Moorpark, California June 8, 1994
An Adjourned Regular Meeting of the City Council of the City of
Moorpark was held on June 8, 1994 in the Council Chambers of said
city located at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 7:15 p.m.
2. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was led by Councilmember Montgomery.
3. ROLL CALL:
Present: Councilmembers Hunter, Montgomery, Perez,
Wozniak and Mayor Lawrason

5. PUBLIC COMMENT:
Gerald Goldstein, 11932 Los Angeles Avenue, related his
experience as an election official.
6. COMMITTEE REPORTS:
None.

7. PUBLIC HEARINGS:
A. Consider Amendments to the Carlsberg Specific Plan and
Draft EIR, Resolution No. 94- . Amendment to Land Use
Element of the General Plan to Reflect Amended Land Uses,
and Amendment of the City's Zoning Ordinance to Adopt
Amended Land Use Regulations of the Specific Plan as
Zoning for the Property. Staff Recommendation: Review
and approve the amended Carlsberg Specific Plan as
amended and adopt Resolution No. 94- and findings
amending the Land Use Element of the General Plan to
ref lect the amended land uses and introduce for f irst
reading the Ordinance to amend the City's Zoning
Regulations in order to adopt the amended land use
regulations of the Specific Plan as Zoning for the
property; and Adopt the attached Resolution Certifying
the Environmental Impact Report. (Continued Item 9.A.
from 5/18/94; Item 9.A. from 6/1/94) (Hearing Closed)
Mr. Kueny indicated that the settlement agreement was to
be discussed in committee tomorrow and a conclusion to
this item should be forthcoming.
MOTION: Councilmember Wozniak moved and Councilmember Hunter
seconded a motion to continue this matter to the July 6, 1994
City Council meeting. The motion carried by unanimous voice
vote.
CONSENSUS: By consensus, the Council determined to take the
next two items, 7.B. and 7.C. concurrently.
B. Consider Making Certain Changes to Lighting and Landscabe
Maintenance Assessment District (AD84 -2) and Confirming
the Assessments for Fiscal Year 1994/95. Staff
Recommendation: Open the public hearing, receive
testimony and continue these matters to the date of the
Budget Workshops. [Note: Subsequent to the budget
workshop meetings, but no later than June 30, 1994, staff
recommends that the City Council adopt Resolution No. 94-
making certain changes to AD84 -2 and confirming the
assessments for Fiscal Year 1994/95. (Continued Item 9.C.

C. Consider Making Certain Changes to Parks Maintenance
Assessment District (AD85 -1) and Confirming the
Assessments for Fiscal Year 1994195. Staff
Recommendation: Open the public hearing, receive
testimony and continue these matters to the date of the
Budget Workshops. [Note: Subsequent to the budget
workshop meetings, but no later than June 30, 1994, staff
recommends that the City Council adopt Resolution No. 94-
making certain changes to AD85 -1 and confirming the
assessments for Fiscal Year 1994/95.

OPEN
Mr. Kueny said that traditionally Assessment District
84 -2 and 85 -1 are continued with the public hearing open
through the budget deliberations. He said he recommended
continuance to the meeting of June 15, 1994.
In response to Mayor Lawrason, Ms. Hare indicated that
there were no speaker cards.
CONSENSUS: By consensus, the Council determined to continue
items 7.B. and 7.C. to June 15, 1994 with the public hearings
open.
8. ACTION /DISCUSSION:
A. Consider Status Report of 1993/94 Objectives and Consider
1994/95 Goals and Objectives. Staff Recommendation:
Continue to the May 14, 1994 Town Hall Meeting.

5/18/94; Item 11.A. from 6/1/94))
CONSENSUS: By consensus, the Council determined to defer this
item until later in the evening.
B. Consider Hiring a Consulting Geotechnical Engineering and
Engineering Geologist for Review and Comment on
Development Related Matters. Staff Recommendation: 1)
Direct staff to procure proposals from qualified
engineering geological and geotechnical engineering
companies; 2) Upon selection of the qualified company,
direct staff to present this information to the City
Council for final selection and award of a contract to
the selected company or companies. (Continued Item 11.L.

Mr. Aguilera gave the staff report.

