Moorpark, California December 9, 1987
The Special Meeting of the City Council of the City of Moorpark,
California was held on December 9, 1987, in the Council Chambers of
City Hall, located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
The meeting was called to order at 7:11 P.M. by Mayor Galloway.
2. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Councilmember Brown.
3. ROLL CALL:
Present: Councilmembers Eloise Brown, Clint Harper, John Lane
and Mayor John Galloway.
Steven Kueny, City Manager; Scott Field, Assistant
City Attorney; Patrick Richards, Director of Community
Development; Thomas P. Genovese, Deputy City Manager;
John Knipe, Assistant City Engineer; Lt. Mike Brown,
Sheriff's Department; Paul Berlant, Planning
Consultant from Willdan Associates; and Maureen W.
Wall, City Clerk.
4. PROCLAMATIONS. COMMENDATIONS, SPECIAL PRESENTATIONS:
None were presented for approval.
5. REORDERING OF AND ADDITIONS TO THE AGENDA:
A. Steven Kueny, City Manager, asked the Council members to

Valley landfill by 5 p.m. on Thursday, December 10, 1987,
so that a letter might be drafted expressing Council's
concerns and delivered to the County on Friday, December
11, 1987.
6. PUBLIC COMMENTS:
A. Connie Lawrason, 4291 Ambermeadow Street, commented that
the street sign at the intersection of Gabbert Road /Tierra
Rejada Road and Los Angeles Avenue was incorrect and also
asked the Council to eliminate the used car fot located at
the corner of Spring Road and Peach Hill Road.

7. COMMITTEE REPORTS:
December 9, 1987
Councilmember Brown reported she had attended a meeting of
cities within the County who asked for Moorpark's support in
favoring the reopening of the Bailard Landfill.
9. PUBLIC HEARINGS:
A. Vestinq Tentative Tract No. 4338 Residential Planned
Developed Permit No. 1069 and Zone Change No. 2814 (Urban
West Communities) requesting approval of vesting Tentative
Tracts 4338, 8.49 Acres, 55 single family lots; RPO 1069
and Zone Change No. 2814 PC (Planned Community) to RPD 6.50
(Residential Planned Development, 6.5 units per acre)._
Patrick Richards, Director of Community Development, gave
an overview of the project. The Staff Report dated
September 1, 1987, was reviewed by Paul Berlant. After
Staff's presentation, the Public Hearing was opened.
Mr. Tom Zanic, 520 South Broadway, Suite 100, of Urban West
Communities gave a presentation of their proposed project.
He focussed on two main areas of concern - what the land
use on the parcel might be and additionally, where the
location of the storm drain would be. He commented the
subject parcel is the last vacant area in the North Village
which is to be built. It is a very small site and adjacent
to single family homes. Homeowners in the area are
interested in continuing the same housing usage. Urban
West Communities is asking for 55 single - family homes
there. Concerning the site of the storm drain, his firm
would like to move the drain to allow the City clear and
free access to the drain and also would like it located in
an area which does not greatly impact the project
financially. During initial discussions of the project, a
walk- through to the school site had been suggested.
However, he pointed out that in conversations with the
school district, the school district was not interested
since the campus was to be a closed campus. Additionally,
the walkway would have to be staffed by paid personnel
during school hours. He then reviewed a letter dated
December 3, 1987 which had been directed to the City, which
outlined his firm's concerns and also their recommendations
regarding the Planning Commission's recommended conditions
for the entitlement request. This letter contained sixteen
comments by Urban West Communities. Mr. Zanic additionally
presented the Council, during the Public Hearing, with a
written seventeenth comment, which related to the existing
CC &R's for Tract No. 4001 being reviewed and approved by
the City Attorney prior to recordation of the subject
Vesting Tentative Tract. Following Mr. Zanic's
presentation, Council directed questions to him concerning
his proposed project.

