HomeMy WebLinkAboutMIN 1993 1027 CC ADJMINUTES OF THE CITY COUNCIL Moorpark, California October 27, 1993 A Regular Adjourned Meeting of the City Council of the City of Moorpark was held on October 27, 1993 in the Council Chambers of said city located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7:12 p.m. 2. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Councilmember Montgomery. 3. ROLL CALL: Present: Councilmembers Montgomery, Perez, Wozniak and Mayor Lawrason Absent: Councilmember Hunter Staff Present: Steven Kueny, City Manager; Cheryl Kane, City Attorney; Ken Gilbert, Public Works Director; Mary Lindley, Assistant to the City Manager; Don Reynolds, Administrative Services Manager; Paul Porter, Senior Planner; and Lillian Hare, City Clerk 5. REORDERING OF AND ADDITIONS TO THE AGENDA: CONSENSUS: By consensus, the Council determined to continue item 11.F. to the meeting of November 3, 1993 and hear item 11.E. first. 6. PUBLIC COMMENT: None. 11. ACTION /DISCUSSION ITEMS: E. Consider Approval of the Proposed City Bus Route Revisions. Staff Recommendation: Approve the City bus route revisions. Ms. Lindley gave the staff report. In response to Mayor Lawrason, Ms. Lindley said that comments were received from Villa del Arroyo residents. Minutes of the City Council Moorpark, California 2 October 27, 1993 In response to Councilmember Perez, Ms. Lindley indicated that there had been no discussion of expanding the bus route to the original Buttercreek area. MOTION: Councilmember Wozniak moved and Councilmember Perez seconded a motion to approve the staff recommendation to revise the bus route to delete sections of the route along Southhampton and Christian Barrett and the loop up Mountain Trail and down Mountain Meadow, which would be replaced by stops on Tierra Rejada at Mountain Trail and Mountain Meadows and to extend both paratransit and fixed route service to the Villa del Arroyo Mobile Home Park. The motion carried by voice vote 4 -0, Councilmember Hunter absent for the vote. D. Consider Draft Ordinance for Cat Licensing Ordinance and Proposed Plan for Implementation. Staff Recommendation: Direct the first reading of Ordinance No. 182, and approve staff's plan for implementation of the program. (Continued Item 11.E. from 10/6/93). Mr. Reynolds gave the staff report. In response to Councilmember Wozniak, Mr. Reynolds indicated that the date of December 4, 1994 would be the date on which, and thereafter, citations would be issued, certificates of sterility be required and valid rabies vaccination certificates need to be provided in compliance with the ordinance. Cynthia Slater, 484 E. Los Angeles Avenue, spoke against cat licensing. She proposed a low cost spay and neuter clinic instead. The City Clerk read the ordinance title. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to read the ordinance title only. The motion carried by voice vote 4 -0, Councilmember Hunter absent for the vote. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to waive further reading and declare Ordinance 182 introduced as read. The motion carried by voice vote 4 -0, Councilmember Hunter absent for the vote. Minutes of the City Council Moorpark, California 3 October 27, 1993 F. Consider Resolution No. 93- Establishing Parkin Restrictions to Facilitate Street Sweeping. Staff Recommendation: Staff and the Transportation and Streets Committee recommend that the City Council adopt Resolution No. 93- providing for the establishment of parking restrictions to improve the quality of street sweeping; approve revised street sweeping schedule as of November 1, 1993. This item was continued to November 3, 1993. K. Consider Inclusionary Zoning as a Strategy for the Provision of Affordable Housing in New Residential Areas and in the Moorpark Redevelopment Project Area. Staff Recommendation: 1) Direct staff to work with the Economic Development /Affordable Housing Committee and City Attorney to develop a draft inclusionary zoning ordinance for new residential projects and the Moorpark Redevelopment Area. 2) Provide any desired specific direction to the Committee and staff pertaining to the components of the proposed ordinance. Ms. Traffenstedt gave the staff report. In response to Councilmember Wozniak, Ms. Traffenstedt said at this point the suggestion is that inclusionary zoning be considered citywide. Dee Boyson Zinke, 24005 Ventura Blvd, Calabassas, representing the Building Industry Association, went on record concerning the BIA's concerns about inclusionary zoning. She said they don't think inclusionary zoning is a workable solution to affordable housing. She asked to be included in discussions relative to this matter. In response to Councilmember Perez, she said she would provide a copy of correspondence from the State with their (the State's) concerns regarding inclusionary zoning. Mayor Lawrason said he would support but he had some reservations. Minutes of the City Council Moorpark, California 4 October 27, 1993 MOTION: Mayor Lawrason moved and Councilmember Perez seconded a motion to direct staff to work with the Economic Development /Affordable Housing Committee and City Attorney to develop a draft inclusionary zoning ordinance for new residential projects and the Moorpark Redevelopment Area. The motion carried by voice vote 4 -0, Councilmember Hunter absent for the vote. L. Consider Shopping_ Cart Theft Ordinance. Staff Recommendation: Direct staff as deemed appropriate. Gerald Goldstein, 