HomeMy WebLinkAboutMIN 1995 0524 CC SPCMINUTES OF THE CITY COUNCIL Moorpark, California May 24, 1995 A Special Meeting of the City Council of the City of Moorpark was held on May 24, 1995 at the Moorpark Community Center, located at 799 Moorpark Avenue, Moorpark, California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 6:40 p.m. in the Conference Room. 2. ROLL CALL: Present: Councilmembers Hunter, Montgomery, Wozniak and Mayor Lawrason Absent: Councilmember Perez Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Christine Adams, Director of Community .1-ervices; Lillian Hare, City Clerk 3. ACTION /DISCUSSION: C. Consider Fourth of July Fireworks Program. Staff recommendation: Consider including funding for proportional contribution for a July 3 or 4, 1995 event in the 1995/96 City budget. Ms. Adams gave the staff report. CONSENSUS: By consensus, the Council determined to direct staff that if a contribution is to be requested at the event, the City will reschedule the c3ncert. D. Reconsider Membership of Board of Appeals. Staff Recommendation: Rescind Resolution No. 95 -1110 and authorize appointment of hearing officer to serve as Board of Appeals. MOTION: Councilmember Wozniak moved and Councilmember Montgomery seconded a motion to adopt Resolution No. 95 -1125 rescinding Resolution No. 95--1110. The motion carried by voice vote 4 -0, Councilmember Perez absent for the vote. E. Consider Proposed Goals and Objectives for 1995196. Councilmember Perez joined the meeting at 6:50 p.m. B. Consider Amicus Brief Harris V. County of Madera - unfunded Mandates Related to Housing Element Law. Staff Recommendation: Join Amicus. Ms. Hare gave the staff report. Councilmember Perez expressed his concern with this matter as it related to the consideration of a County's compliance with updating its Housing Element. MOTION: Mayor Lawrason moved and Councilmember Montgomery seconded a motion to approve joining the amicus. The motion carried by voice vote 4 -1, Councilmember Perez dissenting. AT THIS POINT in the meeting, a recess was declared. The time was 7:00 p.m. The Council reconvened into Open Session in the Council Chambers at 7 :15 p.m. ROLL CALL FOR PLANNING COMMISSION: Present: Commissioners Acosta, Martens, May, Miller, and Chairman Torres Staff Present: Steven Kueny, City Manager; Jim Aguilera, Director of Community Development; Debbie Traffenstedt, Senior Planner; Lillian Hare, City Clerk; John Whitman, City Traffic Engineer; Dirk Lovette, Assistant City Engineer 3. ACTION /DISCUSSION: A. Freeways) for the Moorpark Area of Interest. North of Los Angeles Avenue. Staff Recommendation: Conduct a joint City Council /Planning Commission workshop, accept public comments, and direct staff as deemed appropriate. Mr. Aguilera presented an introduction to the workshop outlining its purpose and summarizing the General Plan Update and Sphere of Influence study completed in 1992. a004� Minutes of the City Council Moorpark, California Page 3 May 24, 1995 Terry Austin of Austin -Foust Associates, gave an overview of the circulation element of the City's General Plan. He spoke regarding the approved Circulation Element, highway /roadway network and assumptions related to Route 118 and 23 extensions. Richard Poole, Associated Transportation Engineers, the City's Traffic Consultant, gave an overview of Specific Plan No. 8's Traffic Study. He indicated that Campus Park Drive with certain modifications could accommodate all traffic from the Specific Plan No. 8 project. Eddie Ramseyer, engineer for JBR, spoke regarding Specific Plan No. 2, preliminary circulation system alternatives. He discussed Routes 118 and 23 extension alignments and collector roadway extension options. Mr. Aguilera discussed the pros and cons of locating the future Route 118 freeway north of the City to connect with and be coincident with the future Route 23 extension south of Broadway. He discussed the pros to be 1) remove Route 118 freeway from existing residential areas in the City to prevent divisior of present city by a future freeway; 2) provide ability to plan future commercial /industrial land uses adjacent to future freeway; 3) potentially less growth inducing impacts on prime agricultural land; 4) improved access for mining operations_ He discussed the cons as being 1) right of way already planned/ dedicated; 2) area where northerly route 118 freeway could be located is outside of the current city limits and City doesn't control development; 3) there is no investigation of feasibility for a northerly alignment (topographic constraints, right of way requirements, impacts); and a study would need to be funded; 4) Los Angeles Avenue, in the City, may carry more traffic; 5) growth inducing impacts; 6) City would assume maintenance and improvement responsibility for Walnut Canyon Road /Moorpark Avenue and Los Angeles Avenue /New Los Angeles Avenue. CITY COUNCIL /PLANNING COMMISSION DISCUSSION: Councilmember Wozniak asked if the right of way dedications in the County are known. 00603 Minutes of the City Council Moorpark, California Page 4 May 24, 1995 In response to Councilmember Wozniak, Mr. Ramseyer indicated that the only existing right of way dedications were east of Bradley and west of Somis. Councilmember Wozniak said we need to find out specifics on the right of way dedications even if we do not do a northerly study for the realignment of the 118 freeway. Councilmember Wozniak indicated that the number of lanes on Moorpark Avenue between Second Street and Los Angeles Avenue is incorrectly identified in the draft traffic study for Hidden Creek Ranch Specific Plan (page 3.7 -8). In response to Commissioner Martens, Mr. Poole indicated that the traffic impacts to Campus Park Drive would be from 3,221 homes. He said there would be necessary improvements at the Collins Drive intersection and freeway interchange improvements In response to Councilmember Hunter's question regarding how the Moorpark College figures into the traffic circulation calculations, Mr. Poole indicated that the City's