Moorpark, California June 29, 1992
A Special Meeting of the City Council of the City of Moorpark was
held on June 29, 1992 in the City Council Chambers of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 6:20 p.m.
Present: Councilmembers Montgomery, Perez, Talley,
and Mayor Lawrason.
Absent: Councilmember Wozniak.
Steven Kueny, City Manager.
2. CLOSED SESSION:
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to adjourn to Closed Session for a
discussion of A) Personnel; B) Personnel pursuant to
Government Code Section 54957.6. The motion carried by voice
vote 4 -0, Councilmember Wozniak absent for the vote.
Present in Closed Session were all Councilmembers but
Councilmember Wozniak; and Steven Kueny, City Manager.
The meeting reconvened into Open Session at 7:05 p.m. Mr.
Kueny stated that there was no action to report out of Closed
Session and only Closed Session items 2.A., and 2.B. were
discussed.
AT THIS POINT in the meeting a recess was declared. The time
was 7:06 p.m.
3. RECONVENE TO OPEN SESSION:
Mayor Lawrason called the meeting back to order at 7:15 p.m.
4. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Carol Hunt, Executive
Director of the Moorpark Chamber of Commerce.
5. ROLL CALL:
Present: Councilmembers Montgomery, Perez, Talley,
and Mayor Lawrason.
Absent: Councilmember Wozniak.

6. PUBLIC COMMENT:
June 29, 1992
Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Lt. Dean, Sheriff's
Department; Don Reynolds, Management
Analyst; Lillian Kellerman, City Clerk;
and Dorothy Vandaveer, Deputy City Clerk.
CONSENSUS: By consensus, the Council determined to waive the
Rules of Procedure to allow Bill McMahon to speak during the
discussion of the FY 92(93 Budget.
AT THIS POINT in the meeting, Mayor Lawrason requested the
addition of an item to the agenda regarding the Agricultural
Land Trust Advisory Committee (ALTAC) and their
recommendations for a conservation program in Ventura County,
need having arisen since the posting of the agenda.
MOTION: Mayor Lawrason moved and Councilmember Montgomery
seconded a motion to add as agenda item 8.B. Consideration of
the Agricultural Land Trust Advisory Committee Conservation
Program Recommendations, need having arisen since the posting
of the agenda. The motion carried by voice vote 4 -0,
Councilmember Wozniak absent for the vote.
7. PUBLIC HEARINGS:
C. Consider Proposed Assessments for "Parks Maintenance
Assessment District No. AD -85 -1" for the Fiscal Year
Commencing on July 1, 1992 and Ending June 30, 1993 and
Consider Resolution No. 92- , a Resolution Confirming
the Assessment for FY 1992/93. Staff Recommendation:
Adopt the resolution.
Mr. Kueny gave the staff report.
Ms. Kellerman stated that there were no speaker cards
received for this item.
Mayor Lawrason closed the public hearing.
Ms. Kellerman read an amendment to the proposed
resolution as follows:
Paragraph 4 of the resolution to be revised to read
"WHEREAS, the City Council finds that written
protests against the assessment have not been made
by owners representing more than one -half of the
area of land to be assessed;" and paragraph 5 to be
deleted in its entirety.

MOTION: Councilmember Perez moved and Councilmember
Montgomery seconded a motion to adopt the resolution as
amended by the City Clerk above.
Councilmember Montgomery stated that he would be voting
no on this item as he felt the assessment was premature
as there are not parks in all areas of the City.
Councilmember Talley stated that he concurred with
Councilmember Montgomery and for the same reason would
not be voting in the affirmative on this resolution.
MOTION: Councilmember Perez moved and Councilmember
Montgomery seconded a motion to Table the motion being
considered. The motion carried by voice vote 4 -0,
Councilmember Wozniak absent for the vote.
D. Consider Proposed Assessments for "Moorpark_ Lii hting and
Landscaping Maintenance Assessment District No. AD -84 -2"
for the Fiscal Year Commencing July 1, 1992 and Ending
June 30. 1993 and Consider Resolution No. 92- and
Resolution No. 92- ' Resolutions Confirming the
Assessment for FY 1992/93.
Staff Recommendation: Adopt the resolutions.
Mr. Kueny gave the staff report.
Ms. Kellerman stated that there were no speaker cards
received for this item.
Mayor Lawrason closed the public hearing.
MOTION: Councilmember Montgomery moved and Councilmember
Talley seconded a motion to adopt Resolution Nos. 92 -859 and
92 -860. The motion carried by roll call vote 4 -0,
Councilmember Wozniak absent for the vote.
CONSENSUS: By consensus the Council determined to consider
item 8.B.
8. ACTION /DISCUSSION ITEMS:
B. Consideration of the Agricultural Land Trust Advisory
Committee Conservation Program Recommendations and
Adoption of Resolution 92 -861 in Support.