Gregory Barker, 12453 Hillside Drive, President of the
Buttercreek II Homeowners Association. Mr. Barker
commented their association wants to see single family
homes in this development.
Mr. Jim Brady, 12419 Sunnyglen Drive, President of the
Creekside II Homeowners' Association. He indicated that
their association is in support of single family homes for
the development. Additionally, he commented that the
Creekside II Homeowners Association is willing to annex
this new development into their association.
Ms. Janet Gauger, 12466 Sunnyglen Drive. She is a
Creekside II homeowner who favors single - family units on
the subject site. She does not want to see townhouses go
into this small area.
Mr. Wallace Beckman, 12352 Sunnyglen Drive. He is Vice
President of Creekside II Homeowners' Association and again
stated that the association has agreed to annex these homes
into their association.
Kelly McKinney, 12469 Mountain Trail. She favored single -
family homes in the area. She pointed out that if the
Creekside II Homeowners' Association cannot annex this
project into their association, their dues and fees for
upkeep of that area will skyrocket.
Ms. Jackie Dupus, 12475 Sunnyglen Drive, Treasurer of
Creekside II Homeowners' Association. She favored single -
family homes on the site, and additionally commented that
the dues brought in by these new members would help
stabilize their homeowners association's financial
condition.
Richard Zeman, 12450 Sunnyglen Drive, addressed traffic
concerns. He felt that 55 single - family homes would have
less trattic impact on the area than the traffic caused by
90 townhouses.
Ms. Linda Brady, 12419 Sunnyglen Drive. She spoke in favor
of single family homes and asked the City Council to listen
to the wishes of the homeowners, and to allow single - family
homes on this project site.
Gary Jeffrey, 12467 Hillside Drive, spoke in favor of
single- family homes, but was cpposed to the easement which
was suggested by the applicant, which would run near his
home. He felt it would be better for the children to walk
in front of homes in the development rather than through an
unsupervised walkway to the school.

Mayor Galloway read a letter from Mrs. Irene Garrison of 4381
Cloverdale N.E., Moorpark. In her letter, Mrs. Garrison asked
the Council to approve townhouses for this site. She cited as
her reason that there was a great need for homes of this type in
Moorpark for those who were unable to do yard work.
AT THIS POINT IN THE MEETING, the Council recessed, the time being
8:57 p.m. At 9:20 p.m., the Council reconvened, with all City
Councilmembers present.
Mayor Galloway also presented a letter signed by 83 residents of
the Creekside Homeowners Association. The letter was dated
November 19, 1987 and expressed support of 55 single- family
units to be placed on the subject site.
Councilmember Harper commented he was hoping to see some single
story style homes mixed within this project. He further stated
he would like to see an acceleration of development of
multi - family units in the South Village, so that the same
situation of in- filling within an area surrounded by single
family homes with multi - family units would not occur again.
Councilmember Brown commented that the reason for a planned
community was to provide a mix. She further commented that it
appeared the mix will only come in at a later time.
Councilmember Lane commented he had surveyed surrounding
Mountain Meadow residents and found that they would like to see
single - family homes on this site. He stated the Council needed
to listen to those concerns brought forth by the Creekside II
Homeowners' Association and would also like to see an
acceleration of townhouses in the South Village. He
additionally felt that the density of the project could be
reduced and this would take care of the very small 20' frontage
which he felt was not desirable in this area.
Mayor Galloway expressed some concerns regarding impacts on the

project site is reduced. Additionally, he was concerned about a
walkway through to the school site, and expressed his
displeasure that a mix of townhomes and single - family homes was
not going to occur.
After much discussion, the City Council directed Staff to take
the following action:
1. The City Attorney is to review the CC &R's for both the
Creekside II Homeowners Association and this new project,
to be sure that both are consistent and that all areas of
concern are covered. This will be accomplished prior to
final approval of the project.

2. Staff was directed to work on the modified conditions
consistent with the City Council's directions and concerns
and additionally to work with the applicant to develop a
new map modified accordingly. Council also expressed a
desire that the frontage along the lots would be a minimum
of 40', relocate the storm drain from the back yards of
lots, and that care would be taken to eliminate flag lots
in the redesign of the project.
AT THIS POINT IN THE MEETING, the Council recessed, the time being
11:00 p.m. At 11:17 p.m., the Council reconvened, with all
Councilmembers present.
After additional discussion, Urban West Communities stated that
they would extend the processing deadline to January 15, 1988 in
order that Staff and Council would have sufficient time to
review their redesign of the project. The following Motion was
then heard.
MOTION: Councilmember Harper moved and Councilmember Brown
seconded a Motion to re -open the Public Hearing and continue the
Public Hearing to January 6, 1988. The voice vote was unanimous.
10. COMMENTS FROM COUNCILMEMBERS:
Councilmember Harper commented that there are a few pieces of
play equipment in the North Meadows Park that appear to be
unsafe. Staff was directed to contact the developer and the
sub - contractor of this park to be sure that deficiencies in the
play equipment were taken care of. Additionally, the Council
directed that the new Parks and Recreation Commission would look
into the appropriateness of playground equipment which might be
placed in parks within the City in the future.

None were presented.
13. FUTURE AGENDA ITEMS:
Council directed that the Parks and Recreation Commission
members would be installed at the January 6, 1988 City Council
meeting.

15. ADJOURNMENT:
Councilmember Harper moved and Councilmember Brown seconded a
Motion to adjourn the meeting. The voice vote was unanimous.
