April 22, 1992
A Special Meeting of the City Council of the City of Moorpark was held
on April 22, 1992 in the Council Chambers of said City located at 799
Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:15 p.m.
Present: Councilmembers Montgomery, Perez, Talley, Wozniak and
Mayor Lawrason
Steven Kueny, City Manager; Richard Hare, Deputy City
Manager; Pat Richards, Director of Community Development;
Debbie Traffenstedt, Senior Planner; Charles Abbott, City
Engineer; Lillian Kellerman, City Clerk.
2. PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilmember Talley.
3. ORDINANCE:
A. Consider Interim Ordinance Adopted On An Urgency Basis,
Imposing A Moratorium on the Development of Property in the C-
2 (General Commercial) and CPD (Commercial Planned
Development) Zones for Gasoline Sales in Conjunction with
Convenience Mini - Market and Alcoholic Beverage Sales.
CONSENSUS: By consensus, the Council determined to waive the Rules
of Procedure and allow public comment.
Ed Jones, 5135 Island Forest P1, Thousand Oaks, addressed the
Council, representing Sam Atassi. He indicated that he
believed it was Mr. Atassi's application to build an Arco gas
station /mini mart that had precipitated this urgency
ordinance. He asked what affect this would have on the
application process for his client.
Councilmember Montgomery said that an application is not
deemed to be filed until it is accepted as complete, which had
not occurred yet with regard to Mr. Atassi's application. He
said the ordinance would restrict staff's ability to accept
applications until the urgency ordinance expired.
Sam Atassi, 2337 Rocomare Rd., Suite 7, Los Angeles, addressed
the Council saying that he felt his project should be exempted
from the ordinance if the ordinance were passed.
In response to Councilmember Montgomery, Mr. Atassi said ARCO
will not franchise an AM /PM Mini -Mart without the sale of
alcoholic beverages.

The Council took a straw vote of those who supported going
forward with the ordinance. Councilmembers Montgomery and
Mayor Lawrason indicated their support, Councilmembers Perez,
Talley, and Wozniak indicated they would not support the
ordinance.
Councilmember Wozniak suggested that two members of the
Council work with staff as a committee to suggest development
standards for projects having gasoline sales in conjunction
with Convenience Mini - Market and Alcoholic Beverage Sales.
4. PUBLIC HEARING
A. Consider General Plan Update Land Use and Circulation
Elements, Sphere of Influence Expansion Study, and
Environmental Impact Report (GPA -89 -1 and Zone Change 89 -1)
Staff Recommendation: Continue Council discussion.
Ms. Traffenstedt gave the staff report.
Councilmember Montgomery indicated that he found the schedule
outlined in the staff report and its tenure to be
unacceptable. He said the Council should dictate when the
General Plan process will be complete. He indicated that only
two more meetings would be needed. He objected to the fact
that staff continued to bring new issues to the Council.
Councilmember Talley indicated his concurrence with
Councilmember Montgomery's statement.
Mayor Lawrason said the General Plan process has been a
difficult, trying five years. He cited lack of experience and
difficulty with the consultant as adding to the onerousness of
the task. He indicated that staff had identified nearly a
"man year" of staff work still left to be done prior to
adoption of the Plan. He said he believed the Council had
sufficient material and should go forward with the process.
The Council determined to go over the Work Tasks outlined
beginning on Page 2 of the staff report dated April 16, 1992
under the following heading:
Require Immediate Council Direction
1. Review Chamber of Commerce Economic Development and
Employment goals and policies and identify which, if any,
should be incorporated into Land Use Element.
CONSENSUS: By consensus, the Council determined to direct
staff to incorporate the "essence" of the information from the
Chamber for presentation to the Council no later than the
April 29th meeting.

