CALL TO ORDER: Mayor Lawrason called the meeting back to order at 7:16 p.m. 3. ROLL CALL: Present: 6. PUBLIC COMMENT: None. 11. ACTION /DISCUSSION: Councilmembers Hunter, Montgomery, Perez, Wozniak and Mayor Lawrason Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Jaime Aguilera, Director of Community Development; Christine Adams, Director of Community Services; Lt. Dean, Sheriff's Department; Mary Lindley, Assistant to the City Manager; Don Reynolds, Administrative Services Manager; Steve Hayes, Economic /Redevelopment Manager; and Lillian Hare, City Clerk 4 A. CONSIDER PROPOSED 1993194 OBJECTIVES. Staff Recommendation: Direct staff as deemed appropriate. (Continued Item 11.A. from 8/18/94.) Mr. Kueny recapped the previous discussion and Council action on the 1993/94 Objectives. Following is the Council's action this evening regarding each division: Community Services Double stars denoting top priority: 2. In conjunction with the Community Development Department, review and process modification of the Open Space Conservation and Recreation (OSCAR) Element for consistency with the other General Plan elements. Revise park land dedication ordinance and Park Master Plan including evaluation of existing Park Improvement Fund Zones. 4. Coordinate City's participation in contract at -risk youth programs. 6. Develop a Department procedures manual. Recreation Double stars denoting top priority: 1. Develop recreation programs targeting teens and at- risk youths. 2. Provide recreation staffing for programs and activities for Senior Citizens. 4. Evaluate feasibility of establishing a teen center. 5. Provide activities for physically challenged persons. Added item: * 17. Develop a prototype for marquee signs to announce community events. Parks Double stars denoting top priority: 4. Assess feasibility of performing additional park maintenance functions by City staff. 5. Develop proposed funding plan for completion of Arroyo Vista Community Park (part of 5 year CIP). 6. Coordinate with homeowners in the Villa Campesina development for the improvement of the required neighborhood park. 14. Investigate expansion of Arroyo Vista Community Park by incorporating use of adjacent Southern California Edison property. Facilities Double stars denoting top priority: 3. Develop maintenance program for new Arroyo Vista Community Park building. Landscaped Parkways Double stars denoting top priority: 1. In conjunction with Public Works Department, plan, design and install improvement of currently unimproved parkways and medians at various locations. 7. Evaluate options for performing maintenance for City managed areas. New Single stars denoting high priority: 4. Develop and implement a program to effectively and efficiently reduce water consumption and reduce overspray onto streets and sidewalks. Cable Double stars denoting top priority: 1. Administer government channel (Channel 10) operations. 5. Film 200 hours of Moorpark activities for replay supporting public information and community promotion efforts and evaluate the feasibility of filming a video about Moorpark City government. City Manager Double stars denoting top priority: 4. Further develop the City's customer service program to include employee training and quarterly employee meetings with an emphasis on customer service practices. 7. As Executive Director, direct redevelopment agency activities under the day -to -day management of the Deputy City Manager and assist with establishing redevelopment priorities and develop and implement expenditure plan for bond proceeds. Work with County, State and Federal officials to ensure that Moorpark's legislative interests and concerns are addressed and establish a legislation program which would allow the City to respond on a more timely basis to pending State and Federal legislation. Special Projects Double stars denoting top priority: 1. Assist in the acquisition and development of a downtown park. 4. Assist with implementation actions as follow up to General Plan Update including traffic mitigation program, and other items of potential impact to City services and facilities, and preparation of specific plans and modifications to Recreation Element. 5. Assist with development of Citywide Traffic Mitigation program and coordination with Ventura County on traffic impact matters. 12. Evaluate options for providing Library Services. 14. Coordinate City's efforts for proposed transfer of Waterworks District No. 1 to the City. Added direction: Agendize No. 16., "Consider use of funds provided by developer of Tract 3963 for other than affordable housing purposes." Leave No. 19, "If directed by the City Council, coordinate City's effort in evaluating Fire Protection District revenue, costs and services ", on the list without a star. Budget and Finance Committee to initiate meetings with the County Supervisor regarding a proposed transfer of Waterworks District No. 1 to the City. Public Transit Double stars denoting top priority: 1. Pursue a marketing program to increase ridership on City bus system and assist with the marketing program for commuter rail and Amtrak services. f, 4. Work with VCTC and other East County jurisdictions to facilitate regional transit linkage. 7. Evaluate cost benefit of purchasing a City owned bus for use by City's transit contractor. Added item to be double starred: 9. Investigate feasibility of obtaining Section 9 Federal funds for transit purposes. Work with the refuse haulers to develop and implement an industrial and commercial recycling program. 3. Work with the refuse haulers to develop and implement a green waste program. 10. Assist with the development and implementation of a recyclable household hazardous waste collection program in coordination with the one or more other public agencies. 12. Evaluate feasibility of implementing a variable can rate structure or similar alternatives for residential refuse collection. Single stars denoting high priority: 2. Participate in regional solid waste planning efforts and formation of a Regional Waste Authority. 5. Organize and implement a Christmas tree recovery program. 6. Develop educational and public awareness programs utilizing the City's cable television channel and other media forms. 8. Conduct workshops on composting and seek a demonstration site. 14. Coordinate the City's implementation of the Countywide Recycling Market Development Zone (RMDZ) among the City Departments, and serve on the County Economic Development /Recycling Market Development Zone Subcommittee. 17. Evaluate the Commercial Refuse Franchise Agreements (expiring June 30, 1994) and Residential Franchise Agreements (expiring June 30, 1995). Provide training for staff in emergency response procedures and responsibilities. 