In response to Mayor Lawrason, Mr. Aguilera said that
development is moving into hillside areas where the City
will encounter geological issues. He indicated that in
planning, the staff needs to know where the hazards lie
so we can plan around them. He said a set of guidelines
are needed.
In response to Councilmember Wozniak, Mr. Aguilera said
the cost for this request will be recovered through
development projects.
Mr. Abbott said that his firm used guidelines, although
those guidelines were informal. He said he believed the
City needed to remain in "review mode" and said he did
not consider this action necessary.
Councilmember Hunter suggested amending staff
recommendation 2 to read "the Council may make an award
of contract."
MOTION: Mayor Lawrason moved and Councilmember Hunter
seconded a motion to approve the staff recommendations with
the amendment of recommendation number 2 that the Council
"may" award a contract. The motion carried by unanimous voice
vote.
A. Consider Status Report of 1993/94 Objectives and Consider
1994/95 Goals and Objectives. Staff Recommendation:
Continue to the May 14, 1994 Town Hall Meeting.

Mr. Kueny reviewed with the Council the status report on
the 1993/94 Goals & Objectives.
Public Works
Administration:
The Council directed that number 8 be retained in 1994/95
as a high priority (double asterisk) item but reworded
to become more generic in terms of the site to be
established with regard to a lease agreement with the
County of Ventura for the use of a portion of Waterworks
District #1 property as a Public Works Maintenance Yard
or selecting an alternative site and plan for relocation.
The Council directed that number 20 be retained in
1994/95 as a double asterisk item relative to evaluating
the feasibility of having an in -house City Engineer.

Community Development
Councilmember Montgomery said that it would be important
for the Department of Community Development to "watch"
non - billable hours.
The Council discussed the benefit of having agenda staff
reports indicate the billable /non - billable hours required
to accomplish a Council directed task. The Council also
requested that staff provide the estimated number of
hours for the 1994/95 objectives of the department.
Administration:
The Council directed that in number 8 "applicant" and
"draft EIR" should be deleted and Ventura County be
monitored for any work on the Happy Camp Regional Park
development plan.
Current Planning:
The Council directed that number 2 relative to improving
the standard development project conditions used for each
type of entitlement should be reviewed concurrently by
the City Council.
The Council directed that number 7 have the double
asterisks deleted relative to completing an update to the
Housing Element by July 1, 1994.
Building & Safety:
The Council directed that number 2 have priority (one
asterisk) added relative to evaluating moving Building
and Safety services to the City Hall complex.
Public Safety
The Council noted that under the Patrol Services heading,
the last word in the sentence was missing.
Mr. Kueny reviewed with the Council the status report on
the 1993/94 Goals & Objectives for Public Safety.
Public Safety - FY1994195
The Council directed that number 2 under Administration
should be changed to "Evaluate alternative sites for
future police station ". The Council requested that the
"break point" for the City having its own facility be
evaluated in exploring the possibility of a Police
Facilities Fee.

Administration:
The Council directed that an item be added with a double
asterisk to address establishment of a police store front
at Los Angeles Avenue or High Street site.
Councilmembers Perez and Montgomery said they did not
support a double asterisk for a police store front until
it was determined what the budget would allow.
Patrol:
The Council directed that an item be added that there be
at least 200 hours of commercial vehicle enforcement.
The Council directed that number 3 include language
regarding education programs for the seat belt and DUI
laws.
Community Services officer:
Number 2 to be changed from "Maintain" to "Enhance"
active level of Neighborhood Watch.
The Council directed that number 1 should be an added
item -- the Dare Program.
AT THIS POINT in the meeting a recess was declared. The time
was 9:20 p.m.
The meeting was reconvened and recessed at 9:40 p.m.
The Council reconvened at 10:00 p.m.
9. CLOSED SESSION:
MOTION: Councilmember Montgomery moved and Councilmember
Hunter seconded a motion to adjourn to Closed Session for a
discussion of 9.I.:
I. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (pursuant to
Government Code Section 54957)
Title: City Manager, Deputy City Manager, Director of
Community Services, Director of Community Development,
Public Works Director, City Clerk, Chief of Police, City
Engineer, and City Attorney
The motion carried by unanimous voice vote.
Present in Closed Session were all Councilmembers. No staff
member was present.

The Council reconvened into open session at 11:00 p.m. Mayor
Lawrason stated that there was no action to report out of
Closed Session and only item 9.I. was discussed.
10. ADJOURNMENT:
Mayor Lawrason adjourned the meeting. The time was 11:00 p.m.
