Moorpark, California July 14, 1993
A Special Meeting of the City Council of the City of Moorpark was
held on July 14, 1993 in the Council Chambers of said City located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 6:28 p.m.
2. ROLL CALL: Councilmembers Hunter, Montgomery,
Wozniak and Mayor Lawrason.
Absent: Councilmember Perez.
Staff Present: Steven Kueny, City Manager; Richard
Hare, Deputy City Manager; Jim
Aguilera, Community Development
Director; Paul Porter, Senior
Planner; Chris Oberander, City
Engineer's Office, Lillian Hare,
City Clerk.
3. CLOSED SESSION:
MOTION: Councilmember Montgomery moved and Councilmember
Wozniak seconded a motion to go into Closed Session for
a discussion of: A) Personnel, B) Personnel pursuant
to Government Code Section 54957.6, and F) Negotiations
for Real Property at 280 Casey Road (Moorpark Unified
School District) pursuant to Government Code Section
54956.8. The motion carried by voice vote 4-0,
Councilmember Perez absent for the vote.
Present in Closed Session were all Councilmembers but
Councilmember Perez; and Steven Kueny, City Manager.
The meeting reconvened into Open Session at 7:04 p.m.
Mr. Kueny stated that only item B) Personnel pursuant to
Government Code Section 54957.6 was discussed and that
there was no action to report out of Closed Session.
AT THIS POINT in the meeting the Mayor declared a recess.
The time was 7:04 p.m.
The meeting was reconvened at 7:27 p.m.
4. PLEDGE OF ALLEGIANCE:
Mayor Lawrason led the Pledge of Allegiance.

5. PUBLIC COMMENT:
July 14, 1993
Eloise Brown, 13193 Annette Street, addressed the Council
regarding the proposed change in water rates. She
requested that the Council protest the rate increase.
Ethel Sulkis, 270 Sierra Avenue, addressed the Council
regarding the proposed water rate increase. She
requested the Council protest the rate increase.
Pat Bryan, 12418 Sunnyglen Dr., addressed the Council
regarding cat licensing. He indicated that he favored
the licensing of cats.
6. PUBLIC HEARING:
A. Consider Approval of the Citywide and Downtown Sign
Ordinance, for Inclusion in the City's Zoning
Ordinance as Article 10 anO the rescinding of
Article 10 of Ordinance Number 137. Staff
recommendation: Open the public hearing, receive
public testimony and close the public hearing;
determine that the proposed Citywide and Downtown
Sign Ordinance is categorically exempt pursuant to
Section 15061(b)(3) of the State California
Environmental Quality Act (CEQA) Guidelines in that
the proposed amendments to the Zoning Ordinance do
not have the potential for causing a significant
effect on the environment; and adopt the attached
.resolution, approving the attached Citywide and
Downtown Sign Ordinance to be codified as Article
10 of the City's Zoning Ordinance and rescind
Article 10 of Ordinance Number 137. (Continued
Item 9.F. from 6/16/93) PUBLIC HEARING IS OPEN.
Mayor Lawrason indicated that the public hearing
was still open.
Joy Cummings, 650 Bard Street, addressed the
Council regarding the draft Sign Ordinance and made
various comments and suggestions.
Paul Nissen, 487 Sherman Avenue, addressed the
Council regarding the draft Sign Ordinance. He
suggested that the signage the City had on High
Street was "okay ".

MOTION: Councilmember Montgomery moved and Councilmember
Wozniak seconded a motion to continue this matter, the
public hearing open, to a special meeting to be held on
July 28, 1993. The motion carried by voice vote 4 -0,
Councilmember Perez absent for the vote.
CONSENSUS: By consensus, the Council determined to hear
item 6.B. next.
7. ACTION /DISCUSSION:
B. Consider Ventura County Library Services Agency
Proposed Closure of the Moorpark Branch Library.
Staff Recommendation: Direct staff as deemed
appropriate. (Continued Item 11.K. of 7/7/93)
Mr. Kueny gave a. brief staff report. He indicated
that the Librar- was to remain open from 3:00 p.m.
- 7:00 p.m. Monday and Tuesday, from 1:00 p.m. -
5:00 p.m. Wednesday, Thursday and Saturday, for a
total of 20 hours per week.
Mayor Lawrason commented that while the County is
moving forward on an expansion of the Moorpark
Library, the hours are being reduced.
In response to Councilmember Montgomery, Mr. Kueny
said that during their last.discussion Supervisor
Howard indicated that she thought the Library
expansion would remain in place in spite of the
County budget reductions.
Councilmember Montgomery suggested that a study be
done to determine if rather than expanding the
Library, those funds could be used to supplement
Library hours. He also suggested that the City
enter into discussions with the County regarding
the City contracting to operate the Library
facility for an amount equal to the taxes the
citizens of Moorpark are paying for library
services.
Councilmember Wozniak concurred with Councilmember
Montgomery indicating that while the size of the
Library was to be expanded there were no funds
allocated for books. He said he would also support
considering breaking away from the County library
district.

