Moorpark, California July 10, 1991
A Special Meeting of the City Council of the City of Moorpark was held
on July 10, 1991 in the Council Chambers of said City located at 799
Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Pro Tem Bernardo Perez called the meeting to order at
7 :35 p.m.
2. PLEDGE OF ALLEGIANCE:
Richard Hare led the Pledge of Allegiance.
3. ROLL CALL:
Present: Councilmembers Montgomery, Talley, Wozniak, and
Mayor Pro Tem Perez
Absent: Mayor Paul Lawrason
Present: Steven Kueny, City Manager; Richard Hare, Deputy
City Manager; Cheryl Kane, City Attorney; Don
Reynolds, Management Analyst; Pat Richards,
Director of Community Development; and Lillian E.
Kellerman, City Clerk
4. PROCLAMATIONS, COMMENDATIONS, AND SPECIAL PRESENTATIONS:
None.
5. REORDERING OF, AND ADDITIONS TO, THE AGENDA:
None.
6. PUBLIC COMMENT:
A. Ken Maffei, President of the Ventura County Professional
Firefighters Association, 155 Granada, Camarillo, spoke
regarding the paramedic program that the firefighters
have proposed for the City of Moorpark. He said his
organization stands behind the cost of their proposal and
they are prepared to meet the needs of the City through
this program. He presented a petition with approximately
2500 signatures of citizens of Moorpark.

7. COMMITTEE REPORTS:
Councilmember Montgomery said the Board of Supervisors is
reluctant to endorse the proposed paramedic program, but Mayor
Lawrason and he continue to support it and are meeting
frequently with the firefighters and medical service
personnel.
Councilmember Perez said he thinks each Councilmember should
call Supervisor Howard to voice their support for this
program.
8. CONSENT CALENDAR: (Roll Call Vote)
A. Consider Adoption of Salary Resolution No. 91 -776 for
Fiscal Year 1991/92. Staff Recommendation: Adopt Salary
Resolution No. 91 -776.
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to adopt Resolution No. 91 -776
adjusting the salary rates for fiscal year 1991/92 and
repealing Resolution No. 90 -691. The motion carried by roll
call vote 4 -0, Mayor Lawrason absent for the vote.
9. PUBLIC HEARINGS:
A. Consider the Reappropriation of Community Development
Block Grant (CDBG) Funds from Program Years 1988 -91
Estimated to be $80,000. Staff Recommendation: Allow
staff to utilize $50,000 of Gann funds as part of the
$150,000 loan /grant from City to Boys and Girls Club, and
reappropriate CDBG program funds of $80,000 to City
street improvement projects.
Mr. Kueny gave the staff report.
Mayor Pro Tem Perez opened the public hearing.
There being no speaker cards, Mayor Pro Tem Perez closed
the public hearing.
The Council determined to amend the staff recommendation
by tabling item 1.B. of the staff report "the
reappropriation of the grant portion of Club Assistance
for use on street projects on Nogales Avenue /Avenida
Colonia and Charles Street with an accompanying grant of
$50,000 from Gann funds currently appropriated for street
improvements ".

MOTION: Councilmember Wozniak moved and Councilmember
Montgomery seconded a motion to reappropriate the Grant
portion of Club Assistance which includes $5,266 of CDBG
program year 1988/89 and $44,736 of CDBG program year 1989/90
for redesignation as a loan to the Club with conversion to a
grant upon repayment of $100,000 and to reappropriate $30,000
from CDBG program year 1990/91 to City street improvement
projects. The motion carried by 4 -0 roll call vote, Mayor
Lawrason absent for the vote.
COMMENTS FROM COUNCIL MEMBERS:
Councilmember Wozniak asked staff if signs could be posted in
the community parks regarding the safety of certain equipment.
Mr. Kueny suggested this be agendized for the meeting of
July 17 so staff can bring back complete information regarding
the wording.
Councilmember Perez encouraged citizens to attend the second
Ad Hoc Gang Committee meeting to be held on July 16.
ACTION /DISCUSSION ITEMS:
A. Consider Retirement Plan for Part -Time Employees. Staff
Recommendation: Authorize the payment of the part -time
employee portion of the Social Security contribution.
Mr. Hare gave the staff report.
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to direct staff to set aside an
amount equivalent to 6.2% of part time employees' salaries for
the purpose of development of a defined benefit retirement
system or defined contribution to be paid by the City from the
appropriate fund reserves; the cost to be $4,225. The motion
carried by a 4 -0 roll call vote, Mayor Lawrason absent for the
vote.
B. Consider Status of an Affordable Housing Agreement
Regarding a Proposal by Bibo, Inc. (RPD 91 -1) to Provide
100 Affordable Apartment Units on a 7.4 Acre Site South
Side of Los Angeles Avenue between Moorpark Avenue and
Fremont Street. Staff Recommendation: Allow the
Planning Commission to hold public hearings regarding the
entitlement requests.

Mayor Pro Tem Perez stepped down from the dais at this
time because of a possible conflict of interest. He
passed the gavel to Councilmember Montgomery.
Mr. Richards gave the staff report.
MOTION: Councilmember Talley moved and Councilmember Wozniak
seconded a motion to allow the Planning Commission to hold
public hearings regarding the entitlement requests. The
motion was carried by a 3 -0 voice vote, Mayor Lawrason and
Mayor Pro Tem Perez absent for the vote.
Mayor Pro Tem Perez returned to the dais.

FUTURE AGENDA ITEMS:
Councilmember Talley requested that staff report on the status
of the Texaco station on Moorpark Avenue at the next meeting.

MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to adjourn the meeting. The motion
was carried by a 4 -0 voice vote, Mayor Lawrason absent for the
vote. The time was 8:35 p.m.
