Moorpark, California November 10, 1993
A Special Meeting of the City Council of the City of Moorpark was
held on November 10, 1993 in the Council Chambers of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER: '
Mayor Lawrason called the meeting to order at 7:15 p.m.
2. PLEDGE OF ALLEGIANCE:
Councilmember Perez led the Pledge of Allegiance.
3. ROLL CALL: Councilmembers Hunter, Montgomery, Perez,
Wozniak and Mayor Lawrason
Staff Present: Steven Kueny, City Manager; Cheryl Kane,
City Attorney; Jaime Aguilera, Director
of Community Development; Paul Porter,
Senior Planner, Dirk Lovett, Assistant
City Engineer, and Dorothy Vandaveer,
Deputy City Clerk.
4. PUBLIC HEARING:
A. Consider Amendments to the Carlsberg Specific Plan and
Draft EIR, Amendment to Land Use Element of the General
Plan to Reflect Amended Land Uses. and Amendment of the
City's Zoning Ordinance to Adopt Amended Land Use
Regulations of Specific Plan as Zoning for the Property -
Carlsberg Financial Corporation - Staff Recommendation:
1) Certify the Final EIR, and 2) direct staff as deemed
appropriate regarding revisions to the Specific Plan.
Mayor Lawrason opened the public hearing.
The Deputy City Clerk stated that an affidavit of
publication for the Notice of Public Hearing is on file
in the City Clerk's office and that the hearing was duly
noticed as prescribed by law.
Ron Tankersley, 2800 28th Street, Suite 200, Santa
Monica, addressed the Council and identified the changes
that occurred in the Carlsberg Specific Plan redline
draft document. Mr. Tankersley outlined the proposed
changes in the grading, landscape and open space land
usage. He answered questions of Councilmembers about the
aspects of each.
Lynn W. Crockatt, 137¢8 Christian Barrett Drive, spoke in
favor of moving forward with the approval of the

Carlsberg project. He said he believes Carlsberg has
been responsive to the needs of the community and the
City and should be allowed to proceed with development.
Janet Murphy, 15308 Seitz Court, spoke as a
representative of the Environmental Coalition. She
stated that her concerns are that the environmental
aspects of the project be seriously considered and
addressed. She indicated that she is disturbed by the
34% loss of oak trees in the project. Ms. Murphy also
indicated that as much landscaping as possible should be
done utilizing existing the natural plants.
Mayor Lawrason questioned the 34% loss of oak trees with
this project and said the intention is to preserve the
majority of the oak trees.
Margaret Kirnig, 10725 Citrus Drive, spoke as a member of
the Board of Directors of the Environmental Coalition of
Ventura County. She indicated that household poisoning
from area houses once the project is built will be
damaging to the vernal pools that have been found to
exist in this area. She continued by stating that the
vernal pools are extremely rare and fragile and requested
that the watershed in that area be left intact and
undisturbed.
Dan Wallman, 4210 Laurelhurst Road, said his biggest
concern is the prominent hillside along Spring Road that
is being scaled down. He said the ridgeline is important
and he hopes the conceptual view he has seen is what it
will actually look like. He also mentioned that the lack
of a regular park in the project is a detriment and that
he believes putting d park in the institution area is a
great idea.
Roseann Mikos, 14371 E. Cambridge Court, spoke
representing the Environmental Coalition. She said there
are many positives associated with the project, but she
is concerned that the vernal pools and other habitat be
protected as much as possible. She also indicated that
page 567 of the Specific Plan does state that 34% of the
trees will be removed.
Ron Tankersley responded to the percentage of tree
removal by stating that it is not their intent to remove
or damage the oak trees, but there are some specific
pepper trees that will have to be removed. In response
to the protection of the vernal pools, he said vernal

pools can be created from cow wallows. He continued by
stating that there have been extensive studies done to
prove that the watershed is not how you charge a vernal
pool. He said Carlsberg is providing a separate drainage
system to provide the pool with runoff water and believes
they have been more than generous in providing a feasible
plan.
Mayor Lawrason closed the public hearing.
Councilmember Montgomery said he prefers to have
subsequent discussion on this subject when they have the
final EIR documents.
AT THIS POINT in the meeting, Mayor Lawrason declared a
recess. The time was 9:05 p.m. The meeting reconvened
at 9:25 p.m.
MOTION: Councilmember Montgomery moved and Councilmember
Wozniak seconded a motion to direct staff to prepare the final
Environmental Impact Report for Specific Plan No. 8 and to
bring it forth for consideration at a meeting to be held
November 291 1993 at 7:00 p.m. The motion carried by
unanimous voice vote.
5. ADJOURNMENT:
MOTION: Councilmember Montgomery moved and Councilmember
Perez seconded a motion to adjourn the meeting. The motion
carried by unanimous voice vote.
Mayor Lawrason adjourned the meeting at 9:30 p.m.
