HomeMy WebLinkAboutMIN 1987 0723 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California _ July 23, 1987 A Special Meeting of the City Council of the City of Moorpark, California was held on July 23, 1987, in the Moorpark Community Center, Room A, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: The meeting was called to order at 4:39 p.m. by Mayor Clint Harper. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Lane. 3. ROLL CALL: Present: Councilmembers Eloise Brown, Thomas Ferguson, John Galloway, John Patrick Lane, and Mayor Clint Harper. Steven Kueny, City Manager; Cheryl Kane, City Attorney; Gerald Forde, Director of Community Services; and Maureen W. Wall, City Clerk. 4. DISCUSSION /ACTION ITEMS: A. Community Port -A -Pool. 1. Consider the acquisition of the port -a -pool. 2. Scheduling of theport =a -pool prof ect. 3. Proposed agreement with Moorpark_ Unified School District_ concerning the port -a -pool. A -1. Mr. Dan Schmidt, P. 0. Box 3, commented the City should save the $20,000 and construct a permanent pool. Jerry Forde, Director of Community Services, gave an overview of the progress which had been made on the pool project. The shower issue had not been resolved, and he had been told by the pool supplier delivery could be expected in 15 days, although this was not guaranteed. Councilmember Ferguson commented he was unsure the benefits of the pool project were worth the costs involved. He added he did not feel this approach was going to solve the original problem. Minutes of the City Council Moorpark, California 2 July 23, 1987 Councilmember Lane commented he felt the City should save the $20,000 earmarked for this project, and build a permanent community pool. Mayor Harper stated the $14,999 for the pool purchase plus the $5,000 for operations should be placed in the pool account. He further said he was in favor of a community pool, even if the City had to subsidize it. He noted there was already $5,000 in the pool account which had been previously donated to the City by Kavlico. Councilmember Brown stated it appears the City is reaching a point of no return in the completion of this project. The benefits of a three week program in a pool 30 inches deep, needs to be weighed against the cost. Councilmember Galloway commented the City is receiving a very good price for the pool, and some of the costs involved are being donated by members of the community. He felt the proposed agreement with the school district would allow the City the benefit of the showers and the on -site showers will allow the program to run for an extended period of time. Councilmember Ferguson felt the City needed a swimming pool with a shallow end, a diving board, plus picnic tables and trees, and a grass area surrounding the pool. He suggested the City begin work to raise money for this type of community pool. He did state, however, that if the community were fully aware of the limitations of the port -a -pool, he could support the program. Mayor Harper said a permanent pool would cost approximately $220,000, and might be built at the 69 -acre community park site. He felt Council should conclude discussion of the port -a -pool, and commit funds for a permanent pool. MOTION: Councilmember Galloway moved and Councilmember Ferguson seconded a motion to approve the community port -a -pool as a training pool; to direct staff to proceed with acquisition of the pool, to schedule the water safety lessons to begin as of August 10, 1987, to acquire the necessary approvals to complete installation of the pool, to approve the agreement with the school district for use of their shower facilities as a backup to on -site showers, to allocate $5,000 for operation and program costs, to negotiate and sign a contract for swim instructors or a part -time employment agreement with Mr. Bowles. During discussion by Council, the following amendment was heard. AMENDMENT TO THE MAIN MOTION: Councilmember Brown moved and Councilmember Harper seconded a motion to obtain a guarantee that the pool will be delivered within 15 days, or the pool is not to be ordered. The voice vote was approved with Councilmembers Galloway and Ferguson voting no. MOTION: Councilmember Galloway moved and Councilmember Brown seconded a motion to call for the question. The motion failed with Councilmembers Ferguson, Lane, and Mayor Harper voting no. AT THIS POINT IN THE MEETING, the Council recessed, the time being 6:00 p.m. At 6:20 p.m. the full Council reconvened. The original motion, as amended, was then withdrawn by the maker and the second. The following new motion was heard. MOTION: Councilmember Lane and Councilmember Harper seconded a motion to rescind the Council's previous action of appropriating $14,999 for the pool, plus the $5,000 or operation expenses; and place $30,000 from the General Fund Reserve in the Pool Fund towards the construction of a permanent pool, and commit the City to moving forward to obtaining the necessary funds to construct a permanent Olympic -sired swimming pool. AMENDMENT TO THE MOTION: Councilmember Ferguson moved and Councilmember Lane seconded a motion to make a commitment to build a pool within three years with the use of City and private funds, with the pool site to be centrally located. The motion was approved with Councilmembers Brown and Galloway voting no. Councilmember Brown commented she could not support the amendment since no cost of construction was indicated. Councilmember Galloway commented he would not support the amendment because it appeared there were too many loose ends. MOTION: Councilmember Brown moved and Councilmember Galloway seconded a motion to divide the main motion into two parts: MOTION 1) rescind the Council's previous action to acquire the pool at a cost of $14,999, and to appropriate $5,000 for operation costs, and MOTION 2) allocate $30,000 from the City's General Fund Reserve for construction of a permanent Olympic -sized pool. The motion was approved by a voice vote with Councilmember Ferguson and Lane voting no. MOTION 1: During consideration of MOTION 1, the following amendment to the motion was heard. AMENDMENT TO MOTION 1: Councilmember Galloway moved and Councilmember Brown seconded a motion to form a sub - committee of the Council to develop a program for low cost water safety at neighborhood council swimming pools in the City. The voice vote was unanimous. MOTION 1, as amended, was approved by a unanimous voice vote. Minutes of the City Council Moorpark, California 4 _ _ July 23, 1987 MOTION 2: By consensus of Council, consideration of MOTION 2 was continued to July 29, 1987. B. Tierra Rejada Road and Bridge Project (C.C. Myers, Contractor) consideration of options for_placement of 30 inch sewer pipe. City Attorney, Cheryl Kane, counseled the project has reached a level where litigation may be pending. It was her recommendation the City Council go into a Closed Session to discuss this matter under Government Code Section 54956.9(b)(2), and if it is found litigation is pending, then to remain in Closed Session under Government Code Section 54956.9(b)(1) to discuss the matter. The following motion was heard. MOTION: Councilmember Brown moved and Councilmember Galloway seconded a motion to go into Closed Session to discuss the Tierra Rejada Road and Bridge Project and potential litigation. The voice vote was unanimous. The time of adjournment was 6:45 p.m. The City Council came out reconvened in Open Session. the City Council had stayed Code Section 54956.9(b)(1), report. ADJOURNMENT: of Closed Session at 8:11 p.m. and The City Attorney announced that in Closed Session under Government and there was no other action to MOTION: Councilmember Brown moved and Councilmember Ferguson seconded a motion to adjourn the meeting.
