HomeMy WebLinkAboutMIN 1991 0501 CC REGMINUTES OF THE CITY COUNCIL Moorpark, California May 1, 1991 A Regular Meeting of the City Council of the City of Moorpark was held on May 1, 1991 in the Council Chambers of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7:25 p.m. He noted the death of Riley Spencer and offered condolences to the family. He asked that a moment of silence be observed to mark his passing and in support of those still in the armed services in the Persian Gulf. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Eagle Scout Michael Scott Lilienthal. 3. ROLL CALL: Present: Councilmembers Montgomery, Perez, Talley, Wozniak, and Mayor Lawrason. Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl Kane, City Attorney; Pat Richards, Director of Community Development; Sgt. Rouse Sheriff's Department; Ken Gilbert, Director of Public Works; Susan Cauldwell, Assistant to the City Manager; Phil Newhouse, Director of Community Services; Debbie Traffenstedt, Senior Planner; Charles Abbott, City Engineer; John Knipe, former City Engineer; Don Reynolds, Management Analyst; Carolyn Greene, Management Analyst; Lillian Kellerman, City Clerk. 4. PROCLAMATIONS, COMMENDATIONS, AND SPECIAL PRESENTATIONS: A. Proclamation honoring Michael Scott Lilienthal for his achievement of Eagle Scout. Mayor Lawrason presented the proclamation to Michael Scott Lilienthal. B. Proclamation recognizing Small Business Opportunity Day as May 22, 1991. Minutes of the City Council Moorpark, California Page 2 May 1, 1991 Councilmember Perez read the proclamation. C. Proclamation recognizing Hire a Veteran Week as May 5 -11, 1991. Councilmember Wozniak presented the proclamation to Ralph Abruscato from the Employment Development Department in Simi Valley. D. Proclamation for Youth Mayor for a Day. Mayor Lawrason presented Certificates of Achievement to Katie Greer as the 1st runner up and Jennifer Skhal as winner of the essay contest "Why I Would Like to be Mayor for a Day ". Ms. Skhal was also presented a proclamation. 5. REORDERING OF, AND ADDITIONS TO, THE AGENDA: Mr. Kueny requested that consideration of a waiver to allow the City's contract attorney firm, Burke, Williams and Sorensen to represent both the Ventura County Transportation Commission and the City concerning the Commuter Rail Project and acquisition of property on High Street, be added as Item 11.F., the need for action having arisen after the posting of the agenda. MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to add as Item 11.F. Consideration of a Waiver to Allow the Burke, Williams and Sorensen to Represent both the Ventura County Transportation Commission and the City Concerning the Commuter Rail Project and Acquisition of Property on High Street, the need for action having arisen after the posting of the agenda. The motion carried by unanimous voice vote. 6. PUBLIC COMMENT: A. John Ellis, 1544 Norman Avenue, Thousand Oaks, spoke regarding the newly constructed handicapped ramps on Spring Road at Second Street and Roberts Avenue. He said he believed none of the new ramps are in compliance with State Code and the ones at Spring and Second are especially dangerous. He recommended that these two ramps be blocked off until they can be repaired to bring them into compliance. He said the specifications are contained within Part 2 of Title 24 of the California Code of Regulations. Minutes of the City Council Moorpark, California Page 3 May 1, 1991 B. Linda Plaks, 4957 Mira Sol, spoke representing the Chamber of Commerce, providing information regarding the July 3rd Concert in the Sky celebration. She said the theme this year will be a salute to the red, white and blue and that free admission will be granted to military personnel and half -price for their families. There will also be special recognition to those who served in the Persian Gulf. C. Ruth Farabaugh, 13543 E. Cedarpine, spoke representing the Northview Neighborhood Homeowners Association. She read a petition that had been circulated in her neighborhood that stated the concerns with regard to the chimney shrouds on their homes. She appealed to the Council to do something about the situation. D. Dorothy Mercer, 12659 Hillside Drive, requested to be informed what items and activities have been approved for the Cinco de Mayo Festival. In response, Councilmember Perez said the request for the Ferris Wheel had been denied. E. Mary Cosgrove, 