appropriate. This matter had been continued to November 23, 1987. E. Presentation concerning the-_Simi Valley_ Landfill Conditional Use Permit by the County _of Ventura. Staff recommended Council provide comments deemed appropriate. This matter was continued. C. Consider the establishment of priorities for_ _Ci ty_ proiects and responsibilities. Staff rerommended Council give staff direction as deemed appropriate. This matter was continued to November 23, 1987. D. Report concerning homeowner complaint on Williams Ranch Road. Staff recommended Council dirPrt staff as deemed appropriate. This matter was continued to November 23, 1987. F. Consideration of a landscaping_plan for the southwest - _corner of Spring Road and Peach Hill Road (Marlborough). Staff recommended Council direct staff as deemed appropriate. This matter was continued. G. Consider the exoneration of the Model Home_ Conversion Bond for Tract_N_o. 2865 -4 Pacifica), Staff recommended Council direct staff as deemed appropriate. This matter was continued. 12. ORDINANCES: A. Ordinance No. 91. An ordinance amending_ Measure F,_ an ordinance establishing a Residential Development Management System of the City of Moorpark relative to the annual residential development allotment for calendar year ___ Staff recommended Council approve the ordinance for second reading and adoption. This item was continued. B. Ordinance No. A,_,prooposed ordinance amendi nq Chapter 2.06 of Title 1 of the Moorpark Munic_ipal__C_ode relating to the resignation of commissioners.