Mayor Lawrason indicated that the Agricultural Land Trust
Advisory Committee (ALTAC) would be presenting its
recommendations to the Board of Supervisors tomorrow. He
indicated that the City should support ALTAC's
recommendations.
MOTION: Mayor Lawrason moved and Councilmember Montgomery
seconded a motion to adopt Resolution No. 92 -861 in support of
ALTAC's recommendations. The motion carried by voice vote 4-
0, Councilmember Wozniak absent for the vote.
AT THIS POINT in the meeting a recess was declared. The time
was 7:40 p.m. The meeting reconvened at 8:05 p.m.
CONSENSUS: By consensus the Council determined to return to
consideration of 7.C.
7.C. Consider Proposed Assessments for "Parks Maintenance
Assessment District No. AD -85 -1" for the Fiscal Year
Commencing on July 1, 1992 and Ending June 30, 1993 and
Consider Resolution No. 92 -862, a Resolution Confirming
the Assessment for FY 1992/93_. Staff recommendation:
Adopt the resolution.
Mr. Kueny reported that according to Section 22629 of the
Streets and Highways Code, action must be taken to adopt
the resolution no later than July 1st unless the County
Auditor authorizes a later date.

carried by roll call vote 2 -1, Councilmember Montgomery

A. Budget Workshop - FY 1992/93 Budget.
Staff Recommendation: Continue Council discussion of the
Budget.
Bill McMahon, 65 Third St., spoke representing the
Chamber of Commerce. He said that the Chamber is
requesting that the City reduce the amount owed by the
Chamber for the 1991 Country Days event and the 1991
Concert in the Sky event and is requesting a $10,000 co-
sponsorship amount from the City for the 1992 Country
Days event.
MOTION: Councilmember Montgomery moved and Councilmember
Perez seconded a motion to waive the Rules of Procedure and
accept a memo from Chamber of Commerce. The motion carried by
voice vote 4 -0, Councilmember Wozniak absent for the vote.
CONSENSUS: By consensus the Council determined to add an item
to the Council Agenda for July 15 to discuss the reduction of
the amount owed by the Chamber of Commerce.
Mr. Kueny went over the recommendations in his memo dated
June 29, 1992 regarding the 1992/93 Budget Adoption.
CONSENSUS: By consensus the Council determined to defer
Council action on the following until the State budget is
enacted and its impact can be considered by the Council and
staff: 1) Consideration of cost of living adjustments for
employees; 2) Allocation of available unreserved Gann Funds.
CONSENSUS: By consensus the Council determined to direct that
until the State budget is enacted and its impact can be
considered by the Council and staff: 1) No General Fund funded
capital outlay be made without subsequent City Council action;
2) No hires in new positions occur nor filling of full -time
vacancies occur except for the Director of Community Services,
Director of Community Development and Associate Planner
without subsequent City Council action; 3) No use of
additional hours above the number approved in 1991/92 for
part -time positions be used.
CONSENSUS: By consensus the Council determined to allocate
excess proceeds of taxes from FY 1990/91, not already
allocated to street improvements, to offset the Parks
Maintenance Assessment, thereby keeping the assessment at the
same level for FY 1992/93.
The Council reviewed the memorandum from the Deputy City
Manager, dated June 25, 1992, regarding the adoption of
the FY 1992/93 Budget.

Mr. Kueny indicated that all actions reported in the
memorandum would be considered part of the budget unless
Council directed otherwise.
CONSENSUS: By consensus the Council determined that the
following items presented in the Deputy City Manager's memo
would be considered a part of the FY 1992/93 Budget:
1. Funds and Chart of Accounts
Fund 45 for construction of a municipal pool and Fund 47 for
construction of a bicycle and equestrian trail to be
consolidated with the Park Improvement Fund (Fund 5) ; each of
these would be tracked separately within Fund 5.
Within the assessment district funds (Fund 23 and Fund 25)
zones of benefit and each park site will be tracked as
separate departments; the Lighting & Landscaping department
reference number is changed from 143 to 400 and the Parks
Maintenance department reference number is changed from 147 to
500.
2. Personnel Chanaes
Laborer hours are calculated at a rate of $7.41 per hour;
Laborer hours were reduced in Public Works -142 to 660 hours;
Maintenance Worker I position is authorized in Parks -147 which
is an increase of 1020 hours over the previous year; there is
a decrease in the Community Center -149 budget of part -time
Laborer hours from 520 hours to 200.
Additional Recreation Leader hours of 520 are authorized in
Recreation -148 anticipating the absence of the Recreation
Supervisor who will be on maternity leave. During the
Recreation Supervisor's absence, the Recreation Coordinator
will assume the responsibilities of the position and will
receive acting pay; with the additional Recreation Leader
hours there will be some additional support for the Recreation
Coordinator; the Recreation Coordinator position will be in a
new range with a change of 15 %.
The Community Services Director position is budgeted at step
D of the pay range for eleven months of the fiscal year.
Public Employees Retirement System (PERS) employer
contributions were reduced to take into account surplus
contributions in the system in excess of $25,000; the employer
portion of the contribution will be reduced each pay period
until the credit is eliminated.