4126 Greenbush Lane, spoke regarding the chimney shrouds and the smoke she is experiencing in her home as a result of the chimney design. She said she spoke with other homeowners and they were all concerned and experiencing the same problem. She read a petition that had been circulated to residents in her neighborhood. F. John Roberts, 15787 Graduate Circle, read and presented a petition containing signatures of persons that object to traffic being diverted into their residential area during construction of the 118/23 freeway connector. Councilmember Montgomery stated that the City's jurisdiction is limited to commercial traffic if detours are being taken at this time through that area of the City. He said the City would see that there was enforcement with regard to commercial traffic. G. Eloise Brown, 13193 Annette Street, congratulated the Mayor for a Day, Jennifer Skahl, and the runner -up, Katie Greer. May 1, 1991 requested that a stop sign be corner of Annette Street and said the corner of Honeybee and is the stop sign that is there and and Cloverdale is even more She said Ventura County Cablevision's billing is for a standard package plus additional outlets if there are any. She said VCC is about to include as a billing line item the franchise fee from the City. She would like Ventura County Cablevision to also itemize the outlets that are billed to each customer. H. Thomas Cushman, 3826 Township Avenue, Simi Valley, spoke regarding PD -1066, the Moorpark Car Wash. He said all requirements have been met at this time for the construction and operation of the car wash. He said Leonard Liston, his partner, has spoken with the pastor of Shiloh Community Church and that they are in agreement with the car wash landscape plans. He said Reverend Hale was to draft a letter of agreement but that this has not been done yet. He said he was hoping the minor modification would not be delayed. 7. COMMITTEE REPORTS: None. 8. CONSENT CALENDAR (Roll Call Vote): MOTION: Councilmember Montgomery moved and Councilmember Talley seconded a motion to pull item 8.A. the minutes of the Regular Meeting of April 17, 1991, 8.E., 8.G., 8.I., 8.J., and 8.K., and approve the balance of the Consent Calendar. The motion carried by unanimous roll call vote. A. Consider Approval of Minutes of Special Citv Council Meeting of April 17, 1991. Staff Recommendation: Receive and file the report. D. Consider Proposed Planning_ Services Contract with Impact Sciences Inc. Regarding Major Modification to CPD 89 -1 and 89 -2 (Mission Bell Plaza). Staff Recommendation: Approve the proposed contract and authorize the Mayor to sign. F. Consider Status Report Reaardina the Processinq of a Minor Modification to PD 1066 (Liston) Regarding Revised Landscape Plan and Modification to Wall on South Property Line. Staff Recommendation: Receive and file the report. H. Consider Spring 1991 Clean Up Day Summary Report. Staff Recommendation: 1) Continue program twice a year utilizing paid staff and volunteers. 2) Require an on -site supervisor from the haulers, and maximize recycling and reuse opportunities. 3) Limit vehicle size and number of trips to prevent commercial usage. L. Consider Conceptual Review of Sidewalk on North Side of Los Angeles Avenue Millard to Spring. Staff Recommendation: Construct 10 -foot parkway with a five -foot sidewalk to be placed adjacent to the curb. M. Consider _Acceptance of Grant Deed and Temoorar Slope Construction Easement from Carlsberg Financial Corporation for Spring Road. Staff Recommendation: Authorize acceptance of deed and easement and appropriate $4246.50 from Gas Tax Fund Reserve for property acquisition. Staff Recommendation: Refer request to Budget and Finance Committee. O. Consider Funding Additional Funding Request from Senior Survivalmobile. Staff Recommendation: Approve request for an additional appropriation of $350 for Senior Survivalmobile for this fiscal year from budgeted Social Services funds. P. Consider Drainage System at Peach Hill Park Playground. Staff Recommendation: Authorize staff to solicit bids and appropriate $6000 from Peach Hill Zone of Park Improvement Fund. Q. Consider Employee Recognition Program. Staff Recommendation: Approve program start date of June 1, 1991. The following items were pulled from the Consent Calendar for individual consideration: A. Consider Approval of Minutes of Regular City Council Meeting of April 17, 1991. The