2. Review EIR mitigation measures and add applicable
mitigation measures to land Use and Circulation Element
implementation programs.
CONSENSUS: By consensus, the Council determined to direct
staff to complete this task for presentation to the Council no
later than the April 29th meeting.
3. Mitigation Monitoring Program - staff will need to
rewrite mitigation measures to be more specific and must
list which person, City department or agency is
responsible for implementation and long term monitoring.
CONSENSUS: By consensus, the Council determined to direct
staff to complete this task for presentation to the Council no
later than the April 29th meeting.
4. Prior to certification of the Final EIR, a clarification
memorandum should be prepared and attached to the Final
EIR which explains changes which have occurred to the
Draft Land Use and Circulation Element since preparation
of the Response to Comments Section.
CONSENSUS: By consensus, the Council determined to direct
staff to complete this task for presentation to the Council no
later than the May 13th meeting.
5. CEQA Findings are required for each significant effect
identified in the EIR, and a Statement of Overriding
Considerations is required where significant effects are
not at least substantially mitigated.
Councilmember Montgomery indicated that this item would
require analysis by the staff subsequent to the approvals
that the Council will direct regarding the land use.
CONSENSUS: By consensus, the Council determined to direct
staff to draft this information and present it to the Council
at the May 13th meeting for use if needed.
6. Existing Land Use Inventory on page 3 of the Draft Land
Use Element should be updated.
CONSENSUS: By consensus, the Council determined to direct
staff to prepare this for the May 13th meeting.
7. General Plan /Zoning Compatibility Matrix in Draft Land
Use Element is not accurate and should be corrected.

staff to prepare this for the May 13th meeting.

8. Should a glossary and definition section be included in
Land Use Element?
CONSENSUS: By consensus, the Council determined to direct
staff to defer this item until after the adoption of the
General Plan when it could be added as an addendum.
Mr. Kueny indicated that if there was a specific instance
were a definition was needed, staff could address those
prior to completion of the process.
9. Should staff amend Section 5.0 of the Draft Land Use
Element to include language pertaining to clustering
similar to that contained in Resolution 86- 318...
CONSENSUS: By consensus, the Council determined to direct
staff to have this item completed no later than May 13th but
would like to have the item in writing at the next meeting for
review.
10. Confirmation is needed that the following list (a. - k.)
represents the Council's desired revisions or actions
pertaining to Figure 2, Highway Network, of the
Circulation Element based on discussion at the March 11
and April 8 meetings.
The Council took consensus action regarding the
subsections of 10:
Councilmember Talley said that subsection "e" shows a
signal at both Park Lane and Liberty Bell Road
intersections with Los Angeles Avenue; however, in
subsection "f" Liberty Bell is eliminated and the policy
"requiring signalization at major entrances to commercial
projects if determined necessary based on traffic
conditions" would take precedence over the signal at
Liberty Bell.
CONSENSUS: By consensus, the Council agreed with
Councilmember Talley's statement above.
Mayor Lawrason questioned the wording "rural collector"
in subsection "b ".
CONSENSUS: By consensus, the Council asked staff to determine
if "rural collector" was appropriate language.
Mayor Lawrason clarified that subsection "d" referred to
the section of Mountain Trail Street west of Tierra
Rejada just "short of" Arroyo West Elementary School. He
indicated that clarification needed to be explicit.

CONSENSUS: By consensus, the Council determined to direct
staff to make the clarification as requested above by Mayor
Lawrason.
Mayor Lawrason expressed concern with the designation of
"local collector" in subsection "h ".
CONSENSUS: By consensus, the Council determined to direct
staff to change "local collector" to "rural collector" in
subsection "h".
Councilmember Talley clarified that Council would revisit
the Circulation Element for compatibility with the Land
Use determination decisions made by the Council.
Councilmember Wozniak said that while the Council was
discussing Spring Road he would like to confirm that the
small portion of Spring Road that was shown going north
of the 118 into Campus Park was to be deleted from the
Circulation Element.
CONSENSUS: By consensus, the Council determined to direct
staff that the section of road defined by Councilmember
Wozniak above was to be deleted from the Circulation Element.
Mr. Kueny said that the same change that was made on
subsection "h" changing it to a "rural collector" might
apply on subsection "g" on the portion of Spring Road
between Peach Hill Road and the Bridge. He said there
was some concern regarding the Bridge. If it was being
reconstructed for two lanes of vehicular traffic and bike
lanes shouldn't it be reconstructed so that it could
ultimately accommodate four lanes?
CONSENSUS: By consensus, the Council determined to direct
staff to clarify that in subsection "g" Spring Road should be
shown as a four -lane arterial from the approach to the Bridge
on the south side (beginning at some appropriate point south
of the Bridge) , including the Bridge itself and going north to
Los Angeles Avenue.
CONSENSUS: By consensus, the Council determined to direct
staff to add Hearon and Christian Barrett Drives as local
collectors on Figure 2. as presented in subsection "k ".
11. Confirmation is needed from the Council that the list
shown in subsection a - d represents the Council's
desired revisions to Figure 3, Bikeway Network.
CONSENSUS: By consensus, the Council confirmed that
subsection a - d represents the Council's desired revisions to
Figure 3, Bikeway Network.

