Moorpark, California October 30, 1990
An Adjourned Meeting of the City Council of the City of Moorpark,
California was held on October 30, 1990 in the Council Chambers of
said City located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Perez called the meeting to order at
6:17 p.m.
2. CLOSED SESSION:
MOTION: Councilmember Harper moved and Councilmember Perez
seconded a motion to adjourn to Closed Session for a
discussion of the following:
A. Personnel.
B. Potential litigation pursuant to Government Code Section
54956.9(b) (1) .
C. Potential litigation pursuant to Government Code Section
54956.9(c).
D. Litigation concerning City of Moorpark vs. Moorpark
Unified School District.
E. Litigation concerning Moorpark Unified School District
vs. City of Moorpark.
F. Litigation concerning Ventura County Community College
District vs. City of Moorpark.
G. Litigation concerning the County of Ventura vs. City of
Moorpark.
H. Negotiations for Real Property on the North Side of
Tierra Rejada Road East of Spring Road (Pacifica Corp.)
pursuant to Government Code Section 54945.8.

M. Negotiations for Real Property for a portion of Moorpark
Community College (Ventura County Community College
District) pursuant to Government Code Section 54945.8.
The motion carried by unanimous voice vote.
Present in Closed Session were all Councilmembers; Steven
Kueny, City Manager; and Mary Gayle, Acting City
Attorney.
The meeting reconvened into Open Session at 7:54 p.m.
Mr. Kueny stated there was no action to report out of
Closed Session and only item 2. B., Potential litigation
pursuant to Government Code Section 54956.9(b) (1) had
been discussed.
AT THIS POINT in the meeting a recess was declared. The time
was 7:55 p.m.
Mayor Perez called the meeting back to order at 8:05 p.m.
3. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmember Lawrason.
4. ROLL CALL:
Present: Councilmembers Brown, Harper, Lawrason,
Montgomery and Mayor Perez
Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Mary Gayle, Acting City
Attorney; Pat Richards, Director of Community
Development; John Knipe, City Engineer; and
Lillian Kellerman, City Clerk.
5. Consider Carlsberg Specific Plan
Mr. Richards said that pursuant to the Council's last
direction regarding this matter a resolution had been prepared
so as to deny the Carlsberg Specific Plan.
Councilmember Harper said that before considering taking a
final action that the Council should review a modification to
the original map that had been prepared by City staff as
requested by Council.

Mr. Richards presented for the Council's review proposed Land
Use Category modifications for the specific plan and suggested
that the Council consider them before taking final action to
deny the project. For purposes of discussion, he suggested
that the map showing land uses for the Carlsberg Specific Plan
be labeled Exhibit 7 -A dated 10/30/90.
Councilmember Montgomery said he objected to the multifamily
at the northwest corner of New Los Angeles Avenue and the
proposed Science Drive extension and indicated that the City
needs more commercial. He stated that he felt changes were
too sweeping and he couldn't support the plan as presented.
The impacts on the grading plan were discussed as was the
impact of traffic if multifamily replaced neighborhood
commercial.
Councilmember Lawrason said he did not think the multifamily
would work. He said the Council needed to decide what
densities in each planning area would be acceptable.
Councilmember Lawrason suggested the following:
Planning Area A - the saddle area near the freeway could
support a higher density -- 20 acres at one dwelling unit per
acre and 35 acres at one dwelling unit per 1/2 acre -- for a
total of 85 dwelling units.
Planning Area D - to remain as presented by Mr. Richards for
a total of 75 dwelling units.
Planning Area E - to have a total of 125 dwelling units.
Planning Area C - to have a total of 33 dwelling units.
Planning Area B - to have a mixed density for a total of 430
dwelling units with neighborhood commercial land use replacing
multifamily residential land use.
Councilmember Harper suggested a total of 340 dwelling units
for the project, multifamily reverting to commercial -- a
subregional shopping center not neighborhood commercial. He
said he supported a commercial restaurant, single use (2.5
acres), as part of the commercial area.
Councilmember Harper questioned whether the project would
provide adequate off -site improvements to mitigate the impacts
of the project.