City Clerk noted that Page 4 item O. listed under Public Comment should be amended to read "the discussion of SB 821 proposals for FY91 -92." MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to adopt the minutes as amended by the City Clerk above. The motion carried by unanimous voice vote. E. Consider Report Back Regarding Additional Information Pertaining to Chimney Termination Spark Arrestors for the Pardee Tract (TR 2865). Staff Recommendation: Receive and file the report. (Continued Item 11.E. from 4/17/91) Councilmember Montgomery said that Pardee needed to understand that they are in violation of their RPD by virtue of their elevations and architectural conditions and that the remedial action necessary and required in order to bring the chimney situation to a point where it is acceptable to the City and the residents, and would comply with their RPD, should be identified and communicated to Pardee. He asked what mechanism would be Minutes of the City Council Moorpark, California Page 7 May 1, 1991 appropriate to notify Pardee of the violation of their RPD and lack of compliance with the conditions thereof. In response to Councilmember Montgomery, Mr. Kueny stated that it would be a subject of potential litigation and should be addressed in Closed Session. BY CONSENSUS: By consensus, the Council determined to discuss the matter in Closed Session under Government Code Section 54956.9 (c) at the conclusion of the Consent Calendar. G. Consider a Report to Council Regarding Traffic Systems Management. Staff Recommendation: Receive and file the report. Councilmember Montgomery said that this matter should be assigned to a committee designated by the Council to construct programs that will meet the qualifications referenced in the staff report, assisting in developing programs that will improve air quality in the City. MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to receive and file the report and assign to the Council Transportation Committee the development of programs that will meet the qualifications referenced in the staff report and that will improve the air quality in the City. The motion carried by unanimous voice vote. I. Consider Scheduling of General Plan Update City Council /Planning Commission Field Trips and Workshop. Staff Recommendation: 1) Concur with scheduling of field trips for May 20 and May 29, 1991; 2) Concur with scheduling of next General Plan Update workshop for May 29, 1991 at 7:00 p.m. The Mayor noted that the public was welcome to join the Council on the field trips planned. MOTION: Mayor Lawrason moved and Councilmember Montgomery seconded a motion to approve the staff recommendation. The motion carried by unanimous voice vote. Minutes of the City Council Moorpark, California Page 8 May 1, 1991 J. Consider Authorization to Advertise for Recent of Bids for the Construction of a Landscaped Barrier on Williams Ranch Road. Staff Recommendation: Approve plans and specifications and authorize staff to advertise for receipt of bids. In response to Councilmember Montgomery, Mr. Gilbert said these plans were agreeable, in concept, to the Fire Department. He said it was his intent to send the Fire Department the final plans. Mr. Kueny said there is a new Attorney General's opinion which may impact the project and that the staff hoped to have an answer on the matter in two weeks. He asked that the Council continue the item for two weeks. MOTION: Councilmember Montgomery moved and Councilmember Talley seconded a motion to continue the matter to the May 15, 1991 meeting. The motion carried by unanimous voice vote. K. Consider Reauest from Moorpark Senior Citizens for Operations and Maintenance Funding of Senior Van. Staff Recommendation: Deny request for funding and suggest that Senior Citizens coordinate with Senior Survivalmobile. In response to Councilmember Talley, Ms. Cauldwell clarified that no financial information had been received from the Moorpark Senior Citizens for inclusion in the staff report. Mayor Lawrason requested that the staff provide assistance to the Seniors next year in the grant application process, should it be needed. MOTION: Councilmember Talley moved and Councilmember Wozniak seconded a motion to approve the staff recommendation to deny the request for funding and suggest that Senior Citizens coordinate with the Senior Survivalmobile. The motion carried by unanimous voice vote. MOTION: