HomeMy WebLinkAboutMIN 1994 0323 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California March 23, 1994 A Special Meeting of the City Council of the City of Moorpark was held on March 23, 1994 in the Council Conference Room of said City located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 7:16 p.m. 3. PLEDGE OF ALLEGIANCE: 2. ROLL CALL: Councilmembers Hunter, Montgomery, Perez, Wozniak and Mayor Lawrason. Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Jim Aguilera, Director of Community Development; Deborah Traffenstedt, Senior Planner; Dirk Lovett, Assistant City Engineer and Lillian Hare City Clerk. 4. PROCLAMATIONS, COMMENDATIONS AND SPECIAL PRESENTATIONS: A. Proclamation in honor -)f Ventura County Fire Chief, George Lund, upon his retirement. Mayor Lawrason read the proclamation. 5. PUBLIC COMMENT: Connie Lawrason, 4192 Ambermeadow, requested community participation in the Library telethon. Mark Goodman, 147 Flory Avenue, said he was looking forward to the completion of the Moorpark Avenue drain. Lance Martin, 15528 Mallory Ct., spoke against the development by Kaufman and Broad of the 87 lots previously owned by Griffin Homes in the Campus Park area. He indicated that Kaufman and Broad have made unsubstantiated promises about a community pool. He said the homes will be smaller than those built by Griffin. 6. PUBLIC HEARINGS: A. Consider Draft Growth Manaqement Ordinance Developed b Ad Hoc Committee. Staff Recommendation: Open the public hearing for the purposes of obtaining public comments on the draft ordinance, close the public hearing, and direct staff as deemed appropriate. He reviewed the exemptions in the ordinance and went through the draft ordinance section by section. He said that Section 3, Yearly Allotments, is the most critical part of the ordinance. Mayor Lawrason opened the public hearing. Joyce Thompson, 12166 Rivergrove St., spoke as a member of the Measure F Ad Hoc Committee. She said the committee considered the goals of the General Plan in drafting the ordinance. She said the ordinance is an attempt to preserve the quality of life in the City. Dee Zinke, Building Industry Association, 24005 Ventura Blvd., Calabasas, addressed the Council. She provided a letter to the Council and then reviewed it with them. She indicated that the BIA failed to see the purpose of the proposed ordinance prior to December 31, 1995 when Measure F expires. She said the 250 annual building allocation under the proposed ordinance falls far short of the 270 building allocations per year agreed to in the Settlement Agreement between the City and the BIA. Bob Crockford, 7189 Walnut Canyon Road, said he was with the original Measure F Committee. He said this ordinance will give us control of our destiny in Moorpark. Councilmember Hunter suggested continuing this item. Councilmember Montgomery suggested looking at several meetings with one of those possibly being a Saturday meeting. He indicated i schedule should be determined over the summer. After Council discussion the following motion was heard: MOTION: Councilmember Montgomery moved and Councilmember Hunter seconded a motion to continue this matter to May 4, 1994, the public hearing to remain open; staff to provide analysis on the comments made in the Building Industry Association letter referenced by Dee Zinke this evening; the City Attorney to provide analysis on the defensibility of the draft ordinance and the document's relationship to the two settlement agreements relative to Measure F (BIA and Urban West Settlement Agreements); the School District and Water Works District I to be invited to attend the May 4 meeting. The motion carried by unanimous voi(-e vote. 7. Minutes of the City Council Moorpark, California ACTION /DISCUSSION ITEMS: Page 3 March 23, 1994 A. Consider the Draft Hillside Ordinance and Set a Public Meeting Date for Its Review. Staff Recommendation: Direct staff as deemed appropriate. (Continued Item 11.G. from 3/16/94) Mr. Aguilera gave the staff report. MOTION: Councilmember Wozniak moved and Councilmember Montgomery seconded a motion to set a meeting with the Planning Commission for April 27, 1994 to discuss this draft ordinance and as the Council /Commission annual meeting. The motion carried by unanimous voice vote. B. Consider Request to Co- Sponsor CPR /Safety Training with Ventura County Fire Department. Direct staff as deemed appropriate. (Continued Item i1.L. from 3/16/94) Mr. Kueny gave the staff report. Councilmember Montgomery said the event would not provide certification to those attending but would be beneficial training. Mayor Lawrason suggested that Pruner Ambulance Service might be able to hold a CPR certification class in conjunction with the proposed CPR /Safety Training class. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to co- sponsor CPR /Safety Training with Ventura County Fire Department; to waive any fees associated with facilities rental and absorb any direct expenses; to invite Pruner Ambulance Service to participate in the event by holding a concurrent CPR certification class. The motion carried by unanimous voice vote. MOTION: Councilmember Montqomery moved and Councilmember Perez seconded a motion to adjourn to Closed Session for a discussion of the following: 8. CLOSED SESSION E. Negotiations for Real Property at 675 Moorpark Avenue (Moss) and 661 Moorpark Avenue (Aikens) and vacant land on Moorpark Avenue, APN 511- 050 -090 (Aikens) , pursuant to Government Code Section -4956.3. Negotiations with Caltrans for Real Property (a Portion of the Community Center) at 799 Moorpark Avenue pursuant to Government Code Section 54956.8. rAP o I. Negotiations for Real Property on Poindexter Avenue (APN 511 -08 -16 - Gisler) pursuant to Government Code Section 54956.8. The motion carried by unanimous voice vote. Present in Closed Session were all Councilmembers; Steven Kueny, City Manager; and Richard Hare, Deputy City Manager. The Council reconvened into Open Session at 9:27 p.m. Mr. Kueny stated there was no action to report out of Closed Session and only items 8.E, .8.H. and 8.I. had been discussed. ACTION /DISCUSSION: C. Consider Acquisition of Property Located at 661 Moorpark Avenue (Parcel 511 -0- 050 -140). Staff Recommendation: 1) Authorize the purchase of property in an amount of $221,500.00 which includes one half (1/2) of the escrow fees for Parcel 140 with $184,350.00 from account 01.4.142.901 for land acquisition and $37,150.00 from account 01.4.142.902 for building acquisition, 2) Authorize the City Manager to execute the necessary documents for the acquisition. MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to approve the staff recommendation as listed above. The motion carried by unanimous roll call vote. CLOSED SESSION MOTION: Councilmember Montgomery moved and Councilmember Perez seconded a motion to adjourn to Closed Session for a discussion of Personnel. The motion carried by unanimous voice vote. Present in Closed Session were all Councilmembers; and Steven Kueny, City Manager. The Council reconvened into Open Session at 9:42 p.m. Mr. Kueny stated there das no action to report out of Minutes of the City Council Moorpark, California Page 5 March 23, 1994 Closed Session and only Personnel had been discussed. 9.
