Moorpark, California January 13, 1993
A Special Meeting of the City Council of the City of Moorpark was
held on January 13, 1992 in the Council Chambers of said City
located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 9:10 p.m.
2. ROLL CALL:
Present: Councilmembers Hunter, Montgomery, Perez,
Wozniak, and Mayor Lawrason.
Steven Kueny, City Manager; Richard Hare,
Deputy City Manager; Cheryl Kane, City
Attorney; Jaime Aguilera, Director of
Community Development; Paul Porter,
Senior Planner; Lillian Hare, City Clerk.
3. ACTION /DISCUSSION:
A. Consider Revisions to the citv's zonina Ordinance.
Staff Recommendation: Review the proposed changes
and advise staff of any additional changes to the
zoning ordinance. (Continued Item 9.A. from
12/16/92) PUBLIC HEARING REMAINS OPEN
Mayor Lawrason stated that the public hearing was
still open.
John Newton, 165 High Street, Ste. 204, addressed
the Council regarding the need for an institutional
zone to handle situations like the Boys and Girls
Club.
The Council determined to go through the proposed
zoning ordinance page by page. Following are the
comments /requests for changes requested by the
Council:
Pages 1 - 5, no change.
Pages 6 - 10:
Add definition for "Church ".
Page 7, Day Care Facility, insert "before"
prior to "after- school care for..."

Page 7, compare "Commercial Vehicle"
definition with Commercial Vehicle Code.
Page 9, delete definition for "Family ".
Page 10 and 11, Hazardous Material and
Hazardous Waste - In response to Council
question, Mr. Porter said the definitions were
consistent with the County and State codes.
Page 11, Home Occupation, make sure definition
is internally consistent.
Pages 11 - 15:
Page 14, add vehicles under Motion Picture and
Television Production.
Pages 16 - 20:
Page 16, delete Qualified Senior Housing
Development.
Page 18, delete Senior Citizen, Senior
Household, and Senior Unit.
Page 19, Sight Triangle, speed limits should
be a part of sight distance.
Page 20, Swap Meet, add "for which a fee is
paid for admittance" so that there is a clear
distinction between garage sales and swap
meets. Vehicle Abandoned, check for
consistancy with Vehicle Code and /or Municipal
Code.
Pages 21 - 25, no change.
Pages 26 - 30:
Page 27, Sec. 8104 -6.1 - is PC Zone still
needed?
Page 29, f. - change Sec. 8105 -3s to "8105 -
3r".
"Institutional Zone" needs to be added to the
definitions.

Pages 31 - 35:
Page 33, eliminate the requirement for a CUP
in any zone for churches.
Pages 36 - 40:
Page 36, Permitted Uses in Commercial and
Industrial Zones - In response to Council
question, Mr. Kueny said staff would review
this section with the General Plan for
consistency.
The Council determined that it should be
revised to be "adjacent and /or within 100
feet" and that the director of Community
Development would be able to determine if it
should be a major or minor modification.
Pages 41 - 46:
Page 41, the setback definitions need to be
defined here; Sec. 8116 -1 should have the last
sentence "For qualified affordable /elderly
housing developments in the R -1, R -2 and RPD
zones" deleted.
Pages 46 - 50:
Page 48, define roof structures in the
definitions.
Pages 51 - 80:
Page 51, Sec. 8106 -8.6, a., standards to be
written; c., delete "Lighting shall be
designed to have a sharp cut -off at property
lines; g., to be deleted.
Page 54, the highlighted portion of Sec. 8107-
1.4 beginning "A bond or cash deposit shall be
required...." to reference the three
alternatives.
Page 59, all the animal units to be reviewed
and re- written.
Page 67, Sec. 8170 - 5.6.8, staff to review to
determine if Proposition 35 reporting should
be referenced.

Page 70, Sec. 8107 - 5.6.17, complete coverage
to be required for noise reduction.
Page 80, Sec.8107- 9.6.14, staff to review to
determine if Proposition 65 reporting should
be referenced.
MOTION: Councilmember Montgomery moved and
Councilmember Perez seconded a motion to continue
this matter to the next regular meeting; the public
hearing to remain open. The motion carried by
unanimous voice vote.
4. ADJOURNMENT:
MOTION: Councilmember Montgomery moved and
Councilmember Wozniak seconded a motion to adjourn.