Councilmember Montgomery moved and Councilmember Talley seconded a motion to go into Closed Session under Government Code Section 94956.9(c). The motion carried by unanimous voice vote. Minutes of the City Council Moorpark, California Page 9 The time was 8:30 p.m. May 1, 1991 Present in Closed Session were all Councilmembers; Steven Kueny, City Manager; Pat Richards, Director of Community Development; and Cheryl Kane, City Attorney. The meeting reconvened into Open Session at 8:45 p.m. Mr. Kueny reported there was no action to report out of Closed Session and only Potential litigation pursuant to Government Code Section 54956.9(c) was discussed. AT THIS POINT in the meeting a recess was declared. The time was 8:45 p.m.. The meeting reconvened at 8:59 p.m. E. Consider Report Back Regarding Additional Information Pertaining to Chimney Termination Spark Arrestors for the Pardee Tract (TR 2865). Staff Recommendation: Receive and file the report. (Continued Item 11.E. from 4/17/91) MOTION: Councilmember Montgomery moved and Councilmember Talley seconded a motion to direct staff to send a letter to Pardee Construction notifying them that they are in violation of their RPD and demanding that they appear for an office visit at which time they will be instructed as to how they can come into compliance; to visit Mary Cosgrove's house and view the fireplace problems she has reported, a report to come back to Council on the matter. The motion carried by unanimous voice vote. 9. PUBLIC HEARINGS: A. Consider Tentative Tract Map No. 4652 - Abe Guny - The Proposed Subdivision of a 35.9 -Acre Rural Exclusive (RE) and RE -5 Acre Zoned Property into 18 Single - Family Lots and a 29.71 Acre Remainder Parcel. Staff Recommendation: Continue the public hearing until May 15, 1991, if more information is required regarding Casey Road /Walnut Canyon Road sight distance; or approve the project with conditions as recommended by staff. Ms. Traffenstedt gave the staff report. Mayor Lawrason noted that the Public Hearing is still open. Minutes of the City Council Moorpark, California Page 10 May 1, 1991 Tom Montgomery, of Tom Montgomery & Associates, 2151 Alessandro Drive #210, Ventura, representing the applicant, spoke regarding the sight distance study his firm provided regarding this project. He said that a viable solution is to prohibit left turns from Casey Road onto Walnut Canyon. Abe Guny, 7250 Walnut Canyon Road, spoke requesting approval of the tract map with the minor changes recommended by staff. Linda Mackinson, 17934 Hatton Street, Reseda, spoke representing the applicant. She said Condition 87 requires the applicant to widen Walnut Canyon Road and construct the left turn pocket northbound onto Casey Road. She asked that the condition be amended so Mr. Guny could enter into an agreement with the City to complete those improvements with the understanding that he could recover a portion of those costs through future development of the school property. Ms. Mackinson said another issue was the northerly zone boundary which traditionally follows a geographical or structural barrier. She proposed D Street as a new geographical boundary and the northerly lot line of Parcel No. 18 as the northerly zone boundary. This would allow placement of the building pad closer to the street off the slopes and still maintain the required square footage on the lot. She suggested that some of the $54,000 Mr. Guny is contributing toward city -wide traffic mitigation could go towards mitigating the long -term problems on Walnut Canyon Road. Ms. Mackinson said that the next to last sentence in Condition No. 133 states "the required affordable unit shall be built in compliance with all the conditions of approval of Tract No. 4652 and shall be constructed and occupied by the selected buyer prior to the approval of the 13th occupancy in this tract ". She said occupancy is beyond the applicant's control and asked that the wording be amended. Minutes of the City Council Moorpark, California Page 11 May 1, 1991 Carl Schiff, 7041 Owensmouth, #101, Canoga Park, spoke as legal counsel for the applicant. He said he is present to answer any questions. He said Mr. Guny has filed a lawsuit against the Jacoby's for declaratory relief (Case No. 115971) regarding the possible easement rights of the parties. He said stated that the Council should defer to the courts in this civil litigation. Bill Jensen, 1534 