General Plan had been used as the basis for the projection and the figure:, which it contained relative to college enrollment. In response to Commissioner May's question regarding any discussion of Caltrans' cooperation with the City regarding the realignment of 118, Wallace Rothbert, Chief of Project Studies, Caltrans District 7, said he was not in a position to commit to anything for Caltrans this evening. He said Caltrans had participated with the City in the first route study In response to Council question, Mr. Whitman indicated that the estimated cost for the 118 connection and roadway as presently proposed would be $37.3 million. In response to Chairman Torres, Jim Aguilera indicated that the schedule for the 118 connection was 20 years away on Caltrans' timeline. Councilmember Perez expressed his desire that the County and City work productively together relative to the northern area outside the City limits. He noted that sometimes the City had not been informed in a timely fashion regarding developments in that area. Minutes of the City Council Moorpark, California Page 5 May 24, 1995 Commissioner Acosta stated that the increase in crime in having a freeway coming straight into the City from the San Fernando Valley had not been considered and needed to be. Dan Holmes, 200 Wicks Road, representing Waters Ranches and Saint George Farms both located northwest of the City along Broadway, said they do not want the freeway going through that area. He said they like their privacy and they don't want this area industrialized. He also commented that the traffic study is difficult to understand. He said he has a lot of questions and doubts relative to the accuracy of the study. Michael Greynold (not certain of the spelling), General Partner of Morrison Homes (Specific Plan Area No. 2) addressed the Council regarding circulation with regard to their joint venture development of this area with JBR Development. He said Specific Plan No. 2 is severely impacted with any of the proposed alignments. Additionally, he said they recognize the need for Specific Plan 2 to fit into a comprehensive plan. He said they want to protect the rights -of -way for State Routes 23 and 118 relative to their development. Eloise Brown, 13193 Annette Street, commented on the last price increase of the 118/23 connector. She said the Council cannot rely on the accuracy of the numbers being presented. She also mentioned that the rights -of -way being held are sometimes protected unnecessarily for years and the people are displaced long before they need to be. She said the Campus Park Drive situation needs to be looked at very carefully as it is a public road and that the concept of "glor.-_ettas" or "roundabouts" must be carefully considered. Bob Haaland, the Haaland Group, civil engineers on the Messenger project, said they were involved in the extension of 118 from Highway 1 to 101 in Oxnard. He said it was done in phases and the circulation was allowed to adjust and develop as each step was accomplished. He said the "ring road" concept on the north side of the City would preserve Los Angeles Avenue as an internal system to serve the City. He said a full ring isn't needed because on the south side there is Los Angeles Avenue and Tierra Rejada Road which balance out the circulation system. He said Caltrans should keep 118 through the Los Posas valley separated quite a distance from the current Los Angeles Avenue. "085 Minutes of the City Council Moorpark, California Page 6 May 24, 1995 Mary Cruz, a Gabbert Canyon community resident, said she is encouraged by what they are hearing tonight. She said the building of a freeway does not have to mean that the area will be industrialized. She commented that level of service C in circulation is not good enough for the City to aspire to achieve. She said the developers need to "take it easy" and not be so anxious to develop. She said college students could help Caltrans develop some of the plans for the freeways. She said there should be a Walnut Canyon offramp. Barbara Wilhelm, a resident of Gabbert Canyon, commented that Walnut Canyon needs an offramp. She said she would like to see the freeway above the City and not going through the City. She said the City needs another grocery store. Butch Britt, representing the County of Ventura Planning Department, commented that the State Transportation Improvement Program has a shortfall of $3 - $5 billion dollars. He explained that as a result, Caltrans may not be able to do much in terms of a new project as discussed earlier. Mr. Britt said the County General Plan dictates an agreement would have to happen to mitigate impact on County roads if the freeway realignments take place. Mr. Aguilera said the next step in the process would be to agendize this matter for a Council meeting and have a discussion of this matter and have staff outline alternatives. Mr. Kueny indicated that July would be the soonest this matter it could be agendized. ADJOURNMENT OF THE PLANNING COMMISSION: Chairman Torres adjourned the Planning Commission. CLOSED SESSION: May 24, 1995 MOTION: Mayor Lawrason moved and Councilmember Perez seconded a motion to adjourn to Closed Session for discussion of items 4.A. and 4.B. A. PUBLIC EMPLOYEE PERFORMANCE EVALUATION (pursuant to Government Code Section 54957) Title: City Manager, Deputy City Manager, Director of Community Services, Director of Community Development, Public Works Director, City Clerk, Chief of Police, City Engineer, and City Attorney B. CONFERENCE WITH LABOR NEGOTIATOR (pursuant to Government Code Section 54957.6) Agency Negotiator: Steve Kueny Employee Organization: Service Employees International Union Local 998, AFL -CIO, CLC (Public Employees Association of Ventura County) The motion carried by unanimous voice vote. Present in Closed Session were all Councilmembers; Steven Kueny, City Manager and Richard Hare, Deputy City Manager. The Council reconvened into Open Session at 9:40 p.m. Mr. Kueny stated only Item 4.B. was discussed and there was no action to report. 5.