12. Staff is awaiting direction from the Council
Bikeway /Equestrian Trail Ad Hoc Committee pertaining to
the need to revise the Circulation Element text and /or
exhibits to identify that bicycle use on equestrian
trails is permitted...
Councilmember Montgomery stated that he would annotate a
map for staff, allowing them to complete this matter
prior to the April 29th meeting.
13. Staff is recommending that the Council look at each
proposed Specific Plan individually...
Councilmember Montgomery said the Council could probably
get to this by the end of the meeting tonight and
conclude next Wednesday so that staff could prepare the
necessary approval documents by May 13th.
The Council determined to go over the Work Tasks outlined
beginning on Page 5 of the staff report dated April 16, 1992
under the following heading:
Work Tasks Recommended Prior to Completion
1. Analyze, identify, and implement required Zoning Code and
zoning Map changes necessary for consistency with revised
Land Use Element.
CONSENSUS: By consensus, the Council determined to direct
staff that this can be accomplished after the finalization of
the General Plan.
Councilmember Montgomery said that he felt this could be
accomplished within 60 days after adoption of the General
Plan.
2. A transportation improvement fee program shall be
developed and adopted to enable circulation improvements
to be funded by new development.
CONSENSUS: By consensus, the Council determined to direct
staff that this item be one of the first priorities after the
adoption of the General Plan.
3. Prepare Hillside Development Ordinance.
Councilmember Wozniak said he believed most of the
groundwork had been accomplished on this very important
item and that it should not take long to complete.
CONSENSUS: By consensus, the Council determined to concur
with Councilmember Wozniak's statement above.

CONSENSUS: By consensus, the Council determined to consider
the work tasks recommended by staff to be completed following
the adoption of General Plan after that adoption.
The Council determined to go over the Work Tasks outlined
beginning on Page 11 of the staff report dated April 16, 1992
under the following heading:
Land Use Element Issues
1. Unocal
CONSENSUS: By consensus, the Council determined that the land
use would remain as Open Space 2.
2. After making a decision on a preferred land use plan, the
Council will need to determine whether substantive
changes to the draft Land Use Element (text and land use
plan) have been made.
CONSENSUS: By consensus, the Council determined they will not
consider anything the Planning Commission has not considered.
3. What mineral resource areas need to be designated on the
General Plan map to be in compliance with State law?
Mr. Kueny indicated that no action was required as staff
had identified that there are no MRZ -2 zones within the
planning area.
4. Should rail corridor zoning be considered?
CONSENSUS: By consensus, the Council determined to concur
with the Planning Commission recommendation to not include it.
5. School District master plan information.
CONSENSUS: By consensus, the Council determined to direct the
Mayor to communicate with the School Board requesting the
School District Master Plan information.
6. Do we need definitions of density so there is never an
argument as to whether its on a gross or a net acre
basis?
CONSENSUS: By consensus, the Council determined that density
would be calculated based on "gross" rather than "net" area.

7. Does the Council want staff to address any issues related
to the testimony given on March 18, 1992, or any of the
written documents transmitted from the City Clerk to the
Council in packages dated March 13, 1992, March 18, 1992,
and March 19, 1992?
CONSENSUS: By consensus, the Council determined that all
issues described in this item are being considered in the
process.
8. If the Council is interested in doing so, does the
General Plan have language to allow a charge to be
imposed on commercial builders to help pay for low income
housing?
In response to Councilmember Perez, Ms. Traffenstedt
indicated that staff desired to know if the Council would
like to broaden the policy to allow the City to establish
a housing trust fund. She said the implementation
program would then need to reflect the requirement for
staff to study the feasibility of adopting a housing
trust fund ordinance.
CONSENSUS: By consensus, the Council determined to direct
staff to proceed as outlined by Ms. Traffenstedt with the
language "where feasible ".
9. Should we consider one land use such as institutional for
all public and quasi- public uses and then having various
zoning options to recognize current and /or potential
uses?
Ms. Traffenstedt clarified that this is the way the staff
is proceeding.
CONSENSUS: By consensus, the Council determined that staff
should proceed as they are with this item.
10. Relative to the residential density discussion at the
Council's April 8 meeting, should a minimum density be
included? Should any of the maximum densities or density
limits be revised?
CONSENSUS: By consensus, the Council determined to defer this
until the City Attorney could be present for the discussion.