Eastman Avenue, suite A, Ventura, Lockman & Associates, said he was the project engineer and was present to answer any questions. Valerie Jacoby, 1017 Walnut Canyon Road, said she was not aware the suit had been filed.She said the prohibition of the left -turn from Casey Road may not be a problem now, but when 18 homes are built, it will be come a problem. In response, Tom Montgomery said the tract includes a circulation system that will provide a secondary access to Walnut Canyon further north so that the traffic from the new tract will have the option of making a left turn onto Walnut Canyon Road at that point rather than from Casey Road. Mr. Kueny said that the secondary access is a private street and use by the general public could be restricted. He said this project should be conditioned as the JBH project was, to allow the City's ability to use the streets, especially for public safety reasons in the evacuation of the public. Mayor Lawrason closed the Public Hearing. Minutes of the City Council Moorpark, California Page 12 May 1, 1991 MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to approve the staff recommendation to approve the Mitigated Negative Declaration and the Mitigation Monitoring Program; make the appropriate findings, including General Plan consistency; to direct staff to prepare a resolution for adoption at the May 15, 1991 meeting conditionally approving Tentative Tract Map No. 4652, based on the project findings and the conditions of approval amended as presented in the staff report and as discussed tonight with regard to (1) Condition 87 and Condition 101 to include the applicants request for reimbursement language and in Condition 101 "if site distance is determined to be inadequate" to be deleted; (3) Condition 133 -- the affordable housing occupancy requirement to be amended as requested by the applicant; (4) language to be added to allow an access right on the projects private roads by the City for public safety. Staff directed to prepare a resolution setting forth the zone boundary change requested by the applicant. The motion carried by unanimous voice vote. B. Consider Proposed Amendments to the City's Home Occupation Permit Process to include Time Limits and A Processing Fee. Staff Recommendation: Continue the hearing to May 15, 1991. Mayor Lawrason opened the public hearing. There were no speakers present. MOTION: Councilmember Talley moved and Councilmember Montgomery seconded a motion to continue the matter to the May 15, 1991 meeting, the public hearing to remain open. The motion carried by unanimous voice vote. 10. COMMENTS FROM COUNCIL MEMBERS: Councilmember Perez said he wanted to add his congratulation to Michael Scott Lilienthal for his achievement of Eagle Scout. Councilmember Perez said there is a considerable amount of large brush on the north side of Los Angles Avenue between Spring and Millard where the sidewalk is to be constructed. He said he hoped, as the project developed, the City would consider enhancing the landscaping in that area. Minutes of the City Council Moorpark, California Page 13 May 1, 1991 Councilmember Wozniak said staff should look at the "vehicle for sale lot" that is now on the proposed hotel property for possible code violations. 11. ACTION /DISCUSSION ITEMS: A. Consider Weldon Canvon Draft Environmental Impact Report. Staff Recommendation: Authorize Mayor to send letter to Board of Supervisors outlining City's concern with "no project" alternative. (Continued Item 11.A. from 4/17/91) Councilmember Montgomery said Ms. Cauldwell had drafted for him the proposed letter included in the agenda packet to be sent to the Board of Supervisors. He recommended the Council authorize the Mayor to sign the letter. MOTION: Mayor Lawrason moved and Councilmember Talley seconded a motion to approve the recommendation to authorize the Mayor to sign and send the letter included in the agenda packet to the Board of Supervisors outlining the City's concern with "no project" alternative. The motion carried by unanimous voice vote. B. Consider Waiver of Fees for Community Center Use for Public Outreach Meeting on Issues Facing Women in the 90's and Beyond. Staff Recommendation: Direct staff as deemed appropriate. Mr. Newhouse gave the staff report. In response to Council question, Mr. Newhouse said that he recommended waiving all but the direct staff cost. In response to Council question, Mr. Kueny