In response to Councilmember Harper's question, Mr. Kueny said
that from the last Council discussion, a tentative decision
had been made relative to Science Drive and Spring Road and
the status on Tierra Rejada Road is known. The AOC would fund
the balance of the improvements. The Spring Road Bridge,
where adding pedestrian capability was discussed, would
require the modification of the Spring Road Bridge. Mr. Kueny
said he would recommend, if Spring Road was only to be a two
lane road, its modification to include a reconstructed two
lane bridge with pedestrian capability instead of looking at
pedestrian capability only. He said the only other question
the Council might want to address is if you want to continue
with the median in that road. He said he presumed that on the
New Los Angeles Avenue frontage, typical frontage improvements
would be required, with the Los Angeles AOC building the core
improvements inclusive of the bridge widening which would be
a Los Angeles Avenue AOC (Area of Contribution) item.
Councilmember Harper offered the following land use plan:
Planning Area A - 55 dwelling units.
Planning Area B - this area to be split into 69 (3 units per
gross acre) and 46 (2 units per gross acre) dwelling units.
Planning Area C - 33 dwelling units.
Planning Area D - 55 dwelling units.
Planning Area E - 125 dwelling units
Total dwelling units for the project 383 with no multifamily.
AT THIS POINT in the meeting a recess was declared. The time was
9:25 p.m. The meeting reconvened at 9:53 p.m.
Mayor Perez indicated that he favored keeping the multifamily.
After further Council discussion and review of the Land Use
Map labeled Exhibit 7 -A, revised during the recess, including
a discussion on adding 7 acres of institutional land use to a
portion of Planning Area 12, consensus by the Council was
reached.
BY CONSENSUS: By consensus the Council determined the land use
plan for the Carlsberg Specific Plan to be as follows:
Land Use A - single family; 1 unit per gross acre; 55 acres;
55 dwelling units.
Land Use B - single family; to be divided into two areas; the
lower area to be 2 units per gross acre (23 acres); and the
upper area to be 3 units per gross acre (23 acres); total
dwelling units to be 115.

Land Use C - single family; 3 units per gross acre; 15 acres
for a total of 45 dwelling units.
Land Use D - single family; 3 units per gross acre; 21.5
acres; total dwelling units to be 65.
Land Use E - Single family; 5 units per gross acre; 25 acres;
total dwelling units to be 125.
Business Park (BP) - 25 acres.
Sub - Regional Retail /Commercial (SR /C) - 39 acres.
Commercial Restaurant, single use (CR) - 2.5 acres.
Institutional (I) - 7 acres.
Park (P) - 8.5 acres.
Open Space (OS) - 225.4 acres.
Total dwelling units for the project to be 405. Location of
Land Use areas to be as presented on the revised Exhibit 7 -A.
Mary Gayle read Resolution 90 -714 in its entirety.
MOTION: Councilmember Harper moved and Councilmember
Montgomery seconded a motion to adopt Resolution 90 -714
approving the Carlsberg Specific Plan. The motion carried by
unanimous voice vote.
Councilmember Lawrason indicated that his affirmative vote was
reluctant.
6. Discussion of Proposed Meandering Sidewalk Along East Side of
Shasta Avenue (Los Angeles Widening Project).
Mr. Kueny requested that the above referenced item be added to
the agenda as item 6 so that the project could continue.
MOTION: Councilmember Brown moved and Councilmember Montgomery
seconded a motion to add a Discussion of the Proposed Meandering
Sidewalk Along the East Side of Shasta Avenue (Los Angeles Widening
Project) need having arisen since the posting of the agenda. The
motion carried by unanimous voice vote.
Mr. Kueny indicated that the recommendation was for a straight
sidewalk with a parkway rather than the meandering sidewalk to
be constructed along the east side of Shasta Avenue.

MOTION: Councilmember Montgomery moved and Councilmember Harper
seconded a motion to approve the City Manager's recommendation that
a straight sidewalk with a parkway be constructed rather than the
meandering sidewalk that had been proposed along the east side of
Shasta Avenue. The motion carried by unanimous voice vote.
7. CLOSED SESSION:
MOTION: Councilmember Brown moved and Councilmember Lawrason
seconded a motion to adjourn to Closed Session for a discussion of
the items listed on the agenda:
A. Personnel.
B. Potential litigation pursuant to Government Code Section
54956.9 (b) (1) .
C. Potential litigation pursuant to Government Code Section

The meeting reconvened into Closed Session at 10:40 p.m.
Present in Closed Session were all Councilmembers;
Steven Kueny, City Manager; Mary Gayle, Acting City
Attorney; and Richard Hare, Deputy City Manager.
The meeting reconvened into Open Session at 11:42 p.m.
Mr. Kueny stated that there was no action to report out
of Closed Session and that only 7.D., 7.E., 7.F., 7.K.
were discussed.