The Council determined to go over the Circulation Element
Issues outlined beginning on Page 15 of the staff report dated
April 16, 1992:
Circulation Element Issues
12. What is the feasibility of six travel lanes for Los
Angeles Avenue west of Gabbert Road?
CONSENSUS: By consensus, the Council determined to direct
staff to show Los Angeles Avenue as four lanes west of Gabbert
Road.
Councilmember Talley said that there was a need to look
at other streets to get traffic off Los Angeles Avenue,
possibly "B" Street.
CONSENSUS: By consensus, the Council determined to direct
staff to have Austin Foust run the Traffic Model to determine
the effect of the removal of certain streets (removed since
the Traffic Model was first run) from the Circulation Element
Exhibit and the effect of changing the extension of Los
Angeles Avenue west of Gabbert Road from six to four lanes.
13. Depending upon the land uses approved for Specific Plan
2 and the Circulation element linkages approved, do we
need to specifically look how the State Route 23/118
connection project will impact the ability to use a road
through JBR as the main access to the Happy Camp Regional
Park and as the new State Route 23 connecting to
Broadway?
CONSENSUS: By consensus, the Council determined to discuss
this after land use designations are determined.
AT THIS POINT in the meeting a recess was declared. The time
was 9:25 p.m. The meeting reconvened at 9:40 p.m.
Councilmember Wozniak asked what the removal of "D"
Street has on the circulation element.
In response to Councilmember Wozniak, Mr. Abbott said
that all the through traffic will be "dumped" back on
local streets.
Councilmember Wozniak suggested an interim connection
( "D" Street) was needed to connect State Route 118 to
State Route 23.

CONSENSUS: By consensus, the Council determined to direct
staff to include a "D" Street connection (clarified by staff
as East "D" Street) in the Circulation Element Exhibit.
14. The following issues need to be resolved regarding
equestrian trails:
Should the expressed concern of putting equestrian
trails adjacent to agricultural uses be addressed
in the Circulation Element?
CONSENSUS: By consensus, the Council determined that the
answer to the above questions is no.
Do we need to address fencing for equestrian trails
as well as motorcycle barriers?
CONSENSUS: By consensus, the Council determined that the
answer to the above questions is no.
Have we addressed a program for ownership and
maintenance of the equestrian trails?
CONSENSUS: By consensus, the Council determined that a
program was not needed.
How should the Circulation Element address allowing
bicycle use on equestrian trails? Are specific
trail standards required?
CONSENSUS: By consensus, the Council determined to direct
staff that a statement could be made that bicycle use and
equestrian use can be allowed together and that the
development of trail standards is not needed.
15. What is the status of a railroad grade separation?
Mr. Richards showed the proposed plan for an underpass
between the Bugle Boy and Jemco properties.
CONSENSUS: By consensus, the Council determined that this
issue did not need to be acted upon at this time and that
while a circulation element is needed (bypass road) at
approximately the proposed path, the exact location will be
defined in the development review process.
16. Is the Circulation Element consistent with the Congestion
Management Plan requirements?
CONSENSUS: By consensus, the Council determined that the
Congestion Management Plan will have no impact on the General
Plan Update process.

