MINUTES OF THE CITY COUNCIL Moorpark, California June 21, 1993 An Adjourned Meeting of the City Council of the City of Moorpark was held on June 21, 1993 in the Council Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7:10 p.m. 2. ROLL CALL: Councilmembers Hunter, Perez, Montgomery, Wozniak and Mayor Lawrason. Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Mary Lindley, Assistant to the City Manager; Ken Gilbert, Public Works Director; and Lillian Hare, City Clerk. 6. PUBLIC COMMENT: None. 9. PUBLIC HEARINGS: B. Consider Making Certain Changes to the Parks Maintenance Assessment District (AD85 -1) and Confirming the Assessments for Fiscal Year 1993/94 Staff Recommendation: 1)Open the public hearing, receive testimony and continue this matter to the date of the Budget Workshop; 2) Subsequent to the Budget Workshop meetings, but no later than June 301 1993, adopt Resolution NO. 93- making certain changes to Ad 85 -1 and confirming the assessments for fiscal year 1993/94. (Continued item 9.B. from 6/2/93) Public Hearing is Open. There were no speakers for this item. CONSENSUS: By consensus, the Council determined to continue this matter to the meeting of June 23, 1993. C. Consider Making Certain Changes to the Lighting and Landscape Maintenance Assessment District (AD84 -2) and Confirming the assessments for Fiscal Year 1993/94 Staff Recommendation: 1)Open the public hearing, receive testimony and continue this matter to the date of the Budget Workshop; 2) Subsequent to the Budget Workshop meetings, but no later than June 30, 1993, adopt Resolution No. 93- making certain changes to Ad 84 -2 and confirming the assessments for fiscal year 1993/94. CONSENSUS: By consensus, the Council determined to continue this matter to the meeting of June 23, 1993. 11. ACTION /DISCUSSION: I. Consider the Parks and Recreation Commission Recommendation for a New Format for the Recreation Brochure. Staff Recommendation: Approve contract with Coast Media to produce thrice yearly recreation brochure with the inclusion of advertisements. This item was continued 6/23/93. J. Consider Resolution No. 93- Amending the Fiscal Year 1992193 Budget. Staff_ Recommendation: Defer action to approve Resolution No. 93- to proposed adjourned meeting. This item was continued to 6/23/93. K. Consider FY 1993/94 Budget. Staff Recommendation: Direct staff as deemed appropriate. The Council reviewed the draft FY1993/94 Budget requesting revisions to be provided to the Council on Wednesday, June 23, 1993. The Council also requested the following information: 1. Explanation and actual projected costs for line item 142.642 Contractual Services, general. 2. Explanation and actual projected costs for line item 142.658 Maintenance & Repairs, miscellaneous. L. Consider Proposed 1993/94 Objectives. Staff Recommendation: Direct staff as deemed appropriate. This item was continued to 6/23/93. 14. CLOSED SESSION: MOTION: Councilmember Montgomery moved and Mayor Lawrason seconded a motion to adjourn to Closed Session for a discussion of 14.A., 14.B., 14.E., and 14.F. of the items listed below: A. Personnel. Minutes of the City Council Moorpark, California 3 June 21, 1993 B. Personnel pursuant to Government Code Section 54957.6. C. Potential litigation pursuant to Government Code Section 54956.9 (b) (1) . D. Potential litigation pursuant to Government Code Section 54956.9(c). E. Negotiations for Real Property on the South Side of High Street (Southern Pacific /VCTC) pursuant to Government Code Section 54956.8. F. Negotiations for Real Property at 280 Casey Road (Moorpark Unified School District) pursuant to Government Code Section 54956.8. G. Litigation concerning Conejo Freeway Properties, LTD. vs. City of Moorpark. H. Litigation concerning City of Moorpark vs. Foster Enterprises. I. Litigation concerning Moorpark vs. CalTrans (Case No. 123655) J. Litigation concerning Villa del Arroyo vs. City of Moorpark (Case No. 105170) The motion carried by unanimous voice vote. AT THIS POINT in the meeting a recess was declared. The time was 9:57 p.m. The meeting reconvened into Closed Session at 10:03 p.m.. Present in Closed Session were all Councilmembers; and Steven Kueny, City Manager. The meeting reconvened into Open Session at 10:30 p.m. Minutes of the City Council Moorpark, California 4 June 21, 1993 CONSENSUS: By consensus the Mayor was directed to inform the Moorpark Unified School District of the Council's approval of the conceptual terms for the sale of the approximate 10 acre lower field portion of the Moorpark Memorial High School site including that portion of the site on the community center side of the drainage channel for $900,000 cash with six subsequent annual payments of $50,000 each; access as previously proposed by the City, land use consistent with the approved General Plan designation, and a slope easement for landscaping purposes. Mr. Kueny stated there was no action to report out of Closed Session and only item 14.F. had been discussed. 15. ADJOURNMENT: MOTION: Councilmember Montgomery moved and Councilmember Hunter seconded a motion to adjourn to Wednesday, June 23, 1993 at 7:00 p.m. The motion carried by unanimous voice vote. Paul W.
