Moorpark, California August 24, 1994
A Special Meeting of the City Council of the City of Moorpark was
held on August 24, 1994 in the Conference Room of said city located
at 799 Moorpark Avenue, Moorpark, California.
1. CALL TO ORDER:
Mayor Lawrason called the meeting to order at 5:10 p.m.
2. ROLL CALL:
Present.: Councilmembers Montgomery, Wozniak and
Mayor Lawrason
' Absent: Councilmembers Hunter and Perez
Staff: Richard Hare, Deputy City Manager; Lillian
Hare, City Clerk; Dorothy Vandaveer, Deputy
City Clerk
3. PUBLIC COMMENT:
Gerald Goldstein, 11932 Los Angeles Avenue, spoke regarding
election procedures. Mr. Goldstein spoke in favor of the City
holding the election so the voters can exercise their right to
vote.
°i Eloise Brown, 13193 Annette Street, spoke in favor of the City
conducting the election in November instead of the City
Councilmembers appointing the three Incumbents.
Lynn Owens, 4647 Adonis Place, submitted a letter to be read at
the meeting. Mayor Lawrason read the letter which expressed
Mrs. Owens' support for the City conducting the election in
November.
4. ACTION /DISCUSSION:
A. Consider Adopting a Course of Action Pursuant to Elections
Code 22843.5 to (1) Appoint to the Office of Mayor and Two
Councilmanic Seats the Respective Incumbents as the Only
Nominees: or 2) Hold the November 8, 1994 Municipal
Election. Staff Recommendation: Direct that the election
be held or adopt Resolution No. 94 -1059 giving notice of
the appointment to the offices of Mayor and two
Councilmanic seats.
The City Clerk read into the record a statement prepared by
Councilmember Hunter which expressed his support for the
election being held in November.

CONSENSUS: By consensus, the Council determined to include into
the formal record letters which had been submitted by
Councilmember Bernardo Perez in support of appointing the
incumbents and saving the cost of the election and by resident,
Roy E. Talley, in support of holding the election, and to waive
reading of the letters.
Ms. Hare gave a brief staff report.
Mayor Lawrason explained the Election Law and how it
relates to the current election situation. He indicated
his struggle in coming to a decision, but said because of
the tax dollar savings of almost $5,000 and the support he
heard in the community for not holding the election, he
would vote to appoint the incumbents.
Councilmember Montgomery stated that the citizens should be
allowed to vote for Councilmembers even if the candidates
are running unopposed on the ballot. He said he feels it
is "almost un- American" not to have a scheduled election.
Councilmember Wozniak said he finds it difficult to be in
• position to appoint oneself to a Council seat, but from
• fiscal standpoint, he does not believe the election
should be held. He said constituents he talked to did not
favor holding the election.
MOTION: Mayor Lawrason moved and Councilmember Wozniak seconded
a motion to adopt Resolution No. 94 -1059 giving notice of the
appointment to the offices of Mayor and two Councilmanic Seats.
The motion carried 2 -1 roll call vote, Councilmember Montgomery
dissenting and Councilmembers Hunter and Perez absent for the
vote.
ADJOURNMENT:
Mayor Lawrason adjourned the meeting at 5:51 p.m.