Mayor Lawrason said he also concurred.
The following public speaker was heard:
Gerald Goldstein, 11932 Los Angeles Avenue,
addressed the Council and asked who owns the books
and furnishings in the Library.
MOTION: Councilmember Montgomery moved and Councilmember
Hunter seconded a motion to assign the Budget and Finance
Committee consideration of this matter, the Committee to
report back to the Council regarding discussions with the
County relative to using the funds "earmarked" for
expansion to supplement Library hours for this fiscal
year and the City's contracting to operate the Moorpark
Library for an amount equal to the taxes the citizens of
Moorpark are paying for library services. The motion
carried by voice vote 4 -0, Councilmember Perez absent for
the v -te.
A. Consider Revisions to the City's Zoning Ordinance -
City of Moorpark. Staff Recommendation: Review
the revisions to the Zoning Ordinance. (Continued
Item 11.H. from 6/16/93)
Mr. Aguilera gave the staff report. He said the
document will need to go back to the Planning
Commission and through the public hearing process
and then be returned to the Council for final
approval.
Mr. Kueny requested that the Council include
addressing zoning on school sites relative to the
Government Code and the College District request
for an open air event.
COLLEGE DISTRICT OPEN AIR REQUEST
Mr. Aguilera presented a letter from the Campus
Hills Home Owners Association indicating the HOA's
support. He said it was staff's recommendation to
use a similar process to the one that was used for
Monika's -- a temporary zone clearance issued until
the new zoning ordinance is adopted after which a
zone change would be needed and a conditional use
permit application made.

In response to Councilmember Montgomery, Mr.
Aguilera said the College District needs approval
by September. He indicated that staff can meet
this timeframe.
CONSENSUS: By consensus, the Council determined that a
temporary zone clearance be issued until the new zoning
ordinance is adopted after which a zone change would be
needed and a conditional use permit application made; the
temporary zone clearance approved from September to the
date of the adoption of the Zoning Ordinance.
PLANNING ORDINANCE
CONSENSUS: By consensus, the Council directed the
Planning Commission to look at and provide their input as
to what uses are proper in the open space zone; and
directed the Planning Commission to look at increasing
setbacks as lot size increases.
CONSENSUS_ By consensus, the Council determined that the
final document should be printed on both sides using the
smallest margins and type possible in order to save
"Xerox trees ".
In response 'to Councilrmember Wozniak, Mr. Kueny
suggested that the Council separately adopt
lighting standards and have the Planning Commission
review the subject and look at eliminating upward
light spillage.
AT THIS POINT in the meeting the Mayor declared a recess.
The time was 9:20 p.m. The Council reconvened at 9:35
p.m.
The Council discussed revisions made to the draft
Zoning Ordinance and requested the following
further revisions:
Page 7 - Cheryl Kane to review the definition for
"Church ".
Page 20 - Vehicle Abandoned to read "Abandoned
Vehicle "; highlighted wording to be "cleaned up" by
staf f .
Page 20 - Swap Meet - following "garage sales"
insert" as referenced in Section 5188 of Title 5 of
the Municipal Code.

Page 33 - "I" for Institutional Use to be added to
the chart.
Page 34 - An open circle character to be added
under OS for Churches.
CONSENSUS: By consensus, the Council determined to
direct the Planning Commission to review the church in
Open Space issue and provide a recommendation to the
Council.
Page 45 - Sec. 8106 d. regarding parking of
recreational vehicles in driveways to be considered
by Planning Commission. The Council determined
that RV's should be allowed to be parked in
driveways if a sight distance problem is not
created. Also, Real Estate professionals within
the City should be made aware of the final
requirement in this portion of the ordinance.
Page 46 - Parking in Setbacks - add "width" after
"30 feet total... f°
Page 59 - Permitted Uses - Planning Commission to
review visibility of satellite dish antennas from
adjacent properties and make a recommendation.
Page 61 - 10 of general provisions (at the top of
the page) to be revised to include the words "where
applicable ".
Page 62 - Staff to define what is a pet and what is
a farm animal.
Page 63 - Chart - to be checked by staff to see if
Ventura County has revised animal units. Chart to
be revised relative to when animal units are not
permitted in Residential Planned Developments
(RPD's).
Page 64 - Include miniature horses in list of
animal types.
Page 97 - y. Mobilehome parks, resident parking -
Planning Commission directed to look at returning
to previous language.
Page 106 - Off - Street Loading and Unloading Spaces
- may be waived by the Director if a future loading
zone can be accomodated.

Page 110 - Commercial Vehicles Prohibited in
Residential Zones - staff to research the bus for
the handicapped which may be parked in a
residential zone and need to be excepted from this
provision.
Page 113 - d. to read "Sum of side yards on any
lot: minimum of eighteen feet."
Page 114 - f. to read "Minimum setback from a rear
lot line: thirty (30) feet for a house..."
Page 114 - a. to read "Measuring from the property
line, a minimum landscaped setback of twenty -four
(24) feet..."
Page 142 - Conditional Use Permit - to read,
"Conditional Use Permits may be granted through a
public hearing process by the City Council or the
Planning Commission."
Page 156 - Permit Adjustment - the Council directed
that the Planning Commission consider a "not to
exceed" figure or other "ceiling" for this
provision.
MOTION: Councilmember Montgomery moved and Councilmember
Wozniak seconded a motion to return the Zoning Code
document to the Planning Commission with the direction to
begin the public hearing process. The motion carried by
voice vote 4 -0, Councilmember Perez absent for the vote.
C. Consider Proposed 1993194 Objectives. Staff
Recommendation: Direct staff as deemed
appropriate. (Continued Item 11.L. from 6/16/93;
Item 11.L. from 7/7/93)
CONSENSUS: By consensus, the Council determined -to
continue this matter to the regular meeting of July 21,
1993.
8. CLOSED SESSION:
MOTION: Councilmember Montgomery moved and Councilmember
Hunter seconded a motion to adjourn to Closed Session for
a discussion of 9.A., 9.B. and 9.F, listed below:

The motion carried by voice vote 4 -0, Councilmember Perez
absent for the vote.
AT THIS POINT in the meeting a recess was declared. The
time was 10:30 p.m.
The Council reconvened into Closed Session at 10:45 p.m.
Present in Closed Session were all Councilmembers but
Councilmember Perez; and Steven Kueny, City Manager.
The meeting reconvened into Open Session at 11:20 p.m.
Mr. Kueny stated that only items 8.B. and 8.F. were
discussed and that there was no action to report out of
Closed Session.