11932 Los Angeles Avenue made comments regarding shopping carts. Councilmember Montgomery said he had requested this item be placed on the agenda because of calls he received from residents. Councilmember Wozniak suggested that the Business and Professions Code section regarding this matter should be combined with the draft ordinance that Councilmember Montgomery provided to address the specifics of problems with this matter in Moorpark. He said he was concerned that the businesses not be hindered because of costs or fees associated with the enactment of such an ordinance. Mayor Lawrason voiced his concerns that a burden not be placed on the shopping cart owners. He said he also did not want the City to be involved as an enforcer except at a nninimum level. CONSENSUS: By consensus, the Council determined to invite the Grocery Industry Association representative and all markets in the City that own shopping carts to the Council meeting of November 17, 1993 at which time this matter would be discussed. The motion carried by voice vote 4 -0, Councilmember Hunter absent for the vote. M. Consider Revisions to the City's Zoning Ordinance - City of Moorpark. Staff Recommendation: Review the revisions to the Zoning Ordinance. Mr. Porter gave the staff report. The Council took the foLLowing consensus actions: Minutes of the City Council Moorpark, California 5 October 27, 1993 CONSENSUS: By consensus, the Council determined to modify the definition of "Animals, Farm" on page 3 of the draft ordinance to include miniature horses but requested staff provide more realistic height and weight measurement allowances; the definition of pot bellied pigs to remain as recommended by the Planning Commission. CONSENSUS: "Airfields and Landing Strips" to remain unchanged from the current ordinance to allow them in the Open Space zone with Planning Commission approval of a conditional use permit. CONSENSUS: By consensus, the Council determined that for four and six lane arterials, a minimum of 10 ft. of landscaping behind the property line would be required and a 30 ft. building setback. CONSENSUS: By consensus, the Council determined that for two lane arterials, a minimum of 10 ft. of landscaping behind the property line would be required and a 20 ft. of building set back. CONSENSUS: By consensus, the Council determined to delete "bus" from Section 8106 -5 d, of the draft ordinance relative to parking in setback areas. CONSENSUS: By consensus, the Council determined to delete 10. from Section 8107 -1.9 b. relative to satellite dish antennas; a resolution to be enacted to set forth the process as to when HOA's and /or adjacent neighbors are required to give consent_ CONSENSUS: By consensus, the Council determined to agree with the Planning Commission recommendation clarifying parking for schools as being for "non public" schools. CONSENSUS: By consensus, the Council determined to maintain consistency by not allowing compact parking spaces. The Council requested information on the requirements /demand for theater parking. CONSENSUS: By consensus, the Council determined that in Sec. 8108 -1.1 a cap of 20% would be set on allowable reduction of parking spaces for off- street parking for mixed uses where it can be demonstrated that the peak hour parking for eacti of the uses does not compete with each other. Minutes of the City Council Moorpark, California 6 October 27, 1993 CONSENSUS: By consensus, the Council determined to allow tandem parking in church parking lots. CONSENSUS: By consensus, the Council determined to approve the Planning Commission recommendations for development standards for the RPD zone with the exception that "e", under Section 8109 -2.3.2 would not be deleted and would read "Minimum distance between structures that are separated by a side lot line and do not share a common wall: twelve feet for single story; 15 feet for two story." CONSENSUS: By consensus, the Council determined to direct the City Attorney to give an opinion on Sections 8109 -2.3.3 and 8109- 2.3.=, relative to setbacks and whether these sections are consistent with or superseded by either Section 8116- 2.3.2(a) of the Zoning Ordinance or provisions for density bonuses as found in the Government Code. CONSENSUS: By consensus, the Council determined to revise Section 8111 -7.1.4 (a), regarding allowable, one per year, permit adjustment, to read "An increase or decrease of not more than ten percent in floor or permit area and up to or not more than 5,000 square feet ". MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to approve continuance to November 1.7, 1993, to direct staff to make the changes to the draft ordinance as directed by the Council this evening, and to adopt Resolution 93 -982 instructing the Planning Commission to consider proposed changes to the City's zoning ordinance pertaining to large day care facilities. The motion curried by voice vote 4 -0, Councilmember Hunter absent for the vote. 13. FUTURE AGENDA ITEMS: Councilmember Wozniak reported to the Council that he had requested the City Manager to investigate the light intrusion from Conejo Ready Mix. In response to Council question, Mr. Kueny said that the weekend staff would be instructed to pick up signs from the public right- off -way. CONSENSUS: By consensus, the Council determined to direct staff to make an immediate response to a letter received from Caltrans relative to their delaying landscaping along the nev freeway connector.