7. Develop a program to regularly inform the public about the need to adequately prepare themselves for a potential disaster. Single stars denoting high priority: 1. Develop a list of equipment and resources needed in the City's Emergency Operation Center to respond to an emergency. City Attorney Double stars denoting top priority: 6. Develop operating procedures to ensure final review of all ordinances before placement on agenda for first reading. 4 Administrative Services Double stars denoting top priority: 8. Implement provisions of the new Cable Act regulations and revised fee regulations. 9. Retain a contract firm to review and analyze the City's and Redevelopment Agency's property tax receipts. 12. Prepare in -house work space needs study for approved and potential personnel additions including in -house building inspector and City Engineer. 13. Coordinate City's downtown improvement efforts and develop prioritized list of improvements. 2. Develop for City Council consideration and adoption and implement a business attraction, promotion and retention plan `including provisions for working with the business and development community to increase sales tax capture. 9. Manage the activities of the Moorpark Redevelopment Agency including development and implementation of a work program and Capital Improvement Plan (CIP) and coordination of Project Area Advisory Committee (PAAC) participation. Assist with the preparation of a standard lease agreement. Identify revenue sources to support police activities and recovering costs. 2. Participate in the Sheriff's Department Disaster Plan exercises and coordinate with the City's Disaster Plan. 7. Complete EMT Certification for deputies. Single stars denoting high priority: 4. Work with City's Ad Hoc Committee and County's Gang Task Force in developing techniques for addressing gang and at -risk youth issues. 6. Assist with evaluation and possible preliminary planning for future Moorpark Police Station. Public Safety Investigation Single stars denoting high priority: 1. Increase the number of investigated criminal cases by 20 %. Public Safety Traffic Enforcement 1. Obtain OTS funding for Spanish Language Traffic Enforcement program. 2. Provide at least 200 hours of commercial vehicle enforcement. P. Consider Adoption of the Proposed Ordinance No. Control and Abatement of Graffiti. Staff Recommendation: Direct staff as deemed appropriate. Mary Lindley gave the staff report. In response to Councilmember Montgomery, Ms. Lindley said that as per the City Attorney's recommendation, whenever possible prosecution,would be made under state law. If an offense was not covered under penal code, the City ordinance would be used. Minutes of the City Council Moorpark, California Page 11 September 15, 1993 Mayor Lawrason said that the broad tip markers need to be included in the ordinance. Councilmember Hunter said that he agreed with Mayor Lawrason that broad tip markers need to be included in the ordinance. Councilmember Wozniak said that he "feels okay" about putting in the broad tip markers or leaving them out. He said if markers are to be defined as graffiti implements, it is important to have the exceptions in the ordinance. In response to Councilmember Perez, Lt. Dean said that Deputies won't arrest anyone simply for possession of the markers unless the Deputies can articulate the persons intent on paper. He said he would write enforcement guidelines that will outline caution. Councilmember Perez said he could agree to put broad tip markers back in the ordinance. CONSENSUS: By consensus the Council determined to define broad tip markers as a graffiti implement in the ordinance. Councilmember Montgomery said he would like to see "intent" clearly indicated as part of the language of the ordinance. Gerald Goldstein, 11932 Los Angeles Avenue, indicated his opposition to the ordinance. Councilmember Montgomery said the City should not enter other people's property without their consent to abate graffiti. Ms. Lindley said that the Council might want to consider the City Attorney's recommendation that three choices be given property owners: 1)to self abate; 2) to allow the City to abate; 3) for the City to prosecute to force abatement. CONSENSUS: By consensus the Council determined to accept the City Attorney's recommendation as stated above by Ms. Lindley. In response to Councilmember Montgomery, Mr. Kueny said that the City Council not staff would make the decision to prosecute. Minutes of the City Council Moorpark, California Page 12 September 15, 1993 Councilmember Montgomery said he would like to codify the City Council's authority to make the decision to prosecute rather than do it by policy. In response to Councilmember Perez, Mr. Kueny said that the City will abate graffiti on residential property if there is a public impact but commercial /industrial property owners must pay for the abatement. In response to Councilmember Hunter, Ms. Lindley said that other Cities have language in their graffiti ordinances regarding collecting indirect costs but the City Attorney has said that such language might not be defensible. In response to Council question, Mr. Kueny indicated that staff would ask the 'City Attorney if language stating "consistent with applicable sections of local and state law" can be included in the ordinance. Councilmember Montgomery suggested that staff notify the businesses which will be affected by the graffiti ordinance, because of their sale of broad tip markers, before the ordinance comes back to the Council. CONSENSUS: By consensus, the Council determined to direct staff to bring the ordinance back to the first Council meeting in October after another review by the City Attorney. Councilmembers Perez and Montgomery requested that Lt. Dean provide a written enforcement policy and procedures for changing that policy after the ordinance is adopted. 14. CLOSED SESSION: MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to adjourn to Closed Session for a discussion of 14.A. Personnel, 14.F. Negotiations for Real Property at 280 Casey Road (Moorpark Unified School District) pursuant to Government Code Section 54956.8., 14.M. Negotiations for Real Property on the North Side of Los Angeles Avenue contiguous to Mission Bell Plaza (Ken McLeod) . The motion carried by unanimous voice vote. The time was 9:45 p.m. The meeting reconvened into Closed Session at 9:50 p.m. Present in Closed Session were all Councilmembers; and Steven Kueny, City Manager. The meeting reconvened into Open Session at 10:16 p.m. Mr. Kueny stated there was no action to report out of Closed Session and only items 14.A., 14.F. and 14.M were discussed. 15.