The Management Analyst position in the Administrative Services
Department is reclassified to the position of Administrative
Services Manager with a 5% range adjustment.
Corrections to the rates of the Deputy City Clerk and the
Assistant to the City Manager have also been made in the
latest update of the personnel listing to show both of them at
their correct rate.
All of the personnel calculations include the continuation of
the raises for performance for eligible employees when
applicable; also included is the cost for an extra week of
administrative leave for eligible management employees,
exercise of this option dependent upon performance and review
by the City Manager and the City Council.
Part -time hours are increased in the City Clerk's department
adding 200 hours to the Records Clerk position and 100 hours
to the Clerical Aide position. Part -time hours were also
increased 200 hours for clerical aides in the Administrative
Services department.
The salaries for the Code Enforcement Officers and the
Secretary in the Planning Department are transferred to the
Community Development Fund (41).
The Director of Community Development position is budgeted at
step E of the pay range for ten months of the fiscal year.
Within the Police Services budget which is a contract cost and
not listed with regular personnel services, 2040 cadet hours
were added to provide assistance with administrative and
clerical tasks.
3. Departmental Operational Budgets
All changes to the departmental operational budgets as
outlined in the Deputy City Manager's and reflected in the FY
1992/93 Budget.
After further Council discussion, the following consensus
actions were taken:
CONSENSUS: By consensus the Council determined to direct a 5%
range adjustment for the Deputy City Manager.
CONSENSUS: By consensus the Council determined to direct that
three additional days of administrative leave be authorized
for the City Manager, Deputy City Manager, and City Clerk; two

days of additional administrative leave authorized for the
Deputy City Clerk for additional hours spent on the General
Plan adoption.
CONSENSUS: By consensus the Council concurred that the AB939
fees of $62,800 not expended for program cost should be
applied to personnel costs of the Solid Waste Department in
the amount of $59,274.
CONSENSUS: By consensus, the Council determined to use FY
1990/91 available Gann Fund monies for an emergency generator
($23,000); Youth Services ($20,000); and Charles Street
Improvements ($30,000) and to defer all other decisions
regarding use of available Gann Funds.
CONSENSUS: By consensus, the Council determined to establish
a Capital Projects Fund but defer until after the passage of
the State budget any contribution to that fund or the existing
Equipment Replacement Fund.
CONSENSUS: By consensus, the Council determined that they
would reverse the previous practice of charging street
improvements and maintenance expenses to LTF before the Gas
Tax Fund and instead transfer FY 1991/92 charges to the Gas
Tax Fund first and future FY 1992/93 and FY 1993/94 charges to
Gas Tax Fund first, thereby increasing the LTF fund balance as
much as possible to be used as the matching funds for the
State and Local Partnership Program.
CONSENSUS: By consensus, the Council determined that line
item 05.4.147.903 would reflect $5,000 for sidewalk to and
around the tot lot at Griffin Park, $300 for the tot lot
swings and $700 for security lighting at Griffin Park for a
total of $6,000.
Mr. Kueny requested a 3% contingency in salaries for
possible cost of living adjustment in the two assessment
districts so that if a cost of living increase is
approved at a later time in FY 1992/93, those salaries
funded from the assessment districts could share in that
increase.
CONSENSUS: By consensus, the Council determined to authorize
a 3% contingency in salaries for a possible cost of living
adjustment in the two assessment districts (AD -84 -2 and AD -85-
1) as requested by the City Manager.
Councilmember Perez requested that the Council look at
funding for Alzheimers and Aids after the impact of the
State budget is known.

Perez seconded a motion to adopt the FY 1992/93 Budget. The
motion carried by roll call vote 4 -0, Councilmember Wozniak
absent for the vote.
9. ADJOURNMENT:

voice vote 4 -0, Councilmember Wozniak absent for the vote.
