HomeMy WebLinkAboutMIN 1988 1129 CC SPC 6:33 PMMINUTES OF THE CITY COUNCIL Moorpark, California November 29, 1988 The Special Meeting of the City Council of the City of Moorpark, California was held on November 29, 1988 in the Council Chambers of the City Hall of said City, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: The Meeting was called to order at 6:33 p.m. by Mayor John Lane. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Mayor Pro Tem Eloise Brown. 3. ROLL CALL: Present: Councilmembers Eloise Brown, Clint Harper, Bernardo Perez and Mayor John Lane. Steven Kueny, City Manager; Brian Pierik, Assistant City Attorney; Richard Hare, Deputy City Manager; Patrick Richards, Director of Community Development; Philip Newhouse, Director of Community Services; Lt. Richard Rodriquez, Sheriff's Department; and Maureen W. Wall, City Clerk. Absent: Councilmember John Galloway. 4. PROCLAMATIONS, COMMENDATIONS, AND SPECIAL PRESENTATIONS: A. No proclamations, commendations or special presentations were made. 5. REORDERING OF, AND ADDITIONS TO, THE AGENDA: The agenda was not reordered, nor were items added. 6. PUBLIC COMMENTS: A. C. B. Carpenter, 405 Ocean Drive, Oxnard, asked that the City rebuild Avenida Colonia, which has washed out, in order that he might have access to his property in that area of the City. Staff was directed to work with Mr. Carpenter to determine what might be clone. 7. 9. Minutes of the City Council November 29, 1988 Moorpark, California Page 2 COMMITTEE REPORTS: A. Mayor Pro Tem Brown reported she had attended the Highway 118 Improvement Committee and a sub - committee concerning the possibility of establishing a traffic management program with the cooperation and assistance of CalTrans. B. Councilmember Harper reported the Casey Road Site Acquisition Sub - Committee has met with the representatives from the school district, and it appears progress is being made. Further reports will be made in the future. CONSENT CALENDAR: On a motion by Councilmember Perez and seconded by Councilmember Brown, the following items were approved by a unanimous roll call vote of the Council with Councilmember Galloway absent: A. Consider approval of Minutes of the- CitY_.Council Meetings: 1. Adjourned Meeting of November 2, 1988. 2. Regular Meeting of November 2, 1988. 3. Special Meeting of November 16, 1988. B. Resolution No. 88 -523. A_proposed resolution for thg__p ose of rescinding Resolution No._ 86 -276 and adopting __A new resolution of deyelppment approval. Staff recommended the proposed resolution be adopted. C. Resolution No. 88 -524. A proposed resolution establishing a tree and landscape fee - pursuant to Ordinance No. 102 Staff recommended the proposed resolution be adopted. D. Consider the adoption of a_ Master Tree Planting List_. Staff recommended the proposed list be adopted as amended. The following item was pulled for individual consideration by the Council: A. Consider approval of Minutes of the City Council Meeting: 4. Regular Meeting of November 16, 1988. Councilmember Brown asked that her comment regarding her objection to Ordinance No. 102 be amended to reflect she was opposed to the proposed fee structure. MOTION: Councilmember Brown moved and Councilmember Harper seconded a motion to approve the minutes as amended. The voice vote was unanimous with Councilmember Galloway absent. PUBLIC HEARINGS: A. DISCUSSIOWACTION ITEMS: A. No Discussion /Action Items were presented for the Council's consideration. 12. ORDINANCES: A. No Ordinances were presented for Council's consideration. 13. FUTURE AGENDA ITEMS: A. No Future Agenda Items were directed to be placed on Council's agendas. 14. CLOSED SESSION: MOTION: Councilmember Perez moved and Councilmember Brown seconded a motion to go into Closed Session to discuss those items of consideration listed. The voice vote was unanimous with Councilmember Galloway absent. The time was 6:47 p.m. A. Litigation concerning Boething vs. the City of Moorpark. B. Litigation concerning the City of Moorpark vs. Boething. C. Potential litigation pursuant to Government Code Section 54956.9(b)(1). D. Potential litigation pursuant to Government Code Section 54956.9(c). E. Negotiation for real property at 280 Casey Road (former high school site) pursuant to Government Code Section 54956.8. F. Litigation concerning Southern California Edison vs. the City of Moorpark. G. Negotiation for real property on a portion of A.P.N. 500 -35 -22 (Carlsberg) pursuant to Government Code Section 54956.8. THE COUNCIL, WITH COUNCILMEMBER GALLOWAY ABSENT, reconvened in Open Session at 7:00 p.m. Assistant City Attorney Brian Pierik announced that the items discussed in Closed Session were items 14. A., 14.B., 14.C. and 14. D., and that the Council took no action on any of the items. is. ADJOURNMENT: MOTION: Councilmember Brown moved and Councilmember Harper seconded a motion to adjourn the Special Meeting.