said the Commission for Women would be covered for insurance under the umbrella of Ventura County liability coverages. Mr. Kueny suggested referring the subject matter to the Public Works Committee. Minutes of the City Council Moorpark, California Page 14 May 1, 1991 MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to waive the fees for use of the Community Center by the Ventura County Commission for Women and to refer the waiving of fees for facility use by governmental agencies to the Public Works /Facilities Committee for discussion. The motion carried by unanimous voice vote. C. Consider CDBG Agreement for Grant and Loan to the Boys and Girls Club for Acquisition of a Gymnasium. Staff Recommendation: Approve the agreement for grant and loan to the Boys and Girls Club for acquisition of a gymnasium. Mr. Hare gave the staff report. He requested the item be continued to the May 15, 1991 meeting as the agreement is still undergoing revisions. MOTION: Councilmember Montgomery moved and Councilmember Talley seconded a motion to continue the matter to the May 15, 1991 meeting. The motion carried by unanimous voice vote. D. Consider Proposal to Reorganize Solid Waste Management in Ventura County. Staff Recommendation: Authorize Mayor to send a letter to Board of Supervisors supporting empowerment of Waste Commission on issues relating to solid waste. Councilmember Montgomery said he recommended authorizing the Mayor to send the proposed letter to the Board of Supervisors. MOTION: Councilmember Perez moved and Councilmember Wozniak seconded a motion to approve the recommendation to authorize the Mayor to send the letter provided in the agenda packet to the Board of Supervisors supporting empowerment of the Ventura County Waste Commission on issues relating to solid waste. The motion carried by unanimous voice vote. E. Consider City's Mission Statement and 1991/92 Departmental Goals. Staff Recommendation: Approve Mission Statement and 1991/92 departmental goals. The Council commended the staff on the Mission Statement and 1991/92 departmental goals. Consideration of a Waiver to Allow the Firm of Burke, Williams and Sorensen to Represent both the Ventura County Transportation Commission and the City Concerning the Commuter Rail Project and Acquisition of Property on High Street Mr. Kueny gave a report on this matter. MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to authorize the Mayor to sign a waiver allowing Burke, Williams and Sorensen to represent both the Ventura County Transportation Commission and the City concerning the Commuter Rail Project and acquisition of property on High Street. The motion carried by unanimous voice vote. 12. ORDINANCES: A. Consider Second Reading and Adoption of Ordinance No. 140 - An Ordinance Amending Chapter 10.04 of the Moorpark Municipal Code as it Relates to 1) Parking in Excess of 72 Hours; 2) Overnight Parking, and 3) Parking of Commercial Vehicles. Ms. Kane read the title of Ordinance No. 140. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to read the ordinance title. The motion carried by unanimous voice vote. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to waive further reading and declare Ordinance No. 140 read for the second time and adopted. The motion carried by unanimous voice vote. 13. FUTURE AGENDA ITEMS: Councilmember Perez asked for an agenda item regarding looking for and developing a site for trucks to use for overnight parking for local truck owner /operators. Councilmember Montgomery suggests referring the item to the Transportation Committee. CLOSED SESSION: MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to adjourn to Closed Session for a discussion of all items listed on the agenda: A. Personnel. B. Potential litigation pursuant to Government Code Section 54956.9(b)(1) C. Potential litigation pursuant to Government Code Section 54956.9(c) D. The time was 10:00 p.m. The meeting reconvened into Closed Session at 10:12 p.m. Present in Closed Session were all Councilmembers; Steven Kueny, City Manager; Cheryl Kane, City Attorney; Richard Hare, Deputy City Manager; and Pat Richards, Director of Community Development. Mr. Richards left the Closed Session at 10:50 p.m. The meeting reconvened into Open Session at 10:59 p.m. Mr. Kueny stated there was no action to report out of Closed Session and only 14.A., 14.L., 14.M., 14.N., 14.0., 14.P., and 14.Q. had been discussed. 15.