17. Policy 1.7 includes the term "rural appearance ", which is
not defined.
CONSENSUS: By consensus, the Council determined to direct
staff to leave Policy 1.7 as written to include "rural
appearance ".
18. Should specific definitions be included for level of
service and intersection capacity utilization?
CONSENSUS: By consensus, the Council determined to direct
staff to include appropriate references where needed.
19. The City Engineer has recommended that Policy 3.4 be
revised to delete the requirement for graded shoulders in
hillside areas.
Mr. Abbott said that going up a hill around curves is
exactly where you need to control drainage with curbs and
gutter.
CONSENSUS: By consensus, the Council determined to direct
staff to present a revised policy for Council consideration by
the meeting of April 29th.
20. Policy 3.6 is ambiguous. What is meant by "...preserve
the rural /open space image "?
CONSENSUS: By consensus, the Council determined to direct
staff to delete the words "rural /open space image" from Policy
3.6.
21. Should Policy 5.1 be revised to address new development
and redevelopment?
CONSENSUS: By consensus, the Council determined to direct
staff to revise Policy 5.1 to include new development and
redevelopment for presentation to the Council at the April
29th meeting.
22. Policy 5.4 addresses an Area of Benefit for bicycle path
construction. The implementation of this policy is
unclear.
Mr. Richards said that staff is recommending that language be
incorporated so that development projects are identified as
the funding source to pay for bicycle path construction.
CONSENSUS: By consensus, the Council determined to direct
staff to revise Policy 5.4 as suggested by Mr. Richards for
presentation to the Council at the April 29th meeting.

23. Policy 5.7 should be revised in regard to use of
sidewalks in hillside areas.
CONSENSUS: By consensus, the Council determined to direct
staff to rewrite Policy 5.7 for review by the Council at the
April 29th meeting.
24. The implementation section should include requirements
for the development of standards concerning pavement and
base thickness, dedicated intersection turn lanes, and
the use of medians for safety and aesthetic reasons.
CONSENSUS: By consensus, the Council determined to direct
staff to insert the appropriate language "shall be designed to
acceptable standards" or something approximately similar as
determined by staff; to be presented to the Council at the
April 29th meeting.
25. Should there be a reference that 6 -lane and 4 -lane
arterials typically have a raised median?
CONSENSUS: By consensus, the Council determined to direct
staff to include this reference in the text.
26. For level of service descriptions on ADT Capacities Table
and Table 1, should we reference that the information
should be based upon the current edition of the Institute
of Transportation Engineers (ITE) Trip Generation Report,
so there is never a dispute or requirement to update our
plan if the numbers change?
CONSENSUS: By consensus, the Council determined they had
already directed this to be done.
Councilmember Perez said that the definition was somewhat
vague.
Mr. Richards clarified that the level of service definitions
come from the 1985 Capacity Manual as referenced in the
footnote on Table I, page 16, of the Draft Circulation
Element.
Meeting Schedule /Work Program
Councilmember Montgomery stated that he felt the land use
designations decisions could all be made at the next meeting,
as well as review all the material that staff had been
instructed to provide to Council. He said that by the end of
the April 29th meeting staff could be directed to prepare the
necessary General Plan Update approval documents including the
Certification documents, the Statement of Overriding
Considerations, and all the other documents directed to be
delivered to the Council for the May 13th meeting. He said

the Council could then pass the resolutions and take the
appropriate action with regard to the Environmental Impact
Report and finalize the General Plan on May 13th.
Councilmember Montgomery said that within a week or two
following the conclusion of the General Plan, he would propose
a revised Comprehensive Planning Ordinance and would suggest
to the Council that they make such appropriate revisions to
Measure F to extend it for a period of 20 years and that both
measures be placed on the ballot in November.
Mayor Lawrason said that the implementation measures relative
to the General Plan Update needed to be accomplished first.
Councilmember Perez said the City should "move forward
cautiously ".
Councilmember Wozniak said that the emphasis had to be on
finishing the General Plan Update process and then the Council
could talk about the Comprehensive Planning Ordinance and an
update of Measure F.
Councilmember Talley said he agreed with growth control but
Councilmember Montgomery's plan might be "a little ambitious"
as there was still significant work left to complete relative
to the General Plan Update process.
In response to Mr. Kueny, Councilmember Montgomery suggested
that Councilmembers come to the meeting next week prepared
with the exact densities they believe should be in the General
Plan so that the matter could be decided upon at the beginning
of the meeting.
MOTION: Councilmember Montgomery moved and Councilmember Talley
seconded a motion to continue this item to a special meeting to be
held at 7:00 p.m. on April 29, 1992. The motion carried by
unanimous voice vote.
6. ADJOURNMENT:
MOTION: Councilmember Montgomery moved and Councilmember Talley
seconded a motion to adjourn. The motion carried by unanimous
voice vote. The time was 11:00 p